HomeMy WebLinkAboutAgreements/Contracts - Renew (003)MEMORANDUM OF AGREEMENT FLSA Status for Representecl Exempt and Non -Exempt Etnplouees of RENEW This Memorandum of Agreement (MOA) is entered into by and between Teamsters Local No. 760, representing the recognized employees of RENEW, hereinafter referred to as the "Union", and Grant County, WasHaigton, hereinafter referred to as the "Employer". The purpose of this agreement is to reclassify all Assessment Specialists, Initial Services Specialists, Therapists, Therapists — WISe Proaram, Therapist Interns, Therapist.2s, Community Crisis Responders, and. Youth Mobile Crisis Responders as non-exempt, for the purpose of calculating and payment of overtime for hours worked h-i excess of 40 during a workweek. This agreement will amend the contract to define these positions as Overtime Eligible Positions, and render the aforementioned positions eligible for overtime, retroactive to January 0 1, 2025. Pursuant to the Washington State Minimum Wage Act and in accordance with Grant County policies, 0 0 as approved by the Grant, County Board of County Commissioners, the Union and Employer agree to the following, effective January 1, 20225: Article 10 of the Collective Bargaining ainino, Agreement between Grant County and Teamsters Local 0 1 Union No. 760 re0crardincr Renew Clinical Staff will be changed. to read: 0 10.1 Definitions: a. Overtime Eligible Position: One that meets the criteria and eligibility for overtime payment, in accordance with the exemption tests and status defined under state and federal law. i. Provided, however, that all Assessment Specialists., Initial Services Specialists, Therapists, Therapists — WISe Program, Therapist Interns, Therapist 2s, Community Crisis Responders, and Youth Mobile Crisis Responders will be classified as overtime eligible, and non-exempt. b. Overtime Exempt Position: One that is defined. as Overtime Exempt, in accordance with the exemption tests and status defined under state and, federal law, and not eligible for overtime payment. Provided, however, that all positions listed in Article 10.1(a)(i) will not be Overtime Exempt Positions. Retroactive to January 1, 2025, any hours in excess of 40 worked by employees referenced herein, shall be compensated at one and one-half times their respective hourly rate and shall be calculated on the current wage scale in the CBA for 2025.
