HomeMy WebLinkAboutOrdinance 17-033-CC BOARD OF COUNTY COMMISSIONERS Grant County, Washington ORDINANCE RELATING TO ORDINANCE No. 17- ��> -CC PROCEDURAL CHANGES TO CHAPTERS 22.04, 23.04, 23.08, AND 25.08 OF THE UNIFIED DEVELOPMENT CODE WI3EREAS, Adequate accommodations have been made for agencies, individ�tals and interest groups to be heard and the Planning Commission has thoroughly considered the testimony in the record, and; WHEREAS, the proposed amendments are consistetit with adopted Co�nprehensive Plaii goals, objectives and policies, and do not create adverse impacts to offsite properties, and promote Plexibility of property use, and; WHEREAS, the Board of County Commissioners have found that the proposal is consistent with the general purpose and intenti of the Grant County Comprehensive Plan; and, WHEREAS,the Board of County Coi�amissioners has found that,the UDC Amendment will serve the public use and interest, and; WHEREAS,Appropriate notice has been given to the Washingtou State Department of Commerce Growth Management Services in accordance with RCW 36.70A.106, aud; WHEREAS, the proposed amendments are consistent with the applicable portions of RCW 36.70B, and; WH�REAS, the Planning Commission conducted a public hearing and found the changes to be consistent with prudent operating procedure for the Grant Co�inty Planning Department, and; WHEREAS,P1amling Staff shall have the authority to make gram�natical and format changes as necessaiy to achieve code uiliformity. Substantive changes are not to be made without further review by the Plamling Commission and Board of County Commissioners. NOW, THEREFORE, BE IT HEREBY ORDAINED THAT the Grant Connty Board of Commissioners, ADOPT the procedural amendments to GCC 22.04, 23.04, 23.08, and 25.08; and BE IT ALSO FURTHER ORDAINED that the effective time �nd date for these �mendments shall be 5;00 p,m. on the date of BOCC signature. General Provisions 2 3 22.04.010 Purpose and Intent 4 5 (a) Purpose: In addition to those purposes set forth in RCW 58.17.010, the following purposes are also 6 essential to the regulation of division of land within the unincorporated areas of Grant County: 7 (1) To promote the effective utilization of land; g (2) To malce adequate provision for the housing,commercial,and industrial needs of the County; 9 (3) To prescribe procedures for the subdivision of land and to effectuate the land division standards 10 pertaining to the creation of new lots in accordance with the adopted Grant County 11 Comprehensive Plan; 12 (4) To promote orderly division and development of lots; 13 (5) To provide adequate fire access to residences; 14 (6) To promote establishment of roadways and easeinents to provide adequate and safe traffic 15 circulation to serve developable lots and to meet future development and roadway needs; 16 (7) To ensure that sewage disposal systeins are adequate to support future construction; 17 (8) To provide adequate drainage from roadways and easements; and 18 (9) To provide for the effective processing of land division applications without undue delay. 19 20 (b) Intent: This Chapter governs the division and re-division of land into lots for the purpose of sale, 21 lease or other transfer by utilizing one of the following processes: subdivision, short subdivision, 22 binding site plan or an exemption under GCC § 22.04.020. This Chapter also governs the minor 23 adjustment of boundary lines through the Boundary Line Adjustment process. The intent of this 24 Chapter is to carry out the policies of the Comprehensive Plan and the laws of the State of 25 Washington relating to land division. 26 27 (c) General Provisions: 28 (1) Only a legal lot,as de�ned in GCC 25.02,may be divided; 29 (2) For the purpose of determining the gross acreage of a proposed land division, the acreage shall 30 include that area which would be bounded by the center line of any existing public road or street 31 which is adjacent to the land division, and the side lot lines of the lot running perpendicular to 32 such center line; and 33 (3) For the purposes of determining whether proposed lots within a proposed land division meet the 34 minimum lot size of the zone, the proposed lot acreage shall include: 35 (A) that area which would be bounded by the center line of any existing public road or street 36 which is adjacent to the lot and the side lot lines of the lot running perpendicular to such 37 center line; and 38 (B) that area which would be bounded by the center line of any proposed public or corporate 39 road or street which is adjacent to the lot and internal to the land division, and the side lot 40 lines of the lot running perpendicular to such center line. 41 42 (d) Applications for divisions of land not determiued to be exernpt from the requirements of this Chapter 43 shall be reviewed in accordance with the requirements of GCC § 25.04. 