RESOLUTION VACATING 23 NE RESOLUTION No. 20- A -CC

along with unbuilt County right-of-way

WHEREAS, Grant County, Washington, has received a petition to vacate portions of
certain County road and rights-of-way described as follows: Legal description: Grant County
Rights-of-way: That portion of 23 NE Roadlog 52330 within the boundary of Section 9 from
BMP 0.41 to EMP 0.76 together with unbuilt rights known as Old County Road 872, Finney
Road, within Section 9 all in Grant County, and as shown on ATTACHED EXHIBIT A, and
WHEREAS, a notice of hearing on the report for vacation and abandonment was published
in the County official newspaper at least once a week for two consecutive weeks preceding the date
fixed for the hearing; and a copy of said notice was posted for at least twenty days preceding the date
fixed for hearing at each termini of the county road or portion thereof to be vacated or abandoned;
WHEREAS, the Board of County Commissioners did consider the report given by the
County Road Engineer, together with any evidence for or objection against said vacation and
abandonment; and
WHEREAS the above described County right-of-way is not useful as part of the County
road system and the public will be benefitted by the vacation and abandonment; and
NOW, THEREFORE, BE IT HEREBY RESOLVED THAT the Grant County Board
of Commissioners, APPROVE: VACATING all interest in the County road and right-of-way as
described above; EXCEPT any existing easement to accommodate existing power lines,
communications lines and other franchised and/or permitted public and private utilities.

Bruner Vacation synopses:
A petition was received for vacating 23 NE.
1. GCPW finds that this is an old farm to market road: 872 Finney, and the majority is unbuilt.
2. GCPW finds that the public would be benefitted by vacated all rights within the 1 mile stretch as
the entire area belongs to Bruner, also saving any confusion and/or liability in the future.
3. Bruner is in agreement and has paid the fee.
4. The road 23 NE is occasionally graded, no Fair Market Value is required as per GCPW standard
practice.
