DEVELOPMENT CODE SECTION
23.08.020 ACCESSORY USES AND
STRUCTURES, AMENDING
DEFINITIONS IN CHAPTER 25.02
AND AMENDING THE ALLOWABLE
LAND USE TABLES IN CHAPTER 23.04
WHEREAS, the Grant County Board of County Commissioners previously adopted
Grant County Ordinance No. 02 -192 -CC Performance and Use Standards — Accessory Uses and
Structures; and
WHEREAS, Engrossed House Bill 1337 was passed by the legislature to promote and
encourage the creation of accessory dwelling units as a means to address the need. for additional
affordable housing options; and
WHEREAS, the RCW 36.70 authorizes the county legislative authority to adopt, by
appropriate resolution or ordinance, regulations designed to promote the public health, safety, and
general welfare of its citizenry; and
WHEREAS, the current Unified Development Code limits accessory dwelling unit
options for the residents of Grant County; and
WHEREAS, the Grant County Comprehensive Plan Countywide Planning Policies —
Policy 5, encourages housing alternatives for all economic segments of the population; and
WHEREAS, the Grant County Board of County Commissioners agree that accessory
dwelling units should be allowed to coexist with existing permanent dwelling units as a viable
housing option within the unincorporated county and urban growth areas; and
WHEREAS, the Grant County Planning Commission conducted an open record public
hearing regarding the proposed amendments to its Development Regulations, section 23.08.020,
Chapter 25.02, and Chapter 23.04 on October 4th, 2023 and provided for public notice and
comment and recommends approval to the Board of County Commissioners; and
WHEREAS, the Board of County Commissioners for Grant County conducted an open
record public hearing regarding the proposed amendments to its Development Regulations,
section 23.08.020, Chapter 25.02, and Chapter 23.04 on November 13f, 2023 and provided for
public notice and comment to consider the amendment to the Unified Development Code to
allow Accessory Dwelling Units in certain zoning districts.
NOW, THEREFORE, BE IT HEREBY ORDAINED, THAT the Board of County
Commissioners for Grant County, Washington hereby adopt by resolution the amendments to the
Unified Development Code, Section 23.08.020 and Chapter 25.02 as identified in Attachment A
and Chapter 23.04 as identified in Attachment B.

23.08.020 Accessory Uses and Structures
(a) Accessory uses are customarily incidental and subordinate to the principal use of a structure
or site. Accessory structures are permitted under the following provisions:
(1) Accessory uses/structures not exceeding 1,500 square feet shall be permitted prior to
the construction of a primary use. These structures are not intended for residential
occupancy, business or industrial use;
(2) consistent with the purpose of the zoning district; and
(3) in compliance with the provisions of GCC Title 23. The land use category of an
accessory use shall be the same as that of the principal use(s) as listed in Tables 3, 4 and
5, unless otherwise specified.
(b) Limitations on Accessory Uses and Structures: Accessory uses and structures are permitted in
any zoning district, except as limited or prohibited in this section, in Tables 3, 4 and 5 or in the
sections covering the various zoning districts in GCC § 23.04.
(c) Accessory Dwelling Unity ADU . Accessory dwelling units are intended to increase the
supply of affordable and independent housing for a variety of households. A -accessory
dwelling units areis permitted as accessory to an existing single-family dwelling provided that
the following requirements are met:

1) Accessory Dwelling Unit (ADU): A residential dwelling unit located on the same lot as a
single-family dwelling unit, either within the same building as the single-family dwelling unit,
attached to the single-family dwelling unit or in a detached building used as a permanent,
residence.
(A) Accessory Dwelling Units within UGAs, located in all zoning districts that allow for
single-family homes, are allowed two (2) ADUs in the following configurations:
(i) One attached ADU and one detached ADU'
(ii) Two attached ADUs,
(iii) Two detached ADUs, which xray be comprised of either one or two detached
structures.
(B) Accessory Dwelling Units within unincorporated areas of Grant County, located in
all zoning districts that allow for single-family homes, are allowed ADU's in the

following configurations:
(i) One ADU within the existing_ single-family dwelling and one detached ADU;
(ii) One detached ADU.
(C) All Accessory Dwelling Units shall be occupied as permanent residences and may

not be used, rented, or leased as transient short-term rentals (less than thirty consecutive
(30) days).
(2�) Farmworker Housing: Farmworker housing accessory to a farm residence to accommodate
agricultural workers and their families employed on the premises may be an accessory use on
parcels greater than 5 acres in certain zoning districts as specified in Tables 3, 4 and 5 of GCC §
23.04; as provided below:
(A) For legal lots larger than five (5) acres and less than twenty (20) acres, one (1) farm
housing unit is allowed;
(B) For legal lots larger than twenty (20) acres and less than forty (40) acres, two (2) farm
housing units are allowed;
(C) For legal lots larger than forty (40) acres and less than sixty (60) acres, three (3) farm
housing units are allowed;
(D) For legal lots larger than sixty (60) acres and less than eighty (80) acres, four (4) farm
housing units are allowed;

