GRANT COUNTY, WASHINGTON
In the matter of adopting the
FINAL ASSESSMENT Roll RESOLUTION NO. 93- 1.30 -CC
for Grant County Road Improvement
District No. 92-1
WHEREAS, the final assessment roll for Grant County Road Improvement
District No. 92-1 has been prepared and filed with the Clerk of the Grant County
Commissioners, and
WHEREAS, a public hearing was held at 10:00 a.m., Tuesday, November 9,
1993, in the Grant County Commissioner's Hearing Room in the County Courthouse,
Ephrata, WA, and said hearing was duly advertised and notice of said hearing was
given to all owners and reputed owners by the Clerk of the Board of County
Commissioners, as required under RCW 36.88.090, before a board of equalization to
consider the final assessment roll for Grant County Road Improvement District No.
92-1, that provided for the improvement of "E" NE Road from 4 NE Road through
Westshore Acres by constructing or reconstructing, by clearing and grubbing,
grading, shaping, installing drainage structures, fencing, furnishing and placing
crushed surfacing, constructing approaches, paving a 28 foot wide roadway, installing
traffic control devices, and by doing all work necessary in connection therewith, and
WHEREAS, the Board of County Commissioners did sit as a board of
equalization for the purpose of considering such roll, and
WHEREAS, the Board of County Commissioners heard all persons wishing to
be heard and considered all written objections to the confirmation of the assessment
roll, or any part thereof, and did correct, revise, raise, lower, change, or modify the
assessment roll, or any part thereof, or set aside the assessment roll in order that
such assessment be made de nova as to such body shall appear just and equitable and
then proceed to confirm the same by resolution, and
WHEREAS, the Board of County Commissioners has given due consideration
to the special benefits to be received by each property shown on the final assessment
roll for Grant County Road Improvement District No. 92-1, and after examining the
properties within said district has concluded that no assessment is greater than the
special benefits derived from the improvements, and the assessments are equitable
and just, and the amounts charged against the properties on the final assessment roll
are in accordance with the method of assessments provided by law and clearly reflect
the special benefits received by said properties;
NOW, THEREFORE, BE IT RESOLVED by Board of County Commissioners
for Grant County as follows:
Section 1: The Board of County Commissioners confirms the final assessment
roll for Grant County Road Improvement District No. 92-1 as submitted by the
County Engineer in the amount of $385,500.00.
Section 2: Each of the properties shown on the final assessment roll is declared
to be specially benefitted by the completed improvements in at least the amount
charged against the same, and it is further declared the assessments appearing
Gent County RID No. R2.1
appearing against the same are in proportion to the assessments appearing upon the
final assessment role, and there is levied and assessed against each property
appearing on the role the amount finally charged against the same thereon.
Section 3: The Board of County Commissioners certifies the final assessment
role to the County Treasurer for collection in accordance with the law, and orders
created in the office of the County Treasurer a fund in the County to be known and
designated as "Grant County Road Improvement District No. 92-1 Bond. Guarantee
Fund". Said bond guarantee fund shall use County Road Funds in the amount
determined by the County Treasurer and approved by the County Road Engineer in
order to pay promptly any outstanding bond debt.
Section 4: The assessments may be paid in cash within thirty (30) days from
the date of first publication by the County Treasurer of notice that the final
assessment role is in his hands for collection, without penalty, interest, or cost, or if
not then may, at the option of the property owner(s), be paid in up to fifteen annual
installments with interest thereon at the rate of six percent (6%) per annum, except
that if the average interest rate, without regard to bond discount, of the bonds issued
for Grant County Road Improvement District No. 92-1 is other than six percent (6%)
per annum, the interest rate shall be one-half of one percent (0.5%) greater than the
average interest rate of those bonds.. The first installment of assessments on the
final assessment role for Grant County Road Improvement District No. 92-1 shall
become due and payable during the first thirty (30) day period succeeding a date one
(1) year after the date of first publication by the County Treasurer of notice that the
final assessment role is in his hands for collection, and annually thereafter, each
succeeding installment shall become due and payable in like manner. If the whole
or any portion of the assessments remain unpaid after the first thirty (30) day period,
interest upon the whole unpaid sum shall be charged at the rate as determined above,
and each year thereafter one of the installments, together with interest due upon the
whole unpaid balance, shall be collected. Any installment not paid prior to the
expiration of that thirty (30) day period, during which such installment is due and
payable, shall thereupon become delinquent. Each delinquent installment of
principal and interest shall be subject to a charge for interest at the rate as
determined above from the date of delinquency until paid, and for an additional
penalty charge of twelve percent (12%) per annum levied upon that delinquent
installment of principal and interest. The collection of such delinquent installments
shall be enforced in the manner provided by law.
