Term of Contract: 1 st of September, 2023 to the 31 st day of August, 2024
Purpose: To provide educational opportunities and transitional services to at -risk
youth from ESD 105 region schools and drop -outs.

Memorandum of Understanding
Between
Grant County Juvenile Probation
And
ESD 105
Introduction
This Memorandum of Understanding (MOU) is between Grant County Juvenile Probation and
Educational Service District 105 (ESD) for the purpose of providing educational opportunities and
transitional services to at -risk youth from ESD 105 region schools and drop -outs. Employees of ESD 105,
hereinafter referred to as "Educational Advocates," shall provide the services to youth and work with
staff in Grant County Juvenile Probation to improve educational outcomes for regional students.
Operational Procedures
Description of Services: Educational Advocates and Grant County Juvenile Probation agree to accept the
services provided to youth.
Consideration: Though ESD 105 is providing educational services, no fiscal consideration between ESD
105 and Grant County Juvenile Probation is required or contained herein.
General Provisions
Licensing: ESD 105 agrees that any and all individuals assigned as Educational Advocates to Grant
County Juvenile Probation shall be licensed, certified, and/or accredited in compliance with all
applicable federal, state, county and municipal ordinances and statutes.
Safeguarding Client Information: The ESD agrees that there will be no disclosure of confidential
information. Confidential information includes: student name, DOB, school district, and charges/release
arrangements.
ESD and Grant County Juvenile Probation shall protect and maintain all confidential information gained
by reason of this MOU against unauthorized use, access, disclosure, modification or loss and shall not
use, publish, transfer, sell or otherwise disclose any Confidential Information gained by reason of this
MOU for any purpose that is not directly connected with ESD 105's Grant County Juvenile Probation's
performance of the services contemplated hereunder, except:

(1) as provided by law; or,
(2) in the case of Personal Information, with the prior written consent of the person or personal
representative of the person who is the subject of the Personal Information.
Inspection: ESD agrees that Grant County Juvenile Probation may make periodic inspections of the work
products of ESD 105 and our Education Advocates, and Grant County Juvenile Probation will participate
in the evaluation of the program.
Communication: Communication between ESD 105 and Grant County Juvenile Probation shall be
regular and ongoing. Administrators and/or staff will be included in meetings for evaluating the work
and outcomes of the program.
Terms: This Memorandum of Understanding shall be in full force and effect from the 1" of September,
2023 to the 31St day of August, 2024.
Selection of Personnel: ESD 105 shall provide the Educational Advocates to work in Grant County
Juvenile Probation. All individuals employed by ESD 105 shall undergo screening, security checks, and
background investigations as deemed appropriate for any employee of the ESD.
All individuals employed by ESD 105 shall comply with the provisions of 13.40.570 RCW (Sexual
misconduct by state employees, contractors) which states that when DSHS Secretary has reasonable
cause to believe that sexual intercourse or sexual contact between the employee of a contractor and an
offender has occurred, the Secretary shall require the employee of a contractor to be immediately
removed from any employment position which would permit the employee to have any access to any
offender.
In addition, the DSHS Secretary shall disqualify any person from working under this Agreement, and
Grant County Juvenile Probation shall not assign any employee to work pursuant to this Agreement if
that person has access to an offender:
Is found by the department, based on a preponderance of the evidence, to have had sexual intercourse
or sexual contact with the offender; or
Was convicted of any crime specified in chapter 9A.44 RCW (Sex Offenses) when the victim was an
offender.
Facilities: Grant County Juvenile Probation shall permit Education Advocates to meet with youth on
campus.
Hold Harmless: Each party will be liable for their own acts or omissions and those of its officers,
employees, and agents. No party to this agreement shall be responsible for the acts or omissions of
entities or individuals not a party to the agreement.
Modification and Termination: Any and all amendments must be made in writing and must be agreed to
and executed by the parties before becoming effective.
