HomeMy WebLinkAboutOrdinance 22-017-CCBOARD OF COUNTY COMMISSIONERS Grant County, Washington ORDINANCE AMENDING GRANT ORDINANCE NO. 22- �% I -CC COUNTY CODE CHAPTERS 9.06 "DOG CONTROL" AND 9.07 "DANGEROUS DOG AND POTENTIALLY DANGEROUS DOG" TO REMOVE LICENSING REQUREMENTS. RECITALS: WHEREAS, the Grant County Dog License Ordinance is not routinely enforced; and WHEREAS, The Grant County Dog License Ordinance creates an administrative burden that substantially exceeds it value; and WHEREAS, The Grant County Dog License creates an burden on Grant County Citizens; and WHEREAS, The Grant County Commissioners have found the cost of Dog Licensing requirement in the Grant County Code exceeds its benefit, NOW, THEREFORE, BE IT ORDAINED, by the Board of Grant County Commissioners, hereby Repeals Grant County Code Sections 9.06.074, 9.06.154 and 9.07.160; and amends Section 9.07.190 as follows: Section 1: Section 2: N:\Staff\BVasquez\Resolution-Ordinance\Dog Control and Dangerous Dog- Ordinance for Code Amendment Changes 9.06 and 9.07 02012022.docx Section 3: 9.07.160 - Failure to reclaim. Section 4: 9.07.190 - Dog declared dangerous or potentially dangerous by another jurisdiction. (a) Any person desiring to bring a dog to live in the corporate limits of Grant County which has been previously declared to be potentially dangerous, dangerous, vicious, or similar designation in another jurisdiction, under the provisions of Chapter 16.08 RCW or comparable local ordinance, must notify the animal control authority prior to moving the dog to the corporate limits of Grant County. There is no right to bring into the corporate limits of Grant County a dog that has been the subject of a declaration or similar process in another jurisdiction, and the animal control authority will determine whether such a dog will be lieensed an permitted to reside in the corporate limits of Grant County. (b) Except to the extent inconsistent with this section, an appeal from the decision of the animal control authority under this section may be appealed in the manner set forth in GCC 9.07.100. At the hearing, the presumption shall be that the previous jurisdiction's determination is correct, and the burden shall be upon the appellant to demonstrate the invalidity of the prior declaration or similar process.
