HomeMy WebLinkAboutOrdinance 22-072-CCBOARD OF COUNTY COMMISSIONERS Grant County, Washington ORDINANCE DISSOLVING THE ORDINANCE NO. 22- via -CC ACTIVE WEED DISTRICT #51 WHEREAS, in On October 13, 1964, Weed District 51 (hereafter "the District"), was formed, pursuant to Chapter 17.06 of the Revised Code of Washington (RCW), for the purpose of controlling noxious weeds; and, WHEREAS, RCW 36.96.010(3) dictates a special purpose district is considered "inactive" in the following instances (a) the district has not carried out any of the special purposes or functions for which it was formed in the preceding five-year period; (b) no election has been held for the purpose of electing a member of the governing body within the preceding consecutive seven-year period or, in those instances where the members of the governing body are appointed and not elected, where no member of the governing body has been appointed within the preceding seven- year period; or (c) the district has been determined to be unauditable by the state auditor; and, WHEREAS, on Jan 18"" 2022 the Grant County Auditor provided a letter to the Board of County Commissioners stating that the district is inactive, that it has not carried out any of the special purposes or functions for which it was formed in the proceeding five year period, and that no elections have been held for the purpose of electing a member of the governing body for the preceding seven year period, nor has any member been appointed within the same time period, and, WHEREAS, RCW Chapter 36.96 vests jurisdiction in the county legislative authority to adopt an ordinance dissolving a special purpose district upon notice from the auditor regarding inactivity of a district, once public hearings are held to determine whether the district meets the criteria of being inactive; and, NOW, THEREFORE, BE IT ORDAINED by the Board of Commissioners of Grant County: Section 1. The Board conducted a public hearing on the dissolution of Weed District 51 on July 26, 2022, pursuant to RCW 36.96.030. Section 2. The Board finds the following: (1) The District has not served the public purpose for which it was formed in any of the last five years; and (2) No election nor appointment of a member of the governing authority has taken place in the preceding consecutive seven -years. N:\StafflBVasquez\Resolution-Ordinance\Weed District 51 Dissolution 07262022.doc Section 3. The Commission finds the District is "inactive" pursuant to RCW 36.96.010(3)(a) and (b). Section 4. The Commission finds that dissolution of the district is in the public interest, and that the Grant County Weed board will better serve the needs of the citizens of Grant County located in Weed District 51. Section 5. Weed District 51 is hereby dissolved. Weed District 51 shall cease to exist thirty- one days after passage of this ordinance unless otherwise directed by a Court of Competent Jurisdiction. Section 6. Any remaining moneys or funds shall be used to pay the for all costs and expenses incurred in the dissolution and liquidation of the Weed District 51, as well as payment of any outstanding obligations. Any remaining moneys, funds or property shall become that of Grant and Adams County, pursuant to RCW 36.96.070. Section 7. The Clerk of the Board is directed to provide a copy of this Ordinance to the County Treasurer as required by RCW 36.96.040. APPROVED AND SIGNED this 26th day of July, 2022.
