ORDINANCE ESTABLISHING WALKWAY ORDINANCE No. 25- 03
-CC
SURFACE MAINTENANCE ALONG COUNTY
ROADS VIA RCW 47.48.010 AND NEW CHAPTER
10.50 OF THE GRANT COUNTY CODE
ENTITLED "WALKWAY SURFACE
MAINTENANCE ALONG COUNTY ROADS"
WHEREAS, the Board of County Commissioners of Grant County (Board) is the authority of
legislation and has authority as described in RCWs 47.48.010 and 46.61; and
WHEREAS, The Board desires sidewalks, trails, and footpaths along County roads to be
maintained for public use; and
WHEREAS, The County Engineer has determined that surface maintenance of sidewalks, trails,
and footpaths along County roads is infeasible by road maintenance plows and road maintenance
sweepers, as these large trucks would damage sidewalks, trails, and footpaths in doing so; and
WHEREAS, The County Engineer has determined that an Ordinance establishing Walkway
Surface Maintenance is needed; and
WHEREAS, a new Chapter is needed in the Grant County Code to reflect the desired Walkway
Maintenance; and
WHEREAS, the Chapter will be designated 10.50 "Walkway Surface Maintenance Along
County Roads"; and
WHEREAS, an Open Record Public Hearing was duly advertised and held on Tuesday, March
25, 2025 at 3:00 p.m. to consider this Ordinance and establish a new Chapter to the Grant County Code.
NOW, THEREFORE, BE IT ORDAINED THAT the Grant County Board of Commissioners order
Chapter 10.50 of the Grant County Code be established under title "Walkway Surface
Maintenance Along County Roads" as follows:
Section 1. Chapter 10.50 of the Grant County Code is hereby established as follows:
10.50.010 Declaration of policy
The Board of Commissioners of Grant County desires sidewalks, trails, and footpaths along County
roads to be maintained for public use.

Chapter 10.50.020 Definitions
For purposes of this chapter, the following words and phrases used herein shall have the
designated meaning unless a different meaning is expressly provided, or the context clearly indicates
otherwise:
Sidewalk: a raised concrete or asphalt walkway surface providing for pedestrian travel, that is
separated from road traffic by a raised concrete curb.
Trail: an at -grade gravel, asphalt, or concrete walkway surface providing for pedestrian travel,
which is separated from road traffic by a ditch, green strip, or other physical barrier.
Footpath: an at -grade native soil walkway surface providing for pedestrian travel, which is
separated from road traffic by a ditch, green strip, or other physical barrier.
Chapter 10.50.030 Walkway Surface Maintenance Along County Roads
It shall be the duty of persons occupying property or the legal property owner, if the property is
vacant, to provide walkway surface maintenance for sidewalks, trails, and footpaths along the
County Road frontage adjacent to their property. Walkway surface maintenance includes
keeping the sidewalks, trails, or paths free of snow, ice, winter sand, obstructions, and other
objectionable things.
Section 2. If any provision of this ordinance or its application to any person, entity or circumstance
is, for any reason, held invalid or unconstitutional, the remainder of the ordinance or its application to
other persons entities or circumstances shall not be affected.
Section 3. This ordinance, establishing 10.50 Grant County Code, shall be effective when signed.