(E) For legal lots larger than eighty (80) acres, four (4) farm housing units are allowed;
provided that additional farmworker accommodations may be allowed pursuant to
GCC § 23.08.190.
(F) Farm housing units may only be leased, sold, or subdivided subject to the density
provisions of the underlying zoning district.
(G) Sewage disposal and water supply shall be in accordance with GCC § 23.12.050 and
§ 23.12.060.
(34) Caretaker Residence: Caretaker residences shall be only for caretaker, groundskeeper, or
security capacity to the primary operation. The number of caretaker residences required to
provide care and security shall be reasonable and customary for the associated industry, as
determined by the Administrative Official.
(45) Subdivision: Accessory dwelling units shall not be subdivided or otherwise segregated in
ownership from the principal unit of the single-family dwelling, unless allowed by the zoning.
(56) Size and Scale: '

in accordance with GCC § 23.12 Tables 1, 2 and I.

(67) Building Permit: The owner occupant shall apply for a Grant County building permit for an
accessory dwelling unit. The application must demonstrate that all requirements of this section

(7-9) Construction: Structures shall be subject to all applicable building and constructions
provisions of the GCC. Manufactured Homes, Tiny Homes, Park Model RVs, and other
Factory -Assembled Structures are allowed to be used as accessory dwelling units.
(8-9) Location: The accessory dwelling unit may be attached to, included within the principal unit
of the single-family dwelling, or located in a detached structure.

existingstructures such as detached garages into accessorydwellin units shall com 1 with all
ADU requirements, except that non -conforming_ structures regarding setbacks and/or lot
coverage are allowed to be converted to ADUs and retain their non -conformity.
(10-2) Parking: The number of parking spaces shall be as specified in GCC § 23.12, Table 5. All
parking spaces shall meet the standards of GCC § 23.12.130. Parking requirements for
accessory dwelling units within a UGA shall be as follows:
A) No additional off-street parking is required if the parcel is located one-half mile or
less from a major transit stop;
B) Only one additional off-street parking space is required for lots smaller than 6,000
square feet;
C) Two off-street parking spaces are required where the lot exceeds 6,000 square feet and
two ADUs are proposed as detached structures.

25.02.030 Definitions
Abate: to take whatever means necessary by the Administrative Official to return to the
condition in which it existed before a violation of this UDC occurred or to assure that the
property complies with applicable code requirements. Abatement may include, but is not limited
to, rehabilitation, demolition, removal, replacement, or repair.

Uniform Development Code (this UDC).

Extraction: the commercial removal of naturally occurring materials from the earth, excluding
water.
Farm Pond: means a deepwater habitat created from anon -wetland site in connection with
agricultural activities where the pond is smaller than five (5) acres.
Farm Worker Accommodation: a residential use associated with agricultural labor, consisting
of more than four (4) dwelling units associated with agricultural activities, but excluding
farmworker housing as an accessory dwelling unit pursuant to GCC § 23.08.020 and temporary
farm labor camps pursuant to GCC § 23.04.120.
Farm Labor Camps, Temporary: a residential use associated with agricultural labor,
consisting of camps or housing, other than farm housing as an accessory dwelling unit pursuant
to GCC § 23.08.020 and Farm Worker Accommodations, located on a farm to accommodate
agricultural workers and their families employed on the premises. Temporary farm labor camps
may be occupied no more than four (4) months in any twelve (12) -month period.
Grubbing: the removal of vegetative matter from underground such as sod, stumps, roots,
buried logs, or other debris, and shall include the incidental removal of topsoil to a depth not
exceeding twelve (12) inches.

Guest Ranch: a specialized camp offering activities typical of western ranching and offering
sleeping and eating accommodations in conjunction with existing ranching operations.
Performance and Use -Specific Standards: these provide criteria for testing the degree of
hazard, environmental damage, or nuisance from land use activities creating smoke, dust, noise,
glare, odor, erosion and sediment, runoff, liquid, solid, or airborne wastes, fumes, or traffic. See
GCC § 23.08.
Permanent (Residential Dwelling Unit): A single-family dwelling unit used, rented, or leased
on a permanent basis for periods longer than thirty (30) consecutive da Tis.
Permit Center: the Grant County Department of Community Development, Current Planning
Division.
Transfer Station: a facility for the collection of solid waste from off-site into a larger transfer
container or vehicle for transfer to a permanent disposal site. (see "Solid Waste Transfer
Station")

Transit Station: a dedicated transit facility located outside of the public right-of-way where
several transit routes converge. A transit station is designed to accommodate several buses at
once and may include passenger shelters and waiting areas.
