GRANT COUNTY, WASHINGTON
RESOLUTION NO. 90-93 -CC
A RESOLUTION OF GRANT COUNTY, WASHINGTON,
defining and establishing the boundaries
of the area within Grant County to be
included in a proposed intra -county
public hospital district; providing
for the submission of the proposi-
tion of forming the intra -county
public hospital district to the quali-
fied voters of Grant County residing
in the area to be included in the pro-
posed district for their ratification
or rejection at a general election to
be held therein on November 6,1990, in
conjunction with the State general election
to be held on the same date; and establish-
ing the size of the district's board of
commissioners and the location of the
commissioner districts.
WHEREAS, Grant County, Washington(the "County"), is a municipal
corporation duly organized and existing under the laws of the State
of Washington; and
WHEREAS, RCW 70.44.010 authorizes the creation of municipal corpora-
tions known as public hospital districts within counties, and RCW 70.44.035
provides that "any petition for the formation of a public hospital district
may describe an area lying in more than one county;" and
WHEREAS, there is a present need to form a public hospital district
(the "District"), which district may include areas within the County and
within Lincoln County, Douglas County and Okanogan County(the "Other
Counties") and will furnish health care facilities and services and pro-
vide for the health care needs of the residents of the District and
other persons; and
WHEREAS,.pursuant to RCW 70.44.035, a petition was filed with the
County Auditor containing the signatures of 10% of the voters residing
in the area of the County to be included in the District and requesting
the formation of the District with boundaries within the County and within
the Other Counties as described therein(the"Petition"), a copy of which
is attached hereto as Exhibit A; and
WHEREAS, the Auditor of the County certified the Petition as sufficient
and transmitted the Petition, together with the Auditor's certificate of
sufficiency, to the Board of Commissioners of the County(the "County Com-
mission"); and
WHEREAS, the County Commission held a hearing on the Petition( the
"Hearing") September 4,1990 at 7:00 p.m. at the Center School in Grand
Coulee, Washington, which was continued to September 11,1990 at 3:00 p.m.
at the County Commissioners Hearing Room, Ephrata,Washington, which dates
were within four weeks of the initial date of the Hearing; and
WHEREAS, the County Commission caused the Petition to be published,
together with a notice of the Hearing, in The Star Newspaper which is a
newspaper published in the portion of the County to be included in the
proposed District, and the Grant County Journal Newspaper, of general
circulation in the County, for two weeks prior to the date of the hearing;
and
WHEREAS, pursuant to RCW 70.44.035, the County Commission is re-
quired to determine whether any of the land within the County proposed
by the Petition to be included within the District is unjustly or im-
properly included within the proposed District and to enter an order
establishing and defining the boundary lines of the proposed District
within the County(the "Order"); and

WHEREAS, the Boards of Commissioners of the Other Counties are also
required to determine whether any of the land within their respective
counties proposed by the Petition to be included within the District is
unjustly or improperly included within the District and to enter an order
establishing and defining the boundary lines of the proposed District
within their respective counties; and
WHEREAS, pursuant to RCW 70.44.020, the County Commission must pro-
vide, by resolution, for the submission to the voters residing in the
portion of the County to be included in the District of the proposition
of forming the District with boundaries within the County as set forth
in the Order and boundaries within the Other Counties as determined by
the Boards of Commissioners of those Counties(the Resolution"); and
WHEREAS, the County Commission must transmit the Resolution to the
Grant County Auditor of the County for submission to the voters at the
next general election, which will be held on November 6,1990, in con-
junction with the State general election, at least 45 days prior to the
date of that election; and
WHEREAS, the Boards of Commissioners of the Other Counties are also
required to provide, by resolution, for the submission to the voters re-
siding in the portions of their respective counties to be included in the
District of the proposition of forming the District with boundaries with-
in each county as determined by its Board of Commissioners(the "Resolutions"),
and to transmit such Resolutions to the Grant County Auditor of their
Counties for submission to the voters at the next general election; and
WHEREAS, the Auditor of Grant County will serve as lead auditor
(the "Lead Auditor") for the purposes of forming the District; and
WHEREAS, the Auditor of the County must certify the Resolution and
the Auditor of each of the Other Counties must certify the Resolutions
of their respective Boards of Commissioners to the Lead Auditor; and
WHEREAS, based on the Resolutions, the Lead Auditor will formulate
