We write in response to your e-mail of October 2, 20234
Your e-mail requests that the County and the City "indicate their concurrenceV) on or
before November 1, 2023 with the terms of a "finai version" of a third amendment to the 2007
Agreed Order relating to the Grant County Ephrata Landfill 1. The County and City have been
negotiating the terms of the proposed amendment with Ecology in good faith. We cannot,
however, meet a November 1, 2023 deadline for several reasons.
First, our consultants still have significant concerns with the scope of work proposed by
Ecology. Issues they havc raised have not been addressed by Ecology. We request additional
time to have our consultants address those issues and related schedule issues with you.
Third, like Ecology, we are public entities bound by public meeting laws and we will
need additional time to schedule meetings with the public to address concerns that have been
raised about the r0i
p•'ect.

We believe 'it would be better to continue our negotiations than to terminate them as you
have suggested. To that end, we will be requesting an opportunity to meet with you, Ecology
senior management and our elected officials in the near term to address our concerns.
