Box 37 Ephrata, WA 98823 Re: Grant County Local Improvement District No. 93-3 Dear Peggy: Enclosed please find a revised resolution confirming the assessment roll for LID No. 93-3. The resolution has been revised to reflect in the eighth recital that the public hearing was continued and also shows that the date of adoption of the resolution is January 17. Although I will be unable to attend the public hearing due to a prior commitment in Spokane, I will be available by telephone during the hearing. If the Beard elects to confirm the assessment roll in its current state, then I would appreciate it if you would send me three copies of the executed resolution confirming the assessment roll. If the Board elects to decrease the assessments on the assessment roll, then the amount stated in Section 1 should be revised. Finally, if the Board elects to raise any assessment, then a new hearing, together with new information, must be held. I hope that all goes well on Tuesday. RESOLUTION NO. 95 -__L__ -CC A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF GRANT COUNTY, WASHINGTON, CONFIRMING THE FINAL ASSESSMENT ROLL FOR ROAD IMPROVEMENT DISTRICT NO. 93-3; CERTIFYING SAID ASSESSMENT ROLL TO THE COUNTY TREASURER FOR COLLECTION; DIRECTING THE COUNTY TREASURER TO GIVE NOTICE THAT THE ASSESSMENT ROLL IS IN HIS HANDS FOR COLLECTION; AMENDING RESOLUTION NO. 93 -51 -CC; PROVIDING FOR THE TIME IN WHICH ASSESSMENTS AND INSTALLMENTS THEREOF ARE TO BE PAID; PROVIDING FOR THE RATE OF INTEREST PAYABLE ON ASSESSMENT INSTALLMENTS; PROVIDING FOR THE PENALTY PAYABLE ON DELINQUENT ASSESSMENTS AND INSTALLMENTS THEREOF; PROVIDING FOR THE ACCELERATION OF SUCH INSTALLMENTS IF PAYMENT OF ANY INSTALLMENT IS DELINQUENT; AND PROVIDING FOR OTHER MATTERS PROPERLY RELATING THERETO GRANT COUNTY, WASHINGTON ROAD IMPROVEMENT DISTRICT NO. 93-3 BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF GRANT COUNTY, WASHINGTON, as follows: WHEREAS, Grant County, Washington (the "County"), is a third-class county duly organized and existing under the Constitution and laws of the State of Washington; WHEREAS, the Board of County Commissioners (the "Board") is authorized to create road improvement districts and levy special assessments therein pursuant to chapter 36.88 RCW; WHEREAS, the Board, by Resolution No. 93 -51 -CC, adopted on May 25, 1993, duly created Grant County Road Improvement District No. 93-3 ("RID No. 93-3"); WHEREAS, the improvements ordered by Section 1 of Resolution No. 93 -51 -CC have been completed and the Board now desires to confirm the final assessment roll in regard thereto; WHEREAS, the final assessment roll for RID No. 93-3 has been prepared and filed with the Clerk of the Board; WHEREAS, the Board has found and determined that the boundaries of RID No. 93-3 embrace as near as practicable all the property specially benefited by the improvements ordered therein and that the method of assessment specified in Resolution No. 93 -51 -CC is [KA943640.0081 the most practical and equitable method of assessment under the conditions prevailing among the parcels within RID No. 93-3; WHEREAS, notice of the hearing on the final assessment roll of RID No. 93-3 was given by publication and mailing, in accordance with law; WHEREAS, the Board conducted a public hearing on January 10, 1995, which hearing was continued to the date hereof, at which the Board convened as a board of equalization for the purpose of considering the assessment roll for RID No. 93-3 and all written objections to such assessment roll that were properly filed with the Clerk of the Board; WHEREAS, no owners or reputed owners of property within RID No. 93-3 filed protests in objection to the special assessments proposed to be levied upon their property; WHEREAS, the Board has not determined it necessary to correct, revise, lower, change, or modify the assessment roll for RID No. 93-3, or to set aside such assessment roll in order that such assessment be made de nova; WHEREAS, the Board has determined not to raise any assessment appearing on the assessment roll for RID No. 93-3, or to include property subject to assessment that was omitted from such assessment roll; WHEREAS, the Board desires to confirm the assessment roll for RID No. 93-3 and provide for the collection of assessments in order to mitigate the interest expense chargeable to short-term construction financing for RID No. 93-3; and WHEREAS, the Board intends to issue bonds payable from that portion of assessments confirmed on such assessment roll that are not paid within the 30 -day period for payment provided for by RCW 36.88.270; NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED AND ORDERED, as follows: Section 1: The Board hereby confirms the assessments on the assessment roll for RID No. 93-3, which assessment roll is attached hereto as Exhibit "A" and is incorporated herein by reference (the "Assessment Roll"). The Assessment Roll is in all respects confirmed and approved in the total amount of $247,589.08. The Board hereby finds and determines that no assessment listed on the Assessment Roll is greater than the special benefit derived by the property so assessed for the improvements ordered in RID No. 93-3. Section 2: The Board hereby certifies the Assessment Roll to the County Treasurer (the "Treasurer") for collection. The Board hereby authorizes and directs the Treasurer to proceed to collect the assessments shown on the Assessment Roll in accordance with law. -2- Section 3: As soon as the Assessment Roll has been placed in the hands of the Treasurer for collection, the Treasurer shall publish a notice in two consecutive daily or weekly issues of the official newspaper of the County, stating that: (a) the Assessment Roll is in his hands for collection; and (b) any assessment listed on the Assessment Roll (or any portion of such assessment) may be paid