RESOLUTION RESCINDING RESOLUTION No. 24- -CC
RESOLUTION NO. 11-029-CC
AND SETTING THE RETURN
CHECK FEE FOR COUNTY
OFFICES AND DEPARTMENTS
AND, OTHER MATTERS
PROPERLY RELATING
THERETO
RECITALS:
WHEREAS, Grant County, Washington, is a duly organized and existing municipal
corporation operating under and by virtue of the Constitution and the laws of the State of
Washington; and
WHEREAS, chapter 36.18 RCW regulates the fees to be charged by county officers, and
other matters properly relating thereto; and
WHEREAS, chapter 36.18.016(24) empowers county commissioners, as the legislative
authority of counties, to determine and set costs for non -statutory services rendered by Grant
County, by ordinance or policy; and
WHEREAS, the Board of County Commissioners passed and adopted Grant Countyp
Resolution No. 07-071-CC on May 23, 2007, authorizing the County Clerk and other Grant
County offices/departments to charge a handling fee on returned checks for insufficient funds
and returned item fee for county offices/departments, in an amount to be determined and set by
the Board of County Commissioner; and
WHEREAS, Resolution No. 11-029-CC was adopted on April 19, 2011 to update the
procedure; and
WHEREAS, Grant County off ces/departments incur bank service fees each time a
check is returned; and
WHEREAS, the Grant County offices/departments expend time in the instance of each
returned check, researching what account to charge back to reverse the transaction, and authoring
a letter to the party who presented the returned check, requesting payment to include the bank
service fee; and
WHEREAS, the cumulative costs to Grant County offices/departments to process
returned check fees can be a burden on operations; and
WHEREAS, the Board of County Commissioners has found and determined that it is the
best interest of Grant County government to maintain the handling fees on returned checks for all
Grant County offices/departments in the amount of Thirty and No/100 Dollars ($30.00).
NOW THEREFORE, BE IT RESOLVED AND ORDAINED THAT THE BOARD
OF COUNTY COMMISSIONERS adopt this resolution as follows:
SECTION 1. HANDLING FEE. All Grant County offices/departments are hereby
authorized to impose a handling fee in the amount of Thirty and No/100 Dollars ($3 0.00), on all
checks/warrants returned to Grant County by banks and other financial institutions and/or any
business duly authorized to issue checks and/or warrants, including without limitation, for
insufficient funds.
SECTION 2. SEVERABILITY. If any provision contained within this resolution, or its
application to any person, party or circumstance is held invalid, the remainder of this resolution
or the application of provisions to other people, parties or circumstance, shall not be affected.