4�4 45 (e) The Director of the Grant County Department of Community Development (Department) shall be the 46 Administrative Official vested with the duty of'administering the provisions of this Chapter. 47 48 22.04.020 Applicability/Exemptions 49 50 (a) This Chapter shall apply to all divisions and re-divisions of land for the purposes of sale, lease or Chapter 22.04 1 March 2011 amendments 1 other transfer unless the Administrative Of�cial detennines that a division of land exclusively 2 pertains to: 3 (1) Cemeteries and other burial plots while used for that purpose; 4 (2) Any division of land not containing a dedication in which the smallest lot created by the division 5 40 acres or greater, including fractional sections having a theoretical area of 40 acres or more, 6 such as the NE '/ of the NE '/; unless such divisions would be inconsistent with other provisions 7 of this Code. These divisions shall utilize the Boundar,�_e Adjustment application process 8 and are required to be accoinpanied by a surve��repared b��rofessional survevor licensed in 9 the State of Washington; 10 (3) Divisions made by testamentary provisions, or the laws of descent; provided, that newly created 11 parcels are subject to all zoning and building code regulations in effect at the time of the 12 application; 13 (4) The actions of govermnental agencies, such as acquiring land for the purpose of adding to 14 existing public road rights-of-way, creation of new public road rights-of-way, or other public 15 road construction purposes; 16 (5) A division of land pursuant to the requireinents of RCW 58.17.035 and GCC § 22.04 Article VII 17 for the purpose of: 18 (A) sale,lease or transfer of ownership of commercially or industrially zoned property; 19 (B) lease or rent when no residential structure other than mobile homes,recreational vehicles or 20 travel trailers are permitted to be placed upon the land; or 21 (C) creation of condominium units pursuant to RCW 58.17.035, RCW 58.17.040, RCW 64.32, 22 and RCW 6434; 23 (6) Any division of land used solely for the installation of public roads or facilities, electric power, 24 telephone,water supply, sewer or other utility facilities of a similar nature; except,however,that 25 land leases for wireless cominunication facility sites, as defined in GCC § 23.08.450, are not 26 exempt from the requirements of thzs Chapter; 27 (7) Any division of land solely for the purpose of transfer to a public or legitimate non-profit 28 conservation organization for the purposes of conservation of a property in perpetuity with the 29 presence of species listed by the State as sensitive,threatened or endangered or by the County as 30 species of local concern for the purpose of preservation or conservation of the habitat for the 31 species of recognized biological value, or for the preservation of agricultural lands, or for other 32 open space resources designated in the Grant County Comprehensive Plan;and 33 (8) A Boundary Line Adjustment where the purpose of recording instruinents of conveyance is 34 solely for the purpose of rectifying a boundary line error, to rectify defects in legal description, 35 to allow the enlargement or merging of lots to improve a building site, to achieve increased 36 setbacics from property lines or critical areas, to correct situations wherein an established use is 37 located across a lot line, or for other similar purposes; provided that the Administrative Official 3 g determines that: 39 (A) The proposed.Boundary Line Adjustment does not: 40 (i) Create any additional lot,tract,parcel,building site, or division; 41 (ii) Result in any lot that contains insuf�cient area and dirnension to meet minimum 42 requirements for width and area of a building site; and 43 (B) The party seeking a boundary line adjustment submit a �nal record-of-survey document 44 prepared by a land surveyor°in accordance with WAC Chapter 332-130 and RCW Chapter I 45 58.09 in addition to any other required an�lication forms and materials. 