without penalty, interest or costs at any time within 30 days from the date of the first publication of such notice. Such notice shall be substantially in the form attached hereto as Exhibit "B", which is incorporated herein by reference. Proof of such publication shall be by affidavit of the publisher. Section 4: The Treasurer is hereby directed to cause notice to be sent by first- class mail, postage prepaid, to each owner or reputed owner of property whose name appears on the Assessment Roll within 15 days of the date notice is first published under Section 3 of this Resolution, stating that: (a) the Assessment Roll is in his hands for collection; and (b) any assessment listed on the Assessment Roll (or any portion of such assessment) may be paid without penalty, interest or costs at any time within 30 days from the date notice is first published under Section 3 of this Resolution. Such notice shall be mailed to the respective addresses shown on the tax rolls of the Treasurer for said owners or reputed owners of property listed on the Assessment Roll. Notwithstanding the foregoing, any such notice to be mailed to the State of Washington, or any county, school district or any municipal corporation shall be mailed in the manner required by RCW 36.88.360, RCW 79.44.040 and WAC 82-12-020. Such notice shall be substantially in the form attached hereto as Exhibit "C", which is incorporated herein by reference. Proof of mailing shall be by affidavit of the mailer. Any inadvertent failure by the Treasurer to mail the notice required by this Section 4, or any delay in its delivery to property owners, shall not constitute a waiver of the requirement to pay assessments within the time and in the manner set forth in Section 6 of this Resolution or of the penalty and interest due on such assessments if not paid pursuant to Section 7 of this Resolution. Section 5: Section No. 7 of No. 93 -51 -CC is hereby amended as follows: "That there be and is hereby created in the office of the Grant County Treasurer two funds of the County to be known and designated as "Grant County Road Improvement District No. 9303 Construction Fund." and "Grant County Road Improvement District No. 9303 Bond Fund." "The Grant County Road Fund shall be reimbursed for all costs and expenses incurred by reason of the District except those costs or portions of costs which Grant County agrees to bear as hereinbefore stated. Such reimbursement shall be made by the issuance of warrants against the Grant County Road Improvement District No. 9303 Construction Fund. "All moneys collected by the County Treasurer upon any assessments levied for the construction of said improvement shall be placed in the said Construction Fund during the thirty (30) day period allowed for payment of -3- such assessment without penalty or interest and shall be placed in the said Bond fund thereafter. Bonds of said improvement district, payable not later than ((ten)) 12 years from date of issuance, shall be sold in the amount sufficient to reduce all outstanding warrants against aforesaid construction fund for that portion of the cost and expenses of the installation of said improvement to be assessed against the property within the district after determining the amount of such assessments paid within the thirty (30) days period allowed for payment of assessments without penalty of interest. "The interest charged on the unpaid assessments shall be the same rate as the rate of interest the Road Improvement District bonds shall bear." Section 6: Each assessment confirmed by Section 1 of this Resolution may be paid (in whole or in part) without penalty, interest or cost, at any time during the 30 -day period commencing on the date notice is first published pursuant to Section 3 of this Resolution. The sum of each assessment remaining unpaid after such 30 -day period shall be payable in ten equal annual installments, together with interest on the total outstanding sum of such assessment during the year preceding each installment payment date; provided, the owner of any property listed on the Assessment Roll may, at any time after the 30 -day payment period, pay the unpaid amount of the assessment against its property, together with all interest due thereon to the installment payment date next falling due. Section 7: The rate of interest on each assessment (or portion thereof) remaining unpaid after the initial 30 -day payment period provided for by Section 6 of this Resolution shall be 8.50 percent per annum; provided, that if the average interest rate fixed on the bonds payable from such assessments is other than 8.50 percent per annum, the interest rate on the unpaid assessments shall be equal to the average interest rate on the bonds. Interest on the unpaid assessments shall be calculated on the basis of a 360 -day years consisting of twelve 30 -day months. Section 8: The first installment of assessments on the Assessment Roll shall become due and payable on a date one year after the end of the 30 -day payment period provided for by Section 6 of this Resolution. Subsequent installments shall become due annually thereafter and shall be payable in like manner. Any installment not paid on the due date thereof shall thereupon be delinquent and subject to a 12 percent penalty levied upon both principal of and interest due upon such installment. Interest at the rate fixed by Section 7 of this Resolution shall continue to accrue on the delinquent installment to the date such installment, together with the interest and penalty thereon, are paid. Section 9: Pursuant to RCW 35.50.040 and 36.88.140, the Board hereby provides that upon the failure of an owner of property to pay any installment due under Section 8 of this Resolution, the entire assessment remaining unpaid on such property as of the date of such delinquency shall become immediately