D2: D3: 4/23/24 JUL 3 (1 2024 115 GRANT C01JW Y COIR"OliSSIONERS 1 0'r, IRIETWEENRENEW AND THE ROYAL SCHOOL DISTRICT 2024-2025 School Year This AGREEMENT (Agreoment) is made and entered into by and between GRANT COUNTY, WASHNGTON (Counter), a political subdivision of the State of Washington, by and through RENEW, GRANT BEHAVIORAL HEALTH & WELLNESS (Renew) and ROYAL SCHOOL DISTRICT (District), a public, school district as def-med in Title 28ARCW and a political subdivision of the State of Washington, as authorized and pursuant to by the Interlocal Cooperation Act, RCW 39.34 et seq. AGREEMENT: 1. Sex aces. Renew will provide counseling services to District students pursuant to the teens and conditions of this Agreement to wit.: a. Renew will coordinate necessary services with District teachers, counselors, and psychologists and/or other District representatives as may be mutually agreed upon by the parties*, b. Renew staff will maintain appropriate administrative, technical and physical safeguards to ensure the intemity and confidentiality of information concerning identified students, complying U.- 1W with State required. Mandatory Reporting laws; c. It is anticipated the designated Renew staff will provide the following services-,- prevention, education, conflict resolution, screening and referral, d. Renew staff will receive referrals from District staff and Will coordinate/consult on recommendations; e. Renew staffill participate m' appropriate traiings, meeting and school activities that relate to their role with the District; f. Days and hours of service may fluctuate based upon specific student needs, finding, contractor availability or other reasons as may be determined by both parties. The designated employee shall report to the Renew location if no students are present or the school is conducting business outside of normal school hours and/or under a modified schedule, they should also report to the Renew location if the contractual 8 hours per day have not been fulfUled onsite at RSD. g. If at any time school shall close due to a state of emergency, natural disaster or otherwise, the designated employee shall report to Renew for an updated assigment and direction. h.. t all times material herein, designated Renew staff will compliance with protocols and operating procedures as established by the District-, i. Provided: Renew staff reserve the right to determine whether such designated student or students exceed the need for service beyond the scope offered by such Renew staff member. In the event this is determined, such student will be referred to an appropriate agenoy for services, Interlocal Agreement Between Renew and Royal School District 2024-2025 j. The District will provide adequate internet access to any Renew employee providing other services, for example intakes or continuing care to students. 2.RRRgrtin g. Designoted Renew staff shall prepare and provide progress notes specific to identified g students with such notes to be submitted through the District's designated on-lineprogram. The frequency of such submission shall be mutually agreed upon by the parties. Provided: Renew staff shall have the discretion to contact District staff regarding issues and/or needs beyond the scope of progress notes and reports routinely submitted to the District. 3 ii . Records. The District maintains all student records and is responsible for the storage and legal ownership. 4. Comnensation. The District shall pay Renew, directly, $65.00 per hour for counseling and outreach services provided by designated staff, The District will contract no less than 35 and no more than 40 hours per week inclusive of 5 hours of travel. Hours authonized by Royal School District over 35 regular hours per week shall be $81.00 per hour Renew assigned staff or management. Renew shall' invoices to the District on a monthly basis. The District shall pay properly submitted invoices within 30 days of receipt. 5. Effective Date of Agreement. This Apreement shall be effectiveAugust 27,,202 4,, and shall terminate on June I Ith, 2025 or through an extended school year due to weather or other unforeseen circumstances, or until as set forth in paragraph 5 of this agreement, 6. jorminatib11 on. Ibis Agreement may be terminated y either party for any reason on giving fourteen (14) days advance notice in writing of its intention to do so. 7, Notices. All notices pursuant to this agreement shall be in writing and shall be transmitted'by facsimle or United States Postal service, postage prepaid. Any such notice is effective upon receipt by the party to whom the notice is directed. Proof of deliver via facsimile shall be sufficient upon showing of a receipt of successful trans *ssion produced by the sending facsimile machine and * dicat* the telephone number rM in Mg to which the transmiss on was sent provided that the receipt indicates- the transmission iEM ion was sent to the phone number of the intended recipient. If any teen, provision, covenant or condition of this Agreement should be held by a court of competentjurl'sdiction to be invalid, void or unenforceable, the remainder of this Agreement shall continue in force an d effect and shall in no way be affected, impaired or invalidate., 9. Indemnification. To the Utest extent permitted by law, the Distfict shall indemnify and hold harmless the County, its officers, its comr1lissioners, its agents and its employees from and against any liability, suits, claims, actions, damages, losses and expenses of whatsoever kind or nature including, but not limited to, attorney's fees and costs arising out of, in connection with, or incident to the District! s performance of the terns of thi's Agreement, including specifically claims or suits based in whole or in part of deficient or 'inadequate or negligent acts or omissions on the part of the District, its employees, and/or its agents and its/their performance -under this Agreement. This indemnity shall also cover all losses, claims, expenses, attorney's fees., liabilities and judgments, including those for personal injury or death or for damages to personal property, irrespective of whether m' connection with such act or omission, it is alleged or claftned that the negligence of the County and/or Renew or its representatives or third parties cause d or contributed thereto. This indemnity provision is not intended to 'indemnify the County from the negligence of County's own employees, officers or agents,, To the fallest extent permitted by law, the County shall indemnify and hold harmless the District, its officers, its directors, its agents and its employees from and against any liability, suits, claims, actions, damages, losses and expenses of whatsoever kind or nature including, but not limited to, attorney's fees and costs arising out of, m* connection with, or incident to the County's perfonnance of the terms of this Agreement, including specifically claims or suits based M* whole or in part of deficient or inadequate or negligent acts or omissions on the part of the County, its employees, and/or its agents and its/their performance under this Agreement. Thanks, Unze BOARD OF COUNTY COMMISSIONERS Grant County, Washington RESOLUTION AUTHORIZING RESOLUTION No. 24- 0'11;0 -CC EXECUTION OF INTERLOCAL AGREEMENT BETWEEN GRANT COUNTY (THROUGH RENEW) AND THE ROYAL SCHOOL DISTRICT TO PROVIDE COUNSELING SERVICES TO DISTRICT STUDENTS WHEREAS, Chapter 34.39 RCW, the Interlocal Cooperation Act, permits local government entities to make the most efficient use of their powers by enabling them to cooperate with other localities on a basis of mutual advantage, for the purposes of providing services and facilities in a manner and pursuant to forms of governmental organization that will accord best with geographic, economic, population and other factors influencing the needs and development of local communities; and WHEREAS, the Royal School District, a public school district as defined in Title 28A RCW is authorized pursuant to Chapter 39.34 RCW to enter into interlocal agreements; and WHEREAS, Grant County, Washington, by and through Renew Behavioral Health and Wellness (Renew), is vested with authority to enter into an interlocal agreement pursuant to Chapter 39.34 RCW; and WHEREAS, it is the desire of Grant County, by and through Renew, and the Royal School District to enter into an interlocal agreement for the purpose of providing counseling services to district students.