46 (i) Record of Survey: A record of Survey with regards to a lot consolidation wi11 not be 47 required if the following canditions are met: 48 a. The lots have already been surveyed as part of an existing plat; and 49 b. The property owner shall submit a svvorn declaration that the corners have been 50 located and are visible in the�eld; and Chapter 22.04 2 March 2011 amendments 1 2 22.04.090 Metes and Bounds Filings—Auditor to Question 3 4 (a) The County Auditor shall inquire of every person who tenders for recording a deed or contract for the 5 sale of land in which appears one or more metes and bounds legal description of land, as to whether 6 the land so described is a new division of a parcel of land or a boundary line adjustment. In the event 7 that it is a new division or boundary line adjustment, or if the inquiry is not answered, the Auditor 8 shall not accept the deed for recording. All requests for the creation and/or adjustment of parcel 9 boundaries exempt from this ordinance must be processed by completion of a Segregation 10 Application. This Segregation Application process enables the Administrator to determine if the 11 division or boundary line adjustinent is an exempt division as described in GCC § 22.04.020. It also 12 allows the Adininistrator to determine if the proposed segregation or Boundary Line Adjustinent 13 complies will all local, state, and federal laws,including,but not limited to,RCW 58.17 and the Grant 14 County Zoning Ordinance. Upon learning of any recording of a deed in which a new division of a 15 parcel or a boundary line adjustment is involved without the filing of a Segregation Application, the 16 Administrator shall investigate the same to determine whether a division of land is in violation of this 17 Ordinance or any other local, state, or federal law. If a violation of any law has indeed taken place, 18 the Admirustrator shall notify the Grant County Prosecuting Attorney's Office of the violation. At a minimum, said 23 notice shall be provided to area utilities identified by the Utility Coordinating Council and/or One 24 Call Center. 25 (2) Provide Public Notice pursuant to GCC § 25.04.220(a)(3). 26 27 (e) Utility easement extinguishment/alteration shall only be approved by the decision malcer if the 2g following findings are made: 29 (1) The easement extinguishment or alteration is found to not be detrimental to the public interest; 30 and, 31 (2) No adverse comments were received by the utility providers; and, 32 (3) The easement is not found to be in use by any utility; and, 33 (4) The extinguishment or alternation is needed for purposes consistent with GCC § 22.04.020(a)(8). 34 35 (f� Following the approval of the Administrative Official the Planning Department shall prepare an 36 Extinguishment/Alteration document to be�led with the Grant County Auditor, record the same and 37 notify property owners of filing, 38 39 22.04.110 Modi�cations or Variances 40 41 (a) Any request for a variance froin or modi�cation to any of the requirements of this Chapter other than 42 to density or land use changes shall be processed as a development code variance, pursuant to the 43 variance requirements of GCC 25.08.Variances to density and land use would constitute a rezone and 44 shall follow procedures for a rezone in GCC 25.12. Applications for variances shall be heard 45 concurrent with the land division proposal. An extension of up to one year may be 28 granted by the Decision Maker if the pennittee demons�rates good cause for an extension. 29 If the Administrative Official does not approve the proposed use or developrnent, the applicant may 30 request that the proposed development or use be reviewed as a conditional use as specified in subsection 31 (c) of this section. The applicant shall file a conditional use application and pay any required fees, as 32 specified in GCC§25.08.060 or as established by resolution of the Board of County Commissioners. 33 34 (c) Conditional uses require a conditional use pei7nit, and are subject to a Type III quasi judicial review 35 as specified in GCC § 25.04.080 for coinpliance with: (1) the applicable development standards of 36 GCC § 23.12, (2) the performance and use-speci�c standards unique to the proposed use specified in 37 GCC § 23,08, and(3)the criteria for approval specified in GCC § 25.08.060. 38 39 (d) Variances to development standards of GCC § 23.12 may be requested in accordance with the 40 requirements of GCC § 25.08.060. 