Franz Short Plat Vacation (Continuedfrom 11/22/22)

The Commissioners held an Open Record Public Hearing to consider vacating the entire subdivision of
the Franz Short Plat, Replat #1 (AFN 1099748), further identified as Assessor Parcel Numbers 31-2252-
000, 31-2253-000, 31-2254-000, 31-2255-000 and the included dedicated roadway and associated road
Right of Way pursuant to Grant County Code 22.04.490 and RCW 58.17.212, as petitioned by Vic Jansen
and Dave McKinnon of Terteling Properties LLC (agent Gil Alvarado, GAJ Planning LLC). This includes Lots
1 thru 4, Franz Short Plat, Replat #1 and included dedicated Road,. Lot 2 and 3, Franz Short Plat, in the
South half of the Northwest quarter of Section 32, Township 19 North, Range 29 East, W.M. This
hearing is being continued from 11/22/22.
Commissioner Stone stated the Board hasn't received the sale and closure documents that are required
to approve this vacation. The Board will need to continue this hearing once again.
Gil Alvarado, GAJ Planning stated he spoke with the Terteling Group / Dave McKinnon that the
documents have been signed and funds transferred. What is occurring is the titles cannot transfer
because the Title Company does not have a legal segregation to attach the segregation to. Mr. Alvarado
will meet with Frontier Title, and they can record the sale but once it gets to the Assessor's Office, they
will see there is no segregation that follows the sale.
Discussion ensued.
Jim Cook, Assistant Development Services Director stated in order to complete this transaction, the
county can perform a Boundary Line Adjustment, a recorded document with a legal description, to allow
the vacation to happen with whatever documentation the applicant has provided that says this sale is in
motion until which time we can create that boundary, they can place the easement though.
Gil Alvarado stated they have a meets and bound description from a surveying company. They have this
in place currently. Could they record the meets and bounds description so the title company can see it
and process the sale?
Jim Cook stated he believed this could work.
Gil Alvarado stated in the interim, he will send Jim Cook a copy of the Meets and Bounds description
between now and the next hearing. The deliverables to the County will be the M&B Description
attached to the sale documents that are going to be submitted to the Assessor's Office, so the sale can
go through.
A motion was made by Commissioner Jones to continue the hearing to 12/27/22 at 4:00 p.m.
Commissioner Stone seconded and the motion passed with 2 Commissioners in attendance.
