HomeMy WebLinkAboutResolution 96-022-CCBOARD OF COUNTY COMMISSIONERS Grant County, Washington A RESOLUTION ESTABLISHING GRANT ) COUNTY'S POLICY FOR THE ) PROCESSING OF SEGREGATION ) REQUESTS ) RESOLUTION NO. 96- 22 -CC WHEREAS, Grant County (the "County") has seen a dramatic upswing in public requests for segregation of parcels of land in recent years; and WHEREAS, the Revised Code of Washington provides that the segregation of property for tax purposes shall not be permitted unless all delinquent taxes and assessments on the entire tract have been paid in full; and WHEREAS, the County desires to increase the organization among the departments and offices with duties and responsibilities in the segregation process; WHEREAS, the County is undergoing constant and increased pressures on its limited fiscal resources, to provide important government social services to the public, including criminal justice services, which prompt the policy choices set forth hereinafter; and RES. ESTABLISHING SEGREGATION POLICY - I WHEREAS, the County desires to make the wisest use of its limited fiscal resources; and WHEREAS, historically, a uniform procedure for the processing of requests for segregations has not been in place; and WHEREAS, without a uniform procedure for the processing of requests for segregations, the County cannot ensure that all applicants are being treated uniformly by County personnel and in a timely manner; and WHEREAS, it is essential that an application be filled out by parties requesting segregations in order to efficiently "track" the segregation process by County employees; and WHEREAS, heretofore, the County has not developed a segregation application that was routinely and uniformly required in all requests for segregations; and WHEREAS, it is essential that the County develop and adopt a uniform procedure, including without limitation, an application, for the processing of segregation requests, to limit legal exposure. NOW, THEREFORE, BE IT RESOLVED, that the Grant County Board of Commissioners (the "Commissioners") hereby enact the policy set forth herein, to provide for the processing of segregation applications among County offices and departments, with the continued anticipated cooperation of the Grant County Health District: RES. ESTABLISHING SEGREGATION POLICY - 2 POLICY I. ADMINISTRATION. The Treasurer's Office shall have the primary responsibility for the administration of this Resolution and shall report to the Commissioners periodically on instances suggesting the need for clarification or revision of the procedures specified by this Resolution. The Grant County Assessor and Prosecuting Attorney, and the Planning Department shall assist the Treasurer' Office in the discharge of the County's responsibilities under this policy. II. APPLICATION PROCESS. The Treasurer's Office is responsible for reviewing deeds and tax affidavits as they are filed by the public, to determine if a segregation of a current parcel or a boundary line adjustment is taking place. If either scenario occurs, the Treasurer's Office shall determine the tax status of the parcel at the time of the filing of the Deed and the excise tax application. If there are delinquent taxes on the affected parcel(s), the segregation process as set forth herein will not be commenced. If all taxes and assessments are current on all affected parcels, the applicant is to be instructed to fill out a "Segregation Application," and take same to the Assessor's Office for its review. A true and accurate copy of the Segregation Application (Application) is attached hereto as Exhibit A and incorporated by reference as if fully set forth herein. RES. ESTABLISHING SEGREGATION POLICY - 3 A. Assessor's Office. Reviews the Application verifying: that a segregation or boundary line adjustment is taking place: what parcels are being affected; and that the "Grantor(s)" as stated on the Deed and excise tax affidavit is/are the legal owner(s) of the property. Once the Assessor's Office review is complete, it "signs off" on the Application and forwards same to the Planning Department for its approval. B. Planning Department. Reviews the Application for parcel size creation, and determines whether the new parcels comply with all applicable laws and ordinances, including without limitation, zoning and minimum lot size requirements. Once the Planning Department's review is complete, it "signs off" on the Application and forwards same to the Treasurer's Office for its approval. C. Treasurer's Office. Processes the excise tax affidavit, stamps the Deed and attaches the completed original Application with signatures of approval from the respective departments and offices to the Assessor's copy of the excise tax affidavit. III. REQUIREMENTS. All applicants seeking to segregate a parcel of land in Grant County must successfully complete the Application before the review process by the appropriate County departments and offices set forth herein begins. All taxes and assessments shall be current on the affected parcels prior to the Treasurer's Office stamping the Deed and/or beginning the segregation process as set forth herein. Excise tax affidavits may be processed without taxes being current. RES. ESTABLISHING SEGREGATION POLICY - 4 IV. EFFECTIVE DATE: This policy shall take effect on 52 -,-2 % — 9 (D , 1996. Date Signature of Grantor/Agent Date Signature of Grantee/Agent NOTICE TO PROPERTY OWNER Building, development and/or access permits will require the approval of the Building Department and Public Works Department. Approval of water supply and septic systems will require the approval of the Grant County Health District to standards current at time of application of development permits. All property taxes must be current on all affected parcels prior to the processing and stamping of the deed. Final approval by the Grant County Planning Department will require confirmation of ownership and legal description by the Grant County Assessor's Office. Bring completed application to the Grant County Assessor's office for review. The Assessor will review your completed application and forward it on the County Planning department. When the review process is complete you will receive notice from the County Planning Dept. regarding the status of your application. 0 Once your Segregation Application is approved you may record your deed. Before convevance document(s) can be stamped for recording, all taxes and assessments must be current on all affected parcels by the segregation. NOTE THIS PROCESS WILL TAKE APPDXIMATELY 10 WORKING DAYS TO COMPLETE UNLESS REVIEW BY THE BOARD OF ADJUSTMENTS IS REQUIRED. APPLICATIONS REQUIRING BOARD APPROVAL COULD TAKE 45 TO 60 DAYS.
