RECITALS This contract is made with reference to the following facts and objectives: 1.1 The County desires to have legislative representation in Olympia during the legislative sessions, in addition to that provided by the Washington State Association of Counties. 1.2 The County also desires to have representation at meetings and conferences of interest to the County. 1.3 The County also desires to contract this service to a private contractor. 1.4 The Contractor is an experienced legislative liaison and is familiar with the legislative process. 1.5 Contractor will assist the County with individual County Legislative Priorities as may be deemed appropriate and as directed by the Board of County Commissioners which may include arranging in - person meetings with legislators, legislative staff, agency personnel, or other State officials. 1.6 The Contractor's role has evolved to include strategic advising within the legislative process, focusing on navigating the bureaucracy, leveraging relationships, and providing information to the County that may assist the Commissioners in making policy and advocacy decisions. 1.7 The Contractor will support the County's participation in online legislative hearings and facilitate virtual advocacy as needed, ensuring effective engagement in the digital legislative environment. 11. TERM The term of this contract shall be from January 1, 2025, through December 31, 2026. 2.1 This contract may be extended by mutual agreement of the parties. 2.2 This contract may be terminated by either party by giving thirty (30) days written notice. III. CONSIDERATION The County agrees to pay the Contractor as follows: 3.1 Effective January 1, 2025, yearly fee of five thousand two hundred eighty dollars ($5,280.00). This can be paid monthly$440.00, quarterly$1320.00 (January, April, July and October) or yearly $5280.00 (January). 3.2 The above -noted payment schedule includes all expenses incurred by the Contractor during the regular sessions and up to 45 cumulative days for special or extended legislative sessions for the term of this agreement. 3.3 This contract includes the Contractor's attendance at the Washington State Association of Counties (WSAC) sponsored conference and the Legislative Steering Committee Meetings when appropriate. Potts & Associates 2025 -- 2026 NU v- J i �: i 3.4 If the County asks the Contractor to attend meetings beyond the scope of this contract, the chairperson must approve any extra travel expenses related to these additional meetings. 3.5 When the Contractor attends meetings not listed in the contract on behalf of one or more counties, the actual expenses incurred will be divided among the counties that authorized the attendance. This implies that the counties will share the costs based on the Contractor's presence and representation at these meetings. IV. INDEPENDENT CONTRACTOR The parties agree that the Contractor is a private contractor and not an employee or agent of the County, and the Contractor will not represent itself as an employee of the County and will not receive any benefits from the County. V. ASSIGNMENT Neither party shall assign an interest in this contract, nor shall they transfer any interest in the same without the written consent of the other party. VI. CONTRACTOR'S LIABILITY The Contractor shall be liable for any labor and industries premiums, social security, and all applicable taxes, and shall hold the County harmless therefrom. VII. COUNTY"S REPORTING RESPONSIBILITY The County shall be responsible for reporting to the Public Disclosure Commission. I wanted to share the Potts & Associates updated contract for the 2025-2026 Legislative biennium. Please find the new contract attached to this email. In an effort to better serve our county clients and to align with the legislature's digital practices, we have made some revisions to the contract Language to ensure seamless and efficient collaboration in the evolving legislative environment. We are committed to servicing Washington's Rural communities and while the Language has been updated, the contract pricing remains the same as in the previous contract.
