Guernsey, the Prosecuting Attorney for Grant County,- IN Washington, and pursuant to the authority of RC.W 36.27.040, here -by appoints Anthony Menke of Menke Jackson Beyer, LLP, of Yakima, Washington, to serve as a Special Deputy Prosecutincr Attomey pursuant to the terms below- Z: tion The Prosecuting Attorney appoints a SPECIAL DEPUTY PROSECUTING ATTORNEY (S.D.) to perform and render legal assistance and counsel regarding labor law, employment law, and personnel matters, and such other matters and proceedings, as required by the Prosecuting Attorney or designee. S e c t i 9). nt. 2z: SERVICES The S.D.'s duties shall include, when necessary, the preparation of all legal documents for the proper conduct of proceedings pertaining to labor law, employment and personnel matters, and legal guidance, counsel and assistance, supervision and consultation including, but not limited to, Hirincy and discipline processes, negotiat* ns,-, me d*at* tons and arb-itrations, PERC iot proceedings, grievances, and any other matters as required by the Prosecuting Attorney and/or Human Resources Director or designee. Sep iga.,11 COMPENSATION AND STATUS The S.D. shall be paid Two Hundred Forty and no/ 100 Dollars ($2 0.00) per hour for negotiations, mediation services, arbitrations, administrative law matters, and litigation I Menke SPECIAL DEPUTY PROSECUTING ATTORNEY services performed by Mr. Menke and/or partner attorneys; Two Hundred and no/100 Dollars ($2 per hour for all work performed. by associate attorneys; and One Hundred and no/1 00 Dollars ($100.00) per hour for all work performed by legal. assistants. Fees charged will be based on a one -quarter hour minimum. Travel time will be billed at the hourly rate. Monthly bills and a case status update shall be submitted to the Civil Deputy Prosecuting Attorney for tracking and payment by Grant County. 6gdj=4.z- TERM. This Agreement shall be in full force and. from appointment through December 31, 2026, unless otherwise terminated or extended by the parties. This Agreement may be terminated at any time by either party upon written not -ice. Section..5. CONFLICTS OF INTEREST Notwithstanding anything to the contrary contained herein, S.D. shall not and shall have no obligation to provide legal services under this Agreement where to do so would or could reasonably be construed to rise to a conflict of interest under the Washington Rules of Professional Conduct (RC).1n any instance in which S.D. is prohibited from providing legal services under thi's Agreement by reason of an actual or potential conflict of *interest, S.D. shall have no duty or obligation to provide the Prosecuting Attorney for Grant County, Washington, Grant County or any other party or third -party with conflict counsel.
