Grant County Juvenile Court LCA may individually be referred to hereinafter as "Party", or collectively referred to hereinafter as the "Parties". NOW, THEREFORE, THE COUNTY AND LCA AGREE AS FOLLOWS: SECTION 1: Scope of Services 1) The LCA "I AM JAGUAR" Program uses effective nonviolent, conflict resolution communication tools and cultural social -emotional learning curriculum to address and de-escalate aggressive behaviors that harm youth,. families, schools, and the community. 2) LCA critical intensive Case Management serves middle and high schools and ages 11-19 who have a history of affiliation with gang activity, gun violence, weapon violence difficulty attending school, and school suspensions. . 2) Education ongoing support- Students and families are provided one-on-one support such as working with parents, courts, school counselors, and teachers for youth to succeed in their education. A Language Case Manager and Parent coach who speaks the family's preferred language is assigned and/or interpreting service resources are provided. 3) Parental "coaching" Support- Parental coaching consists of three parts; parents/guardians are provided with a "parent leadership programming", LCA Parent Coach is assigned to check in with families every week, and community parent support meetings are hosted. 4) Community Resources- The LCA Case Manager and Parent Coach assess family needs and connect the family to community resources and LCA's and Grant County Workforce Development Programs. 5) LCA will work with Grant County Juvenile Court Services to receive referrals to enroll youth and families in the LCA Jaguar case management program., General Terms and Conditions A. Services to be performed: I I Page Grant County Juvenile Court Services/LCA MOU 2024-2025 Programming details: LCA Youth Violence Intensive Intervention Program: The LCA" I AM JAGUAR" Program is a Self - Actualization and Communication Program that addresses the dynamics that lead to miscommunication, aggression, and violence. By learning the LCA "I AM JAGUAR" curriculum participants use Latin American indigenous teachings to realize the fulfillment of their talents and potentialities. The program also incorporates an understanding of nonviolent communication techniques, self-respect, and how to de- escalate intense situations, it will help encourage healthier relationships and outcomes at home and school. The leadership pathway offers youth the opportunity to identify their true passion and j ourney. It incorporates social change activism goals so they may fully lead and contribute to building a more equitable, and prosperous future. The program allows participants to work on a variety of projects, including enhancing the program with their lived experiences and tracing the history of their family roots to understand their ancestor's journeys. Understanding trauma, attachment to trauma, and its impact on behavior that creates self -harm and to others. B. COVID-19 and Other Health & Safety Guidelines LCA and its staff performing work in furtherance of this Agreement will abide by any State, Federal, Local Government, or County and State laws, regulations, guidelines, or policies as it pertains to the prevention of infectious disease or other health and safety matters. C. LCA Needs: ❑x Meeting space during screenings if applicable 0 Assistance recruiting and/or identifying youth program participants into the LCA "I AM JAGUAR Program" 0 "Community Partner" badge(s) issued to staff if applicable The Site will attempt to provide a meeting space and/or supplies in the building for services to be conducted, if available. All reasonable efforts will be made to provide similar alternative spaces. The building leadership will have final authority over building use and availability issues The Grant County Juvenile Court staff will not provide clerical support or copying. E. Measures of Success and Accountability The County and LCA will agree upon measures of success and accountability for provided programming. LCA is required to: N Keep a list of participants served N Provide monthly communication and program updates with Grant County Juvenile Court and leadership. Tools for measuring goals/progress for Latino Civic Alliance measuring tools for program evaluation. Pre and post -surveys will be used to measure participants' connection to comply with probation post -release conditions, 2 1 P a g e Grant County Juvenile Court Services/LCA MOU 2024-2025 G. Payment (fill out in partnership with Grant County Juvenile Court ): NA The Grant County Juvenile Court Services wishes to agree with a (Latino Civic Alliance to assist in providing the referrals. There will be no charge to Spokane County Juvenile Courts. M Access to participant court status and probation terms and level Data: DATA SHARING AGREEMENT: The Grant County Juvenile Courts will share referring participant data with the Latino Civic Alliance for purposes of agency data collection and program evaluation: Including: • Family History and contact information • Participant DOB • Grades (includes credit/transcript information if applicable) • Probation terms & conditions • Behavior Incident Reports • Behavioral Health Community Provider referrals • Workforce Provider Referrals if applicable H. Background Checks: It is the responsibility of the LCA to make sure that all necessary background checks have been conducted before paid or volunteer staff are assigned to work with program participants. The -background check must be paid for by the LCA. The LCA agrees that all staff assigned to work under this Agreement have undergone a criminal history background check per RCW 43.43.830 through 43.43.834, 10.97.030, and 10.97.050 and/or through the Federal Bureau of Investigation: Fingerprints cleared by Washington