HomeMy WebLinkAboutResolution 25-075-CCBOARD OF COUNTY COMMISSIONERS Grant County, Washington RESOLUTION FOR VACATING RESOLUTION No. 25- OT�-CC a portion of unbuilt Old County Rd. 528 known as W-NW rights -of -way, Sections19, 20,29 & 30 all in T21N R23EWM WHEREAS, Grant County, Washington, has reviewed certain County road and rights -of -way described as follows; Legal description: Grant County unbuilt Old County Road 528, also known as W-NW rights -of -way, Sections19, 20, 29 & 30 all in T21N R23EWM Grant County, Washington, AS SHOWN on ATTACHED EXHIBIT A; and WHEREAS, Hawthorne Renewable Energy is planning construction of a large solar farm in conjunction with neighboring parcels to serve growing electrical needs, and known as Appledale; and, WHEREAS, the Board of County Commissioners has determined that consideration should be given to vacating portions of certain County roads and rights -of -way and directs the County Road Engineer to prepare a report on the vacation and abandonment of said rights; and WHEREAS, the Notice of Hearing Resolution 25-063-CC on the vacation and abandonment was published in the County official newspaper at least once a week for 2 consecutive weeks preceding the fixed date for the hearing, and a copy of said Notice was posted for at least 20 days preceding the date fixed for hearing at each termini of the county road or portion thereof to be vacated or abandoned, and NOW, THEREFORE, BE IT HEREBY RESOLVED THAT the Grant County Board of Commissioners vacate and abandon all interest in the County Road Rights -of -way as described above, and as shown on attached Exhibit A, except any existing easements, franchises, and utilities. Grant County reserves the right to enforce future dedication requirements should the Appledale facility not be built. Grant County also reserves the right to withhold filing this resolution if any agreement for protecting existing Grant County roads and rights is not met. DATED this (P day of , 2025.
