Parcel 312777000 owned by applicant Shop City LLC is in the Rural Light Industrial (RLI) zoning designation of
Grant County. The Rural Light Industrial (RLI) zoning district is provided to allow light manufacturing, processing,
fabrication and storage of products, wholesale, warehousing, distribution and storage, equipment storage and
repair, and other uses compatible with a light manufacturing district. Brewery, distillery or wineries are an allowed
use in the RLI zone subject to Site Plan Review.
That said, the structures permitted in 2019, 2021, and 2023 under permit numbers BF 19-0841, BF 21-0493, and
BF 23-0134 were identified as "Storage Units" and were therefore reviewed and approved as S-1, or "Storage,"
occupancy with the corresponding fire protection requirements. Whiskey distillation facilities, however, are
generally assigned different occupancy classifications based on the specific operations and the volume of alcohol
stored or processed within the building.
Typical Occupancy Classifications:
• F-1 (Factory Industrial, Moderate Hazard): Most small craft distilleries are classified as F-1 if the total
quantity of spirits is below the Maximum Allowable Quantity (MAQ) for flammable liquids.
H-3 (High -Hazard): When the volume of high -proof alcohol stored or processed in the facility exceeds the
MAQ, or when there are significant quantities of flammable or combustible materials present, the distilling
area must be classified as H-3 occupancy. This group involves stricter fire protection requirements.
Upgrading a building from S-1 (Moderate -Hazard Storage) to H-3 (High -Hazard) occupancy generally requires
significant modifications to comply with fire and life safety codes and a Tennant Improvement (TI) permit. The key
upgrades typically involve enhanced fire protection, separation, ventilation, egress, and containment systems.
1. Automatic Sprinkler System: H-3occupancies must have a building -wide automatic fire sprinkler system
installed to NFPA standards.
2. Fire Barriers and Separation: Fire -rated walls and barriers (often 2-hour minimum) are required to separate
H-3 areas from other occupancies, with fire -rated doors and ceilings as needed.
3. Ventilation and Exhaust: Specialized mechanical ventilation to prevent accumulation of flammable vapors.
4. Secondary Containment: Alcohol and other hazardous liquid storage often requires containment systems.
5. Detection and Alarm Systems: Installation of automatic fire detection and alarm systems.
6. Utility and Equipment Upgrades: Electrical systems may need to be upgraded with explosion -proof fixtures
and wiring.