41 42 23.04.070 Siting of Essential Public Facilities-Unclassified Use Permit 43 44 (a) Purpose. The Growth Management Act directs that no comprehensive plan or development regulation 45 may preclude the siting of essential public facilities (RCW 36.70A.200(2)). The location and 46 permitting of essential public facilities shall be guided by the policies of Chapter 11 — Essential 47 Public Facilities Element of the Comprehensive Plan,subject to the following procedures: 48 (1) Essential public facilities shall be located if possible within zoning districts for which the proposed 49 uses are allowed; 50 Chapter 23.04 9 Jcznt�ary 2013 amendments 1 care of a tei-�ninally ill relative except that the Building Official may extend this period for additional 2 six month terms. A temporary manufactured home accessoiy to a fai�rn dwelling unit 5 on propei�ty meeting the definition of a fai�n in RCW 84.34.020 to accommodate agricultural workers 6 and their families employed on the premises,as provided: 7 (A) The property must meet the de�nition of a far�n in RCW 84.34.020 (Open Space Taxation). 8 (B) Demonstrate compliance with the temporary worlcer standards in Washington State Law 9 including RCW 19.27,RCW 70.114a,RCW 49.17,RCW 43.22,and RCW 43.70; 10 (5) Temporary fai7n labor camps. Temporary farm labor camps or housing other than manufactured 11 homes accessory to a farm dwelling unit on property meeting the definition of a farm in RCW 12 84.34.020 to accommodate agricultural workers and their families employed on the premises, as 13 provided: 14 (A) The property must meet the definition of a fann in RCW 84.34.020(Open Space Taxation). 15 (B) Demonstrate compliance with the temporary worker standards in Washington State Law 16 including RCW 19.27,RCW 70.114a,RCW 49.17,RCW 43.22,and RCW 43.70; 17 (C) The camps shall be occupied no more than eight(8)months in any twelve(12)-month period, 18 (D) Use shall be subj ect to site plan review and approval pursuant to Section§23.04.140; 19 (E) Use shall be subject to conditional use pennit pursuant to GCC § 25.08, an open record public 20 hearing conducted by the Hearings�xaminer,and approval of the following: 21 (i) Department of Community Development; 22 (ii) Health Official; 23 (iii) County Engineer; 24 (iv) Fire Marshall; 25 (v) Building Official;and 26 (vi) Other local,state and federal officials having jurisdiction; 27 (F) The term of any conditional use permit shall be for one(1)year; 28 (G) Complaints received pertaining to sanitation, disposal of waste znaterials, or if the conduct of 29 the camp creates extraordinary requirement for public services, including services of the 30 building, sanitation, planning, or sheriff departments, shall be suf#"icient cause to revoke or 31 suspend the conditional use permit or to require additional conditions,subj ect to an open public 32 heai�ing and decision by the Hearing Examiner; 33 (6) Temporary outdoor events pursuant to GCC§23.08.400; 34 (7) Temporaiy Wireless Communication Facilities pursuant to GCC§23.08.450;and 35 (8) Other mobile or temporary uses not requiring a building permit if allowed within the zoning district, 36 subject to review for adequacy of such factors as access,traffic,noise,land use compatibility,public 37 health and safety. Such permits shall expire one (1) year from issuance, and may be renewed 38 annually for an additional period of one(1)year. 39 40 (b) All temporary structures,except for construction pads and foundations intended to support subsequent 41 seasonal temporary structures, shall be removed upon termination of a temporary permit, and the site 42 shall be restored to existing conditions prior to occupancy of the temporary use. 43 44 23.04.140 Site Plan Review 45 46 (a) Purpose: This section provides for a comprehensive site plan review and approval process for: 47 (1) Commercial developinents; 48 (2) Industrial developments; 49 (3) Multi-family,condonninium and townhouse developments with more than four(4)dwelling units; 50 (4) Mobile/manufactured home parks;and Chapter 23.04 16 January 2013 amendments 1 (5) Farinworker accoiruizodations pursuant to GCC§23.08.190. 2 3 (b) Site plan review shall be required prior to the issuance of building and/or development permits. Planned Unit Developments 2 3 23.04.800 Planned Unit Developments 4 5 (a) Purpose: It is the purpose of this section to encourage innovation and creativity in the development of ' 6 new residential areas in Grant County. In order to make optimum use of these residential areas, to 7 create desirable neighborhoods for family and community life,to take into account special conditions 8 of topography and soil stability, to make maximum use of new concepts and technology of land 9 development and building constilzction, and to carry out the objective and spirit of the Comprehensive 10 Plan, it is the purpose of this section to encourage new residential development not limited by the 11 strict application of the county zoning and subdivision regulations. More specifically to achieve the 12 aforementioned purposes,it is the purpose of this Chapter to: 13 (1) Encourage development of a variety of housing types. 