HomeMy WebLinkAboutResolution 94-108-CCBOARD OF COUNTY COMMISSIONERS GRANT COUNTY, WASHINGTON IN THE MATTER OF APPROVAL OF A PLANNED UNIT DEVELOPMENT ON 252 ACRES INTO 65 LOTS IN A PORTION OF SECTION 13, TOWNSHIP 18 NORTH, RANGE 22 EAST, W.M. RESOLUTION #94 -108 -CC RESOLUTION ADOPTING THE PLANNING COMMISSION RECOMMENDATION WHEREAS, the Board of County Commissioners of Grant county have been advised by the Grant County Planning Commission that a public hearing was conducted on May 4,1994 on the matter of designating 252.72 acres of land zoned Open -Space Recreation as a PLANNED UNIT DEVELOPMENT in a portion of said Section 13, Township 18 North, Range 22 East, W.M. and; . WHEREAS, the Grant County Planning Commission recommended approval of said request, and WHEREAS, the Grant County Commissioners have given notice this matter would be considered at their regular meeting on May 24,1994, and WHEREAS, the Board of County Commissioners have decided additional information presented at a Public Hearing on June 20,1994 should be included in a decision on said matter, and WHEREAS, the Board of County Commissioners after the Public Hearing on June 20,1994 feel additional information from the County Engineer is required, and WHEREAS, the Board of County Commissioners after a public meeting with the County Engineer and the Developer on July 19,1994 have conditioned approval on the following: 1. A plan and profile of the access road from Sunland Road to the South boundary line of the PUD must be submitted for review and approval to the County Engineer. 2. A cul -de -'sac must be provided at the South end of the main access road. 3. All roads providing access to more than 4 lots will be public roads constructed to County road standards. 4. Lots 43, 44, 53, 54, 55, 56, 57, 58, 59, 60, 61, 62, 63, 64 and 65 shown on map dated 3/7/94 are withdrawn at present layout but may be incorporated within upper portion of development. WHEREAS, the Board of County Commissioners have found the recommendations of the United States Bureau of Reclamation to provide fencing on both sides of the proposed public access road, where feasible, is required to provide necessary ecological safeguards and would have no negative impacts on wildlife and all other necessary rights and approvals are acquired, and WHEREAS, the Board of County Commissioners have found that the recommendations of Grant County Fire District #3 are conditions of approval and are as follows: 1. Water supply for fire protection must be provided at minimum county requirements. 2. Fire breaks between open un -developed areas must be established to minimize the potential of fire spread and exposure. 3. Combustible roof coverings shall not be allowed. 4. All plantings must be of fire resistive and drought adaptive varieties. WHEREAS, the Board of County Commissioners have found that the recommendations of the Grant County Health District are conditions of approval and are as follows: 1. Test holes will be required for soil evaluation and feasibility of septic systems. 2. Health District recommends a community water system. WHEREAS, the Board of County Commissioners have found that the recommendations of the Grant County Fire Marshal are conditions of approval and are as follows: 1. Fire water supply will be required at 750 gallons per minute with a duration capability of 1 hour, storage of 45,000 gallons will meet this requirement. 2. Developer may also choose to provide 25 foot fire protection easements to meet fire protection requirements. WHEREAS, the Board of County Commissioners have found that the recommendations of the Bureau of Reclamation are conditions of approval and are as follows: 1. A commitment in the checklist to retention of all storm water on-site not just a statement that drywelis will be used if necessary. 2. Consultation with the State Historic Preservation Officer is required to protect possible cultural resources. WHEREAS, the Board of County Commissioners have found that the recommendations of the Washington State Department of Fish and Wildlife are conditions of approval and are as follows: 1. A minimum of 156 acres of undisturbed habitat on-site be set aside in perpetuity as "Wildlife Open Space". it 2. Residential development be clustered, in consultation with the WDFW. Further, commitments be made to specific "building sites" on all .respective lots. 3. Removal of native vegetation outside of designated building sites be prohibited. 4. Property boundaries adjacent to WDFW lands be fenced to prevent random ORV access. 5. A means to address control of dogs and cats, to minimize their predation on wildlife must be established. 6. Control of noxious weeds along access roads, to prevent their invasion into adjacent wildlife lands must be addressed. 7. Livestock grazing will be prohibited within the designated "Wildlife Open Space" area. 8. Measures to control runoff must be specific to ensure maximum protection to the water quality of the Columbia River and its fisheries, due to it's close proximity. 9. Access must be strictly limited to the residential development area, and not for establishing restricted private access to Grant County Public Utility District Shorelines property on Wanapum Pool. 10. The proponent must revise the declaration of covenants, conditions and restrictions of Suncliff Estates to address mitigative issues prior to final approval. 11. The proponent must establish a Homeowners Association that will be responsible for mitigation measures in perpetuity. WHEREAS, the Board of County Commissioners have reviewed the Environmental Checklist and signed a Determination of Non Significance for this proposal, NOW, THEREFORE, BE IT HEREBY RESOLVED that the Board of County Commissioners for Grant County, Washington by this Resolution, does amend the Grant County Comprehensive Plan and Official Zoning Map for Grant County to the effect that the following described property shall henceforth be designated as a Planned Unit Development: Government Lots 1 and 3 and a portion of Government Lots 4 and 8 and a portion of the West one-half of the Northeast one-quarter of the Southeast one-quarter and a portion of the Northeast one-quarter of the Northwest one-quarter all in Section 13, Township 18 North, Range 22 East, W.M., Grant County, Washington, based on the following findings of fact: r . P 1. Complies with all County zoning regulations and requirements. 2. Is in compliance with State Environmental Policy Act and a Determination of Non -significance has been issued on June 20,1994.
