THIS MATTER having come on for hearing in front of the Grant County Hearing Examiner on November 12, 2024, in the matter of the seizure and intended forfeiture of a' 2024 Subaru Impreza, Oregon License No. 83 IPPN VI N No. JF1 GUHJCOR8282557, and a black Samsung S23 cellphone. The Hearing Examiner, having received and reviewed evidence, hereby submits the following Findings of Fact, Conclusions of Law, and Decision-, L FINDINGS OF FACT 1. On August 19, 2024, Grant County issued a Notice of Seizure and Intended Forfeiture to Trey Stone regarding a 2024 Subaru Impreza, Oregon License No. 83 IPPN, VIN No. JFlGUHJCOR8282557,, and a black Samsung S23 cellphone. 2. On August 28, 2024, Trey Stone submitted his appeal and claimed ownership of the seized property. 3. After due legal notice, an open record public hearing by means of Webex video conference was held on November 12,2024. 4. Appearing and testifying on behalf of Grant County was Detective Christ Kottong of the Grant County Sheriffs Department. 5. The appellant, Trey Stone, appeared at this hearing and provided testimony. 6. The following exhibits were admitted into the record,,, 6.1 Ex. The Hearing Examiner would specifically note that Exhibit 9 contains an interview with Mr. Stone by Detective Kottong that was video recorded. The Hearing examiner has reviewed this video recording. 8. Detective Kottong testified that he was part of undercover operations to conduct drug purchases at the Gorge Amphitheater on August 16, 2024. There were several other officers on this team. He received information from the officers assigned, undercover, that a purchase had been made from Mr. Stone. Mr. Stone had sold the undercover officers LSD "tabs". The LSD tabs were on the person of Mr. Stone. In the video recorded interview of Mr. Stone, Mr. Stone states that he had acquired the LSD tabs in Oregon, and that he had driven from Oregon to the Gorge Amphitheater in the seized 2024 Subaru Impreza. Mr. Stone had traveled to the Gorge Amphitheater with 16 tabs of LSD intending to sell some of these tabs. 9. Based upon Mr. Stone admitting he had transported, in his vehicle, illegal drugs which he intended to sell, the vehicle was seized. Officer Kottong also seized his cellphone planning to get a search warrant, but ultimately did not get a search warrant. Officer Kottong stated that the cellphone should be returned to Mr. Stone, 10. Mr. Stone testified that his car was not involved in the drug transaction. He denied admitting bringing the LSD tablets from Oregon to Washington. However, his primary argument was that the car was not involved in the drug transaction with the undercover sheriffs deputies. He also testified that he had the legal funds to buy the car., 11. The Hearing Examiner finds that there is no question that the sole owner of the 2024 Subaru Impreza *identified above was Trey Stone. 12. It is also undisputed that the ' black Samsung S23 cellphone was not involved in this drug transaction and may be returned to Mr. Stone. 13. The Hearing Exam iner finds that there is a preponderance of evidence that the 2024 Subaru Impreza was used to transport illegal drugs from Oregon to the Gorge Amphitheater with the intent by Mr. Stone that the drugs be sold. The 2024 Subaru Impreza. was properly seized pursuant to RCW 69.50.505. 14. The Grant County Hearing Examiner considered all the evidence within the record in rendering this decision. 15. Any Conclusion of Law that is more correctly a Finding of Fact is hereby incorporated as such by this reference. 1. The Hearing Examiner has been granted authority to render this decision. 2. The current, lawful owner of the above referenced 2024 Subaru Impreza and black Samsung S23 cellphone is Trey Stone. 3. The black Samsung S23 cellphone was not part of the drug transaction and may be immediately returned to Mr. Stone. 4. Grant County has proven by a preponderance of evidence that the seizure and forfeiture of the 2024 Subaru Impreza,.Oregon License No. 83 IPPN VIN No. JFlGUHJCOR8282557, identified above was properly seized pursuant to RCW 69.50.505 (1)(d). Based upon the above Findings of Fact and Conclusion of Law, the seizure and forfeiture of the 2024 Subaru Impreza, Oregon License No. 831PPN VIN No. JFIGUHJCOR8282557 referenced above is hereby AFFIRMEED. The seizure and intended forfeiture of the black Samsung S23 cellphone, is hereby REVERSED pursuant to the request of Grant County and the cellphone may be immediately returned to Trey Stone. day of November, 2024.
