APPOINTMENT AND OATH OF OFFICE OF
SPECIAL DEPUTY PROSECUTING ATTORNEY
COMES NOW Kevin J. McCrae, the Prosecuting Attorney for Grant County,
Washington, and pursuant to the authority of RCW 36.27.040, hereby Christopher F. Ries
Attorney at Law, of Ries Law Firm, P.S., of Moses Lake, Washington, to serve as a Special
Deputy Prosecuting Attorney pursuant to the terms below;
Section 1: PURPOSE
The Prosecuting Attorney appoints a SPECIAL DEPUTY PROSECUTING ATTORNEY
(S.D.) to perform and render legal assistance and counsel regarding the duties and
responsibilities pertaining to Darryl Pheasant, the duly elected Treasurer of Grant County, and
such other matters and proceedings as required by the Prosecuting Attorney or designee.
Section 2: SERVICES
The S.D.'s duties shall include, when necessary, assistance, counseling, and the
preparation of all legal documents for the proper conduct of proceedings pertaining to the
Treasurer, including, but not limited to, the following duties, and any other matters as requested
by the Prosecuting Attorney or designee:
Advice and assistance regarding issues involving collecting real and personal
property taxes (including performing foreclosures on real property and distraints of
personal property), special assessments, excise tax gambling taxes, and miscellaneous
receipts from other County districts and departments and collection of all delinquent
accounts.
• Advice and assistance regarding issues involving accounting for all funds and
deposits of revenues for the state, county, cities and junior taxing districts.

• Advice and assistance regarding issues involving determining adequate liquidity in

funds and authorizing the release of warrants for payment to vendors.
• Advice and assistance regarding issues involving administering short — and long —
term debt financing.
• Advice and assistance regarding issues involving managing the cash flow of the
County and investing funds not needed for immediate expenditures for the County
and junior taxing districts.
• Advice and assistance regarding issues involving coordinating banking services and
facilitating financial planning for the County and various taxing districts.
Section 3: COMPENSATION AND STATUS
The S.D. shall be paid Three Hundred and no/100 Dollars ($300.00) per hour. The S.D.'s
associate attorneys shall be paid Two Hundred and no/100 Dollars ($200.00) per hour, the legal
assistants who perform services shall be paid One Hundred and no/100 Dollars ($100.00) per
hour. Fees charged will be based on a I /I Oth hour minimum. Travel will be billed at the hourly
rate. Monthly bills and a case status update shall be submitted to the Civil Deputy Prosecuting
Attorney for tracking and payment by Grant County Treasurer.
Section 4: TERM
This Agreement shall be in full force and from appointment through December 31 2023
unless otherwise terminated or extended by the parties. This may Agreement be terminated at

any time by either party upon written notice.
Section 5: CONFLICTS OF INTEREST
Notwithstanding anything to the contrary contained herein, S.D. shall not and shall have
no obligation to provide legal services under this Agreement where to do so would or could
reasonably be construed to rise to a conflict of interest under the Washington Rules of
Professional Conduct (RPC). In any instance in which S.D. is prohibited fromrovidin legal

services under this Agreement by reason of an actual or potential conflict of interest S.D. shall
have no duty or obligation to provide the Grant County Treasurer, the Prosecuting Y Attorne for
Grant County, Washington, Grant County, or any other party or third -party with conflict counsel.
