HomeMy WebLinkAboutResolution 95-068-CCBOARD OF COUNTY Grant County, Washington IN THE MATTER OF FRENCHMAN HILLS ) WATER DISTRICT ) RESOLUTION NO. 95- 68 -CC A resolution of the Board of County Commissioners of Grant County, Washington: finding that Frenchman Hills Water District will be conducive to the public health, welfare and convenience; finding that Frenchman Hills Water District will be of special benefit to the land included within the boundaries of the proposed water district; establishing and defining the boundaries of Frenchman Hills Water District; directing the County Auditor to set a special election for the formation of Frenchman Hills Water District and approval or rejection of a one year levy in excess of the limitations provided by law; directing the County Auditor to set an election at the same election at which the proposition is submitted to the voters as to whether such water district shall be formed for the election of three water district commissioners; and providing for other matters properly relating thereto. BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF GRANT COUNTY, WASHINGTON, as follows: WHEREAS, Grant County, Washington (the "County"), is a Class 3 county, duly organized and existing under the Constitution and the laws of the State of Washington; and WHEREAS, the Board of County Commissioners (the "Board") of the County is authorized to conduct proceedings and to create water districts for the acquirement, construction, maintenance, operation, development and regulation of a water supply system pursuant to Chapter 57.04 RCW; and WHEREAS, the Board has been presented with a petition from the Marine View Heights Homeowner's Association for the formation of a water district for the acquirement, construction, maintenance, operation, development and regulation of a water supply system; and RES. SETTING ELECTION ON FORMATION OF FRENCHMAN HILLS WATER DISTRICT - 1 WHEREAS, said petition was found by the County Auditor to be legally sufficient and certified to contain a sufficient number of signatures; and WHEREAS, the Board at a regular meeting set the petition on for hearing pursuant to law; and WHEREAS, the Board at a regular meeting caused notice of the hearing on the petition for the establishment of Frenchman Hills Water District to be published in accordance with law; and WHEREAS, notice of the public hearing on the petition for the establishment of Frenchman Hills Water District was given by publication in accordance with law; and WHEREAS, the Board conducted a public hearing on May 15, 1995, to consider the petition for the establishment of Frenchman Hills Water District; and WHEREAS, during the public hearing, the Board considered written and/or oral objections to the establishment of Frenchman Hills Water District and/or the proposed boundary lines thereof; and WHEREAS, the Board has found and determined that Frenchman Hills Water District will be conducive to the public health, welfare and convenience; and WHEREAS, the Board has found and determined that Frenchman Hills Water District will be of special benefit to the land included within the boundaries of Frenchman Hills Water District; and WHEREAS, the Board has established and defined the boundaries of the proposed Frenchman Hills Water District as set forth in Exhibit A attached hereto and fully incorporated as set forth herein; and WHEREAS, the Board has found and determined that the County Auditor shall set a special election in accordance with law; and WHEREAS, said special election shall set forth the proposition of whether Frenchman Hills Water District shall be established; and WHEREAS, said special election shall also set forth the proposition of whether Frenchman Hills Water District Hills Water District, if formed, shall be authorized to levy at the earliest time permitted by law on all property located in Frenchman Hills Water District, a general tax for one year, in excess of the limitations provided by law, in the amount of $1.25 per thousand dollars of assessed value, for general preliminary expenses of Frenchman Hills Water District; and RES. SETTING ELECTION ON FORMATION OF FRENCHMAN HILLS WATER DISTRICT - 2 WHEREAS, three (3) water district commissioners shall be elected at the same election at which the proposition is submitted to the voters as to whether such water district shall be formed. The election of said commissioners for the proposed Frenchman Hills Water District shall be null and void if the ballot proposition to form the water district is not approved. NOW, THEREFORE, IT IS FOUND, DETERMINED AND ORDERED, as follows: Section 1: The Board has found and determined that Frenchman Hills Water District will be conducive to the public health, welfare and convenience. Section 2: The Board has found and determined that Frenchman Hills Water District will be of special benefit to the land included within the boundaries of Frenchman Hills Water District. Section 3: The Board has established and defined the boundaries of the proposed Frenchman Hills Water District as set forth in Exhibit A attached hereto and fully incorporated as set forth herein. Section 4: The County Auditor is hereby directed to set a special election on February 6, 1996, on the propositions as set forth herein, in accordance with law. Section 5: The Board has found and determined that said special election shall set forth the proposition of whether Frenchman Hills Water District shall be established. Section 6: The Board has found and determined that said special election shall also set forth the proposition of whether Frenchman Hills Water District Hills Water District, if formed, shall be authorized to levy at the earliest time permitted by law on all property located in Frenchman Hills Water District, a general tax for one year, in excess of the limitations provided by law, in the amount of $1.25 per thousand dollars of assessed value, for general preliminary expenses of Frenchman Hills Water District. Section 7: The County Auditor is hereby directed to set an election pursuant to the general election laws of the State of Washington, for three (3) water district commissioners, at the same election at which the proposition is submitted to the voters as to whether such water district shall be formed. The election of said commissioners for the proposed Frenchman Hills Water District shall be null and void if the ballot proposition to form the water district is not approved. Section 8: All actions heretofore taken in connection with Frenchman Hills Water District by the Board, employees and/or agents of the County that are not inconsistent with the provisions of this Resolution are hereby ratified, confirmed and approved. RES. SETTING ELECTION ON FORMATION OF FRENCHMAN HILLS WATER DISTRICT - 3 Section 9: All resolutions or parts thereof in conflict herewith are hereby repealed to the extent of said conflict. SETTING ELECTION ON FORMATION OF FRENCHMAN HILLS WATER DISTRICT - 4 Section 7: Government Lot 4 The South 200 feet of the Southeast Quarter of the Southwest Quarter of said Section 7. The South 200 feet of the Southeast quarter of said Section 7. Section 17: The West half of said Section 17, except that portion North of Marine View Heights Plat, West of Marine View Plat, and South of the Southerly boundary of state highway 262, and except that portion of Marine View Plat filed under Book 10, Page 5, Auditor's file number 629933, records of Grant County, lying easterly of the East boundary of a county road known as Highland Drive. Section 18: That portion of the East Half of said Section 18 known as Marine View Heights Plat, Divisions 2 and 3, filed under Book 10, page 67, Auditor's file number 664385, records of Grant County. That portion of the North half of said Section 18 lying North of the Southerly boundary of State Highway 262. EXHIBIT ---A
