GRANT COUNTY BOARD OF COMMISSIONERS
MONDAY, OCTOBER 22,2018
The Grant County Commissioners session began at 8:30 a.m. with Commissioners Taylor and Carter in
attendance. Commissioner Stevens was out and excused.
8:30 a.m. — 9:00 a.m. Elected Official Roundtable
9:00 a.m. — 9:20 a.m. J Hammond, ASC Update and Misc BOCC Action (items 1 through 4)
A motion was made by Commissioner Carter, seconded by Commissioner Taylor, to approve items 1, 3
and 4 on the agenda as presented. Item 2 was not ready for signature. The motion passed with 2
Commissioners in attendance.
1. Possible vouchers for insurance, legal services, grant administration, etc. (Approved)
2. Anticipating: General Fee Agreement with Ries Law Firm, P.S. for legal representation to Darryl
Pheasant, Grant County Treasurer. (Item not ready for signature)
3. Filing Fee Surcharge Distribution Agreement between Grant County and the Columbia Basin
Dispute Resolution Center for distributing funds obtained by the County as a result of RCW
7.75.035. Term is January 1, 2019 through December 31, 2019. (Approved)
4. Working Agreement (Collective Bargaining Agreement) between Grant County and Teamsters
Local Union No. 760, Case Management Unit, Intake & Crisis Services Unit, Therapy Services Unit
and SLID Counselors Unit— January 1, 2018 to December 31, 2019. (Approved)

the Shorecrest Estates Plat
The Grant County Commissioners held an Open Record Public Hearing to consider the vacation
of undeveloped real property (Parcel No. 120927000) within the Shorecrest Estates Plat, Lot 23,
Block 1.
Damien Hooper, Director of Development Services, the option today is to vacate a portion of a
subdivision that exists on Shorecrest Drive. The Board can vacate all or part of a subdivision
through a public hearing process. This is a public park lot that was dedicated to the County to
hold as a public park parcel.

The Board, if they establish that it does not serve a public use, and that the public interest would
be served by the lot being vacated, they can make that finding and vacate that portion of the
Shorecrest plat. The notice was sent by the Clerk of the Board to all of the property owners in
Shorecrest subdivision as required by statute.
Commissioner Carter stated that the property was dedicated to the county as a "public park"
and the county has done nothing with it.
Mr. Hooper stated there is no improved park, only gravel for access to the lake. This was never
established as a "park".
Gene Conroy asked about the advertisement for this hearing and who was all notified. Mr.
Hooper stated the statutory requirement is those properties within that plat that resulted in
that plat are notified of the vacation. Commissioner Taylor stated that if the vacation is
approved, the lot will then be placed for surplus and sold at the Treasurer's Auction.
Frank Fulton commented that this lot is used quite frequently and he considers the parcel a
benefit to the area residents.
Commissioner Taylor clarified the history that the Board received many complaints about illegal
activities and people dumping trash. The Board then looked into the lot and what can be done.
He mentioned that the county put ecology blocks on the road to assist as well.
Richard Stapleman lives next door and stated the lot is a nuisance. Garbage, no maintenance,
and a lot of diapers dumped there. Loud music, drugs and needles too.
Commissioner Carter asked about vacating a portion of the road. Is this a possibility? Mr.
Hooper stated that by statute the county cannot vacate a county road right of way that goes to
the water unless it's dedicated to another public agency.
Gene Conrad said unless the county fences off the road, the problems will continue.
Aaron Mickelsen is in favor of improving the lot to make it better for everyone or vacating it.
Gene Conrad asked about getting rid of the park. Commissioner Taylor clarified that it is not an
official park but the developer platted the lot for the possible future development of a park, if
the county so desired.
Damien Hooper stated the county owns the property and if they desire, they can make it into a
park.
Frank Fulton commented that there is another area that would be the new hang out if this area
was vacated.
Aaron Mickelsen asked about the zoning of the parcel after vacation? Mr. Hooper stated its
Urban Residential 2, which is the same as the other lots in the area.

