(509) 754-2011 Ext. 321 BOARD OF COUNTY COMMISSIONERS GRANT COUNTY, WASHINGTON IN THE MATTER OF APPROVING THE PRELIMINARY PLAT OF NEPPEL ESTATES IN A PORTION OF SECTION 9, TOWNSHIP 20 N., RANGE 27 E., W.M., GRANT COUNTY, WASHINGTON) RESOLUTION NO. 95 -186 -CC RESOLUTION ADOPTING PLANNING COMMISSION RECOMMENDATION ROBERT & ESMERALDO WEIDIG WHEREAS, the Board of County Commissioners of Grant County have been advised by the Grant County Planning Commission that a public hearing was conducted on November 1, 1995 on the matter of approving the Preliminary Plat of NEPPEL ESTATES a 48 acre subdivision into 40 lots in a portion of said Section 9, Township 20 North, Range 27 East, W.M. and; WHEREAS, the Board of County Commissioners have set a public meeting for December 4, 1995. WHEREAS, the Board of County Commissioners have conditioned approval of the plat on the following items: 1. The subdivision shall be in compliance with the Grant County Comprehensive Plan, the Growth Management Act, The County Wide Planning Policies, The Washington State Environmental Policy Act, the Grant County Shorelines Master Program, the Grant County Zoning Ordinance and all applicable federal, state, and local regulations, rulings or requirements. 2. Proponent shall meet and comply to the fullest extent possible the recommendations of the Washington State Department of Fish and Wildlife which are listed as follows: a. Develop fire prevention and control programs to reduce the risk of fire losses of native shrub cover; this may include, among other things, green belts planted with fire resistant vegetation, or other means to reduce fuel buildup around perimeter of the development. b. Establish weed control programs to prevent noxious weeds from spreading outside the development into the adjacent native habitats. C. Discourage off road vehicle use to minimize disturbances to habitats and nesting birds. d. Through covenants in the land deeds, require strict control of cats and dogs to avoid predation and harassment of the native wildlife. Fire protection needs shall be met by proponent to include all applicable requirements of the Grant County Fire Flow guidelines, the Uniform Building Code and Uniform Fire Code. 4. Developer shall comply with all required improvements deemed necessary by the Grant County Public Works Department including the following: a. Access road shall be built to current county road standard. Lot 14, 15 and 21 shall be adjusted to provide a minimum of 50' frontage on the proposed access road. z b. Lots 13, 14, 15 and 16 shall be re -configured to provide for the future continuation of the access road to the Southeast and an easement dedication for future county road use to the East boundary. C. Road 11 N.E. from Neppel to the East boundary of the plat shall be required to be paved. 5. Developer shall address comments from the Washington State Department of Transportation and obtain all required permits and or approvals from the WSDOT including the following condition: a. The proponents shall improve the intersection of SR -17 and Road 11 N.E. to WSDOT Design Manual standards. 6. Developer shall comply with all requirements deemed necessary by the Grant County Health District and/or the Washington State Department of Health concerning the water supply system(s) and the sewage disposal systems. 7. Developer shall comply with all requirements of the Washington State Department of Ecology. WHEREAS, the Board of County Commissioners have upheld the findings of the Grant County Planning Commission that this proposal complies with the S-2 (Suburban) zoning district. NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners for Grant County, Washington by this Resolution approve the Preliminary Plat of Neppel Estates on the property described below: REVISED LEGAL DESCRIPTION OF PRELIMINARY NEPPEL ESTATES PLAT THAT PORTION OF THE WEST HALF OF THE NORTHEAST QUARTER OF SECTION 9, TOWNSHIP 20 NORTH. RANGE 27 EAST, W.M., GRANT COUNTY. WASHINGTON, LYING NORTHEASTERLY OF THE NORTHEASTERLY RIGHT OF WAY BOUNDARY OF STATE HIGHWAY 17, EXCEPT THE NORTHERLY 490.39 FEET OF THE WEST HALF OF SAID WEST HALF, AS MEASURED PERPENDICULARLY TO THE NORTHERLY BOUNDARY OF SAID NORTHEAST QUARTER. CONTAINING 48.08 ACRES MORE OR LESS. TOGETHER WITH AND SUBJECT TO EASEMENTS, RESERVATIONS AND RESTRICTIONS OF RECORD.
