Bill Stevens owns Tax Parcel 161835002. It is a portion of an abandoned
railroad right of way. Its dimensions are 100 feet in width and approximately
1700+ feet in length and contains approximately 4.00 acres. This parcel has all the
attributes required to qualify for a building permit except according to paragraph
3 in code 22.04.065 it has to have a minimum size of 5.00 ac. in paragraph 4 of the
same code it states that the county commissioners can grant the right to be
granted a building permit if it is in the best interest of the public or that interest
will not be adversely affected. To build a dwelling on this parcel will not bean
adverse effect. To support a decision by the commissioners to allow a building
permit one can consider the provision in paragraph of code 22.04.020 starting on
Vol
line 33, page 2 of said code. Which states that a boundary line adjustment
procedure is accepted to allow for the enlargement of an existing parcel by
merging it with part of an adjacent lot or parcel. Line 1 of paragraph (A) paragraph
8 is not restrictive because enlarging this parcel will not require creating an
additional parcel.
The adjacent parcel owned by Mr. Stevens is tax# 161835000 will
contribute enough acreage to the railroad parcel through the B.L.A. process to
bring it up to an acceptable size.
Parcel 161835000 was originally 89+ acres and became what it is today
through a series of 2 boundary line adjustments of a pair of Don Jacobsen's 40 ac.
segregated parcels this was an approved change to the minimum 40 ac.
Segregation rule. Now Jacobsen's two parcels are no longer 40 ac. after the
proposed B.L.A. to increase the R/R parcel Stevens parcel; #161835000 will still be
in excess of 120 acres which makes it eligible to be segregated into 40 ac+ parcels
by means of a simple record of survey. If planning requires that it be short
platted, then the R/R parcel doesn't have to be involved and will remain a useless
tax parcel producing no revenue to the county. Short platting parcel 161835000
will deprive it from ever being able to be segregated. This defeats the purpose of
it becoming what it is through the B.L.A. process.
