RESOLUTION NO. 96-5—CC
RESOLUTION AMENDING THE
COUNTY COMPREHENSIVE
PLAN
ROBERT AND KATHRYN STRUGER
WHEREAS, the Board of County Commissioners of Grant County having received notice that a
public hearing was held on December 6, 1995 by the Grant County Planning Commission on the matter of a zone
change request by Robert and Kathryn Struger from Agriculture to Suburban -Agriculture on 269 acres in a
portion of Section 25, Township 20 North, Range 27 East W.M. and;
WHEREAS, the Board of County Commissioners, having received notice that the Grant County
Planning Commission could not reach a quorum on said zone change request, set the proposal for a public hearing
on January 8, 1996.
WHEREAS, the Board of County Commissioners have conditioned the approval on the
following items:
1. The zone change and any development subsequent to approval of the zone change request shall
be in compliance with the Growth Management Act, The County Wide Planning Policies, The
Washington State Environmental Policy Act, the Grant County Comprehensive Plan, the Grant
County Zoning Ordinance, the Grant County Shorelines Master Program, the Grant County
Resource Lands and.Critical Areas Ordinance and all applicable federal, state, and local
regulations, rulings or requirements.
2. Development subsequent to zone change approval shall comply to the fullest extent possible with
the recommendations and requirements of the Washington State Department of Fish and Wildlife
including the recommendation listed below:
a. Establish low density housing development consistent with local zoning designations.
b. Disturb the natural vegetation only to the extent necessary for construction of the roads
and building sites; place the building sites near the access roads to further minimize
disturbance and to maximize the amount of open space.
C. Establish control programs to prevent noxious weeds form spreading into adjacent
habitats.
d. Develop fire prevention and control plans to reduce potential losses of species and
habitat form wild fire.
e. Encourage individual home site developers to incorporate the natural vegetation into
their landscaping and land management schemes to further minimize disturbance.
f. Through covenants in the land deeds, require strict control of cats and dogs to avoid
predation and harassment of the native wildlife.
3. Zone change and subsequent development shall comply with all applicable requirements of the
Grant County Fire Flow guidelines and the Uniform Building Code and Uniform Fire Code.
4. Zone change and subsequent development shall comply with all improvements required by the
Grant County Public Works Department and the Washington State Department of
Transportation.
S. Developer shall comply with all applicable requirements of the Grant County Health District,
the Washington State Department of Health and the Washington State Department of Ecology
concerning water supply system(s) and the sewage disposal system(s).
6. If any Native American grave sites or archaeological resources are discovered or excavated the
developer shall stop work and notify the Yakama Nation Cultural Resource Program and the
Colville Confederated Tribes Cultural Resource Program.
WHEREAS, the Board of County Commissioners have found that the proposal falls within a
Critical area as defined by the Grant County Resource Lands and Critical Areas Development Ordinance. The
proposal subject to the review and letter submitted from the Washington State Department of Fish and Wildlife
does comply with the Critical areas ordinance.
WHEREAS, the Board of County Commissioners have found that the proposal is not within the
irrigated farm units of the Columbia Basin Project.
WHEREAS, the Board of County Commissioners have found that the proposal is consistent with
the agriculture resource land requirement of the Grant County Resource Lands and Critical Areas Ordinance, i.e.,
subject lands shall be preserved to the extent practical until that time that demand for higher density residential or
other uses is established to warrant the change.
WHEREAS, the Board of County Commissioners have found that the zone change proposal is
consistent with existing lot sizes in the area.
WHEREAS, the Board of County Commissioners have found that the proposal is adjacent to the
proposed interim urban growth boundary area as defined by the City of Moses Lake and this zone change is a
buffer zone between the larger lot sizes outside the proposed IUGA and the land within the proposed IUGA.
WHER::AS, the Board of County Commissioners have found that due to the population growth
and lack of parcels zoned to allow manufactured housing, there is a need for Suburban -Agriculture zoning.
WHEREAS, the Board of County Commissioners have found that the proposed zone change
complies with the intent and criteria of the Suburban -Agriculture zoning District.
NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners for Grant
County, Washington, does, by this Resolution, amend the Grant County Comprehensive Plan and Official Zoning
Map for Grant County to the effect that the following described property shall henceforth be zoned as
SUBURBAN -AGRICULTURE:
