proposed road at that point in time; and
WHEREAS, The existing roadway does not match thegraphical depiction of the proposed

WHEREAS, Grant County Public Works (Grantee) and Eilers Land, LLC (Grantor) both
agree that an accurate legal description of the existing right of way will benefit both parties
