SURRENDER OF LEASEHOLD — MOSES LAKE DUNES
To the Commissioner of Public Lands:
Grant County is presently lessee (hereafter "Lessee") under State Lease No. 60-B69048
(hereafter "Lease") of the following state-owned lands managed by the State of Washington
Department of Natural Resources (hereafter "State") :
LAND DESCRIPTION:
All, except that portion along the western boundary subject to flooding by the Potholes
Reservoir, Section 16, Township 18 North, Range 28 East, W.M., Grant County, Washington,
containing 570 acres, more or less, according to the government survey thereof.
Subject to the rights of the holder of Department of Natural Resources Water Rights No.
78-W03193, filed on June 18, 1974.
Subject to the restrictions of the Reclamation Reform Act of 1982, as filed under Water
Rights file No. 78-W0235.
Lessee understands the State intends to sell/transfer to Grant County all of the Lease area
associated with the State purchase and sale agreement number 02-108265, effective July 22,
2025. Lessee is willing to voluntary surrender the Lease conditioned upon the successful
sale/transfer and closing of the Premises, such surrender to become effective on the closing date
of the sale/transfer. The effective date of surrender will be inserted into this surrender at or prior
to closing. This lease surrender is further conditioned upon no reimbursement to Lessee of any
advance rent paid.
Effective December 8th1 2025, Lessee surrenders all of its right, title, interest or benefit to
the Premises. Lessee releases and forever discharges the State from any and all actions, liability,
or claims which Lessee might have or had by reason of any matter, cause or thing arising o ut of
said lease and occupation of the Premises. Lessee represents that all outstanding rents, duties and
obligations under the Lease have been paid and fulfilled.
Lease No. 60-B69048 Surrender of Lease
The reason for this surrender is to facilitate the State in its sale/transfer of a portion of the
Premises to Grant County under the State purchase and sale agreement number 02-108265.
The Lessee has executed this surrender of Lease as of the date set forth below.

DEPARTMENT ACCEPTANCE OF SURRENDER
As this lease is in good standing and may be canceled under Subsection 4.03 of said
lease, it is ordered that the foregoing surrender be accepted and Lease No. 60-B69048 be
canceled effective December 81h, 2025, and the records of the Commissioner of Public lands be
so noted.