the boundaries of the proposed District as they have been determined by,
the County Commission and Boards of Commissioners of the Other Counties
(the "Boundaries") and will certify the Boundaries to the Auditor of the
County and the Auditor of the Other Counties for inclusion in the pro-
position submitted to the voters within the County and the Other Counties
(the "Proposition"), and
WHEREAS, the total vote cast upon the Proposition must be greater
than 40% of the total number of votes cast at the next preceding general
election in the portion of the County to be included in the District and
in the portion of each of the Other Counties to be included in the District;
and
WHEREAS, pursuant to RCW 70.44.051, any public hospital district
created after June 8, 1967, may have three, five or seven commissioners;
and
WHEREAS, pursuant to RCW 70.44.040, the portion of the District
lying within each of the counties included in the District is required
to be a separate commissioner district for the purpose of electing the
Board of Commissioners of the District (the "Commission"),
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS
OF GRANT COUNTY, WASHINGTON, as follows:
Section 1. The County Commission hereby enters an order establishing
and defining the area of the County to be included in the proposed District
with the boundary lines described in Exhibit B attached hereto. The County
Commission hereby finds and determines that such boundary lines are reason-
able and just and conducive to the welfare and convenience of the residents
of the County living within the proposed District.
Section 2. The Auditors of the Other Counties are requested to submit to the
Auditor of Grant County the boundary lines established in Section 1 of
this Resolution as described in Exhibit B hereto.
Section 3. The Auditor of the County is further requested to submit
at the next general election of the County, which is to be held in con-
junction with the State general election on November 6,1990, to the voters
residing in the area of the County lying within the District for their
approval or rejection, the question of whether or not a public hospital
district shall be formed which district shall include that area of the
County and those areas of the Other Counties, lying within the boundaries
set forth in Exhibit C attached hereto(the "Boundaries"), which Boundaries
were formulated and certified to the Auditor of the County by the Auditor
of Grant County, and which district shall be known as the Douglas, Grant,
Lincoln and Okanogon Counties Public Hospital District No. 6.
Section 4. The Prosecutor of Grant County is directed to draft the
Proposition that the Auditor of the County shall submit to the voters
pursuant to SEction 3 of this Resolution, which Proposition shall conform
to provisions of RCW 70.44.020 and this Resolution.
Section 5. The Clerk of the Board of the County Commission is dir-
ected (a) to certify to the Auditor of the County a copy of this resolution
showing its adoption by the Board at least 45 days prior to the date of
the general election; (b) to certify to the County Auditor a copy of
Exhibit B attached hereto, which establishes the boundaries of the Dist-
rict within the County; and (c) to perform such other duties as required
by law to the end that the question of whether or not the District shall
be formed shall be submitted to the voters at the aforesaid general election.
Section 6. The County Commission hereby determines that if the form-
ation of the District is approved by the voters, the District shall have
five commissioners, who shall be elected at the election at which the Pro-
position is submitted to the voters. The County Commission hereby approves
the persons listed on Exhibit C attached hereto as candidates for the five
commissioner positions as indicated therein and requests the Auditor of the
County to transmit such list of candidates to the Lead Auditor to be placed
on the ballot. The candidates shall be voted on by the entire District, and
the candidates receiving the highest number of votes for each commissioner
position shall serve as the commissioners of the District. The candidates
elected from Okanogan and Douglas Counties shall serve for terms of five
years each, the candidates elected from Lincoln and Grant Counties shall
serve for terms of three years each, and the at -large candidate shall serve
a term of one year. If the Proposition does not receive approval by a maj-
ority of the voters voting ont he Proposition, the election of the commis-
sioners shall be null and void.
Section 7. The County Commission hereby further determines that if
the formation of the District is approved by the voters, the portion of
the District located within each of the counties of the District shall
constitute a separate commissioner district, and the remaining positions
shall be at large positions.
ADOPTED AND APPROVED by the Board of Commissioners of Grant County,
Washington, at a regular open public meeting thereof this 18th day of
September, 1990, the following Commissioners being present and voting
in favor of this resolution. Resolution is approved and adopted only
upon being provided with exhibit C by 5:00 p.m.,September 21,1990