Commissioner Taylor stated the county has not use for this parcel. Fencing it off still leaves the
lot overgrown.
Clint Pozzi is a fisherman and likes the access. He stated that police presence is next to none
and when they are called they do not respond in a timely manner. The road is the problem, not
the parcel.
Commissioner Taylor confirmed that the road is not an official boat launch.
Bud McIntire stated he and his wife developed the road and asked if the county would have it
surveyed to identify the road right -of way, if the lot is vacated?
Christie Pozzi asked about the litter on the property and who is responsible. Commissioner
Taylor stated the county only recently found out we owned the property, and it is the county's
responsibility.
Loren McIntire asked about the vacation and the county... will it be sold? He's wondering if the
lot is too small to build on and make it worthless. He also mentioned that they have contacted
the Sheriffs Office to get a block watch started but gets no response.
Damien Hooper stated that the lot size may or may not be able to hold sewer and septic. That
will have to be addressed at a later date by the possible new owners.
Frank Fulton stated he agrees that there is a problem with "riff raff".
Christie Pozzi hopes that when other area lots sold, the nuisances would slow down.
Linnea Fulton asked about County parks. Commissioner Taylor stated the county does not own
any parks. A large light would be welcomed. She would like to keep the lot as a benefit to the
area homeowners.
Richard Stapleman gave kudos to the Sheriffs Office for helping him put up his mailbox.
Gene Conroy said if nothing is done with the road, there will still be a problem. Its not just the
lot.
Commissioner Carter mentioned the possibility of continuing this hearing to gather more
information. Commissioner Taylor stated they approached the Moses Lake Irrigation and
Rehabilitation District MLIRD about selling the property to them but they were not interested
BUT still wanted the ability to use the "boat launch".
Darryl Pheasant stated that he plans to put the lot up for sale at the November 16, 2018 tax
foreclosure sale. Surplus parcel sales will be sold before the tax foreclosure parcels.
The Clerk of the Board confirmed that the surplus public hearing for this lot is being held on
October 30, 2018 at 10:00 a.m.

Richard Stapleman stated that if he purchases this lot, he will block off the entire area and this
will take away the boat launch.
Frank Fulton stated that vacating the lot does not take away the problem.
Arne Berg wants to give the Sheriffs Office a chance to respond to their issues with their office
not responding to calls.
Commissioner Carter moved to move the hearing to October 29, 2018 at 1:00 p.m.
Commissioner Taylor seconded and the motion passed with 2 Commissioners in attendance.
The hearing adjourned.

3. Payment of vouchers certified by the auditing officer as required by RCW 42.24.080, and those

as recorded on a listing and made available to the Board. (Approved in the amounts of
$94,286.09 and $707,590.87)
SUPERIOR COURT
S. Request approval to conduct two (2) adoption proceedings in a location other than the County
Seat, per RCW 2.08.030, and hold them at 1515 S. Division Street, Moses Lake for National
Adoption Day. (Approved)
6. Request to surplus a Glock 22, 40 caliber pistol (SN: VSL749, Asset ID# 105184) with the intent to
sell it to Old World Trading Company. The value is under $2,500 and does not require a public

TREASURIER'S OFFICE
8. Resolution No. 18 -103 -CC authorizing fees to charge and collect from the Grant County
Conservation District. (Approved: $15,000 per year, beginning 2018; Increase by $3,500 each
year for the next 3 years, until 2021; and the District will pay at the same rate as all other
charged assessment districts from 2022 forward)

Extensions
The Commissioners held an Open Record Public Hearing to consider the following budget extension
requests:
Sheriffs Office in the amount of $216,277.79 to purchase a Full Body Scanner and Mail Scanner
for use in Grant County correctional facilities (jail scanners). Funding will come from Law and
Justice Funds and transfers from INET Investigations and Jail Concessions accounts.
Clerk's Office in the amount of $6,201.94 to receive reimbursement funds from the
Administrative Office of the Courts for overtime costs associated with the implementation of the
new statewide case management system - Odyssey.
Commissioner Stevens noted that the Mail Scanner purchase is a sole purchase from Chemimage,
The Sheriff s Office will be tra nsferring $ 100,000 from Jail Concessions and $25,000 from Inet f unds
for this purchase. The total amount for the Sheriffs Office purchase is $341,277.79 with
$216,277.79 coming from Law and Justice Funds.
Commissioner Taylor moved to close the public comment portion of the hearing. Commissioner
Stevens seconded and the motion passed with 2 Commissioners in attendance. Commissioner
Taylor moved to approve the budget extensions as presented. Commissioner Stevens seconded and
the motion passed with 2 Commissioners in attendance. The hearing adjourned. (Approved,
