WITNE SSETH WHEREAS) the Client has need of a accounts receivable administrative or support service to be performed by an experienced and qualified Service Provider for the purpose of processing time -pay accounts owing Client., NMEREAS, it is the intent of this agreement that the accounts assigned to the Service Provider by Ci. fient shall be assigned at the sole discretion of the Client. 1 Contract Document. The contract documents consist of this agreement, together with exhibits attached, if any, do 1b 2. Work to be performed. The Service Provider shall do all work and furnish all equipment, labor and materials necessary to service aocounts assigned to Service Provider by Client. The Service Provider shall provide all forms and postage as required. Client shall transfer all accounts electronically to Service Provider. 3. Thee of Commencement. The services to be perfon-ned under this agreement sball cornmence on the J a day of I � 2012. 4. Termination. This agreement may be: terminated by either party upon thirty (30) days advanoe written notice to the other party. Waiver of breach by any party shall not be deemed a waiver of any subsequent breach, 5. Compensation to Service Provider. Service Provider shall be entitled to a fee for service basod upon the following schedule: Five dollars per month will be assessed to the defendant's time -pay plan as per court order. Client shall promptly report payments -received after the referral of any account to Service Provider. Service Provider shall be entitled to the aforementioned fee for service once Service Provider has commenced with processing on any account, regardless of where the payment is tendered. 6. Accounting. stud Payments by Service Provider. Service Provider will remit all monies received to Client weekly. Service Provider shall supply sufficient reported 'information at the time of remittance to allow Client to make independent verification as to total amounts pm*d on remaining balances. Service Provider has no authority to and.wi'll not engage.in compromise settlement arrangements without written authorization from Client` 8. Reporting. Service Provider will provide an acknowledgement to Client immediately after accounts are assigned. The r9port may be provided by mail, facsimile transmission, or through Internet methods. Additionally, Service Provider will provide Client with various progress reports showing all accounts assigned to Service Provider as• reqwred by Client. . Cli ent may audit Service Provider's records pertaining to accounts assigned for processing after providing reasonable notice consisting of five days to Service Provider. 9. Assignment of Interest. Neither Client nor Service Provider may assign this agreement nor any interest,. right or responsibility arising from this agreement without the written consent of the other party. Please confirm your approval of the below items. Barbara Duerbeck, you have reviewed and signed off on the 3 contracts for Dynamic Collectors Inc for the following services: Court Payment Management Services (payment plans), Pre -collection services, and collection services. You have also reviewed our current Pay Assist Contract and have verified it only requires a 30 -day written notice to terminate. You don't see any issue with terminating that contract and using Dynamic instead. Tom, you have revied the insurance portion of the dynamic contracts and verified it meets our criteria of $1M/$1 M.