due and payable, and the collection thereof enforced by foreclosure. All actions heretofore taken in connection with RID No. 93-3 by the Board and the employees and agents of the County that are not inconsistent with the provisions of this Resolution are hereby ratified, confirmed and approved. Section 11: All resolutions or parts thereof in conflict herewith are hereby repealed to the extent of said conflict. This Resolution shall be in effect from and after its date of adoption. The assessment roll is in the hands of the Grant County Treasurer for collection. According to the assessment roll, you are the owner or reputed owner of a parcel of property within the boundaries of RID No. 93-3. The entire parcel is subject to the assessment. The total amount of the assessment due on such parcel is set forth below, which amount represents the special benefit to your property resulting ,from improvements to the roadways within RID No. 93-3, as more particularly described in Resolution No. 93 -51 - CC, adopted on May 25, 1993. The assessment against your property (or any portion of such assessment) may be paid without penalty, interest or costs at any time within 30 days from January 19, 1995. Thereafter, the amount of such assessment remaining unpaid shall be payable in ten equal annual installments, together with interest on the total outstanding sum of such assessment during the year preceding each installment payment date. At any time after the 30 -day payment period, you may pay the unpaid amount of the assessment against your property, together with all interest due thereon to the installment payment date next falling due. The rate of interest on each assessment (or portion thereof) remaining unpaid after the 30 -day payment period described herein shall be 6.90 percent per annum; provided, that if the average interest rate fixed on the bonds payable from such assessments is other than 6.90 percent per annum, the interest rate on the unpaid assessments shall be equal to such average interest rate. The first installment of assessments on the assessment roll for RID No. 93-3 shall become due and payable on a date one year after the end of the 30 -day payment period described above. Subsequent installments shall become due annually thereafter and shall be payable in like manner. Any installment not paid on the due date thereof shall thereupon be delinquent and subject to a 12 percent penalty levied upon both principal of and interest due upon such installment. Interest shall continue to accrue on the delinquent installment to the date such installment, together with the interest and penalty thereon, are paid. The assessment roll for RID No. 93-3 constitutes a lien upon the property assessed thereunder. Such lien is paramount and superior to any other lien or encumbrance whatsoever, except a lien for general taxes. Upon the failure of an owner of property to pay any installment when due, the entire assessment remaining unpaid on such property as of the date of such delinquency shall become immediately due and payable, and the collection thereof enforced by foreclosure. GRANT COUNTY, WASHINGTON DdTryl Pheasant, Treasurer _ Name and Address of Property Owner: Description of Property Being Assessed: Amount of Assessment: N GRANT COUNTY, WASHINGTON NOTICE OF COLLECTION OF ASSESSMENTS ROAD IMPROVEMENT DISTRICT NO. 93-3 The assessment roll for Grant County Road Improvement District No. 93-3 ("RID No. 93-3") was confirmed by the Board of County Commissioners of Grant County, Washington, by Resolution No. 95 -7 -CC, adopted on January 17, 1995. The assessment roll is in the hands of the Grant County Treasurer for collection. Any assessment listed on such assessment roll (or any portion of such assessment) may be paid without penalty, interest or costs at any time within 30 days from the date of the first publication of this notice. Thereafter, the amount of any assessment remaining unpaid shall be payable in ten equal annual installments, together with interest on the total outstanding sum of such assessment during the year preceding each installment payment date. The owner of any property listed on the assessment roll for RID No. 93-3 may, at any time after the 30 --day payment period, pay the unpaid amount of the assessment against its property, together with all interest due thereon to the installment payment date next falling due. The rate of interest on each assessment (or portion thereof) remaining unpaid after the 30 -day payment period described herein shall be 6.90 percent per annum; provided, that if the average interest rate fixed on the bonds payable from such assessments is other than 6.90 percent per annum, the interest rate on the unpaid assessments shall be equal to such average interest rate. The first installment of assessments on the assessment roll for RID No. 93-3 shall become due and payable on a date one year after the end of the 30 -day payment period described above. Subsequent installments shall become due annually thereafter and shall be payable in like manner. Any installment not paid on the due date thereof shall thereupon be delinquent and subject to a 12 percent penalty levied upon both principal of and interest due upon such installment. Interest shall continue to accrue on the delinquent installment to the date such installment, together with the interest and penalty thereon, are paid. The assessment roll for RID No. 93-3 constitutes a lien upon the property assessed thereunder. Such lien is paramount and superior to any other lien or encumbrance whatsoever, except a lien for general taxes. Upon the failure of an owner of property to pay any installment when due, the entire assessment remaining unpaid on such property as of the date of such delinquency shall become immediately due and payable, and the collection thereof enforced by foreclosure.