State Patrol and Federal Bureau of Investigations: Required for all LCA staff paid or volunteers Driver Abstract: Required for all LCA staff and volunteers that will transport a participant. I. Confidential Student and Staff Infon-nation: LCA agrees that any participant information obtained through this Agreement is confidential and cannot be disclosed to a third party unless disclosure is required by law. 3 1 P a g e Grant County Juvenile Court Services/LCA MOU 2024-2025 SECTION 11 A. Professional Qualifications: (Latino Civic Alliancel declares that is has complied with all federal, state, and local laws regarding business permits, and licenses that may be required to carry out the work to be performed under this agreement. (Latino Civic Alliances further declares that is has the requisite qualifications, skills, and experience necessary to provide such services. ❑ N/A B. Independent Contractor: The parties agree this Agreement does not make any person an employee of the other party. LCA shall be an independent contractor and not an agent or representative of the Grant County Juvenile Courts about the services provided under this Agreement. No agent of LCA assigned to work at a County Courts location or for a contractor shall become a Grant County Juvenile Courts employee because of this Agreement. LCA is responsible for all wages and benefits owned by LCA staff, agents, or volunteers. Further, the Grant County Juvenile Courts retain the right to immediately prohibit any LCA staff, agent, or volunteer from coming onto county property if the County has good reason, which includes.but is not limited to violation of a county policy, procedure, or guideline. SECTION III A. Indemnification: LCA agrees that to the fullest extent permitted by law, LCA will hold harmless, defend, and indemnify the Grant County Juvenile Courts, its agents, employees, and board members from any liabilities, penalties, losses, damages, claims, expenses, attorneys' fees, taxes, expenses of litigation, judgments, suits, liens, and encumbrances, without limitation, arising out of or resulting from any acts or omission by LCA under this agreement. The county shall have the right to demand that LCA defend any claims, lawsuits, or proceedings related to services provided under the agreement, without cost to the Grant County Juvenile Courts with legal representation acceptable to the County. The terms of this section shall survive termination of this agreement. The Grant County Juvenile Courts agree that to the fullest extent permitted by law, the County will hold harmless, defend, and indemnify LCA, its agents, employees, and the board members from any liabilities, penalties, losses, damages, claims, expenses, attorneys' fees, taxes, expenses of litigation, judgments, suits, liens, and encumbrances, without limitation, arising out of or resulting from the negligence by the County. B. Insurance: LCA, at its own cost, shall maintain and provide evidence of the following insurance coverage: 4 P a g e Grant County Juvenile Court Services/LCA MOU 2024-2025 N71 General Liability insurance for bodily injuries (including sickness or death) and property damages in the minimum amount of $2,000,000 per occurrence, $3,000,000 aggregate. Spokane County Juvenile Courts its agents, employees, and board members shall be named as an Additional Insured. The policy shall include a Waiver of the Subrogation clause and a Primary & Non -Contributory clause. Sexual Abuse and Molestation insurance in the minimum amount of $2,000,000 per occurrence, $3,000,000 aggregate. ® Employers Liability (Washington Stop -Gap) for no less than $1,000,000 per occurrence. Automobile bodily injury and property damage liability in a minimum amount of $1,000,000 per accident for owned, non -owned, and hired vehicles. Professional Liability (malpractice) insurance for $2,000,000 per occurrence. NA F-1 I F-1 Lower Limits Approved Other • A. Termination: The Grant County Juvenile Courts may terminate the Agreement for cause immediately and may terminate this Agreement without cause, with 30 days' written notice to LCA. LCA may, at any time, terminate this Agreement, with 30 days written notice to the County. B. Other Provisions: 1. Entire Agreement. This Agreement constitutes the entire agreement between the parties and supersedes all prior oral or written agreements, commitments, or understandings concerning the matters provided herein. 2. Amendment. Modifications to this Agreement must be in writing and be signed by each party. 3. Governing Law. The terms of this Agreement shall be interpreted according to and enforced under the law of the State of Washington and is subject to all laws and regulations of the State of Washington. 4. Severability. If any provision of this Agreement is held invalid or unenforceable, the remainder of the Agreement will not be affected, but continue in full force. 5 1 P a g e Grant County Juvenile Court Services/LCA MOU 2024-2025 5. Assignment. LCA shall not assign its rights or responsibilities under this Agreement unless it receives written permission from the Grant County Juvenile Courts. 6. Non -Waiver. Any expressed waiver or failure to exercise promptly any right under this Agreement will not create a continuing waiver or expectation of non -enforcement of any Agreement provision. 7. County Policies and Procedures. LCA agrees that all staff assigned to provide services to Grant County Juvenile Court under this Agreement shall comply with all County policies, procedures, and guidelines. 8. Counterparts. The parties agree that this Agreement may be executed in one or more counterparts, each of which shall constitute an enforceable original of the Agreement, and that facsimile signatures shall be as effective and binding as original signatures. C.