14 (2) Create and/or preserve useable open space and recreation and aesthetic enjoyment of residents. ' 15 (3) Preserve to the inaximum extent possible the natural characteristics of the land,including topography, 16 native vegetation and views. 17 (4) Encourage creativity in design. 18 (5) Provide for maximum efficiency in the layout of streets, utility networks, and other public 19 improvements. 2� (6) Provide a guide for developers and county officials who revi.ew and approve residential developments 21 meeting the standards and purposes of this article 22 23 A Planned Unit Development does not constitute a separate zoning district. Application of a Planned Unit 24 Development does not require a change in zoning. 36 (1} Sanitary landfills� 37 (2) Transfer stations;and 38 (3) Construction,demolition and landclearing(CDL)facilities. 39 40 (b) Solid waste handling and disposal facititics iiiay be allowed subject ta the following oonditions in 41 those zanir�g districts specifiad in Tables 3,4 and 5 of GCC § 23.04: 42 (1} Obtaining a conditional use pennit pursuant ta the�equire�n�nts af GCC §25.08; 43 {2} Obtaining a salid waste handling permit fioul the Grant County I�ealth Department?and 44 {3} Obtaining an access permit frozn the Caunty Engineer. 45 46 23.08.37Q 5torage and sale of Fei•tilizer,Pesticides,Herbicidcs,Soil SterilanLs and Fnrnigants 47 48 (a) The following standards shall apply to all facilities that are used for the storage and salc of fertilizer, 49 pesticides,herbicides,soil sterilants and fuxnigants: 50 Chaptet�23.08 32 Janarary ZQ13 ttmendments 1 (1) A minimum lot area of ten (10) acres is required, except that smaller lot areas may be 2 pennissible if the a�licant can clemonstrate that the nature and quantity of the materi�ls present , 3 at the site as well as the proposed site plan will comply with all �t�ulicable buildin� code fire 4 code aiid zoning code requirements, In no case shall the site be less than 5 acres in size; 5 (2) Shall have a minimum setbacic of fifty(50) feet on all property lines; additional setbacic may be 6 required by state or federal law; 7 (3) All such facilities shall be designed and located with full consideration of their proximity to 8 adjacent uses,their effect upon adjacent property, and to the reduction of nuisance factors; 9 (4) The owner or operator of such a use shall furnish evidence that the obnoxious characteristics of 10 the process or activity has been or shall be eliininated sufficiently as not to constitute a nuisance 11 or be detrimental to the health,safety, comfort or general welfare of persons residing or working 12 in or passing through the area; and 13 (5) The owner or operator of such a use shall have continuous obligation to prevent the creation of a 14 nuisance or hazard. 15 16 23.08.375 Storage and Treatment of Sewage Sludge and Septage 17 1g (a) Storage and treatment of sewage sludge and septage at any facility other than an approved sewerage 19 system plant,and development of storage or treatment facilities,are industrial uses for the purposes of 2� this UDC and are subject to the sita standards for industi7al uses in GCC § 23.08.230 and to approval 21 by the Grant County Health Officer. 22 23 (b) The iinportation of sewage sludge or septage frorn outside the county is subject to approval by the 24 Grant County Board of Health. 25 26 (c) The application of sewage sludge and septage to land for disposal or for fertilization is subject to 27 approval by the Grant County Board of Health. 28 29 23.08.380 Sugar Refinery Accessory Uses 30 31 (a) The following standards shall apply to all sugar refineries: 32 (1) Sugar refinery accessory uses ancillary to the primary agriculture processing facility which is 33 located in an industrial zone and which are a necessary and incidental part of the agriculture 34 processing facility provided: that such uses meet all current federal, state and local standards 35 including but not limited to noise, odor, dust, glare, air emissions, EMF, humidity, industrial 36 waste discharge and handling, electrical interference, �re and explosive hazard, and 37 environmental health; that the accessory uses are not detrimental to uses which are permitted in 3g an agriculture zone; that the property is developed as a single unit under common ownership; 39 that more that �fty (50) percent of the use lies on that portion of the property with the least 40 restrictive zone classification; and, that all accessory uses which may be permitted pursuant to 41 this section shall not have any substantial adverse effect on property which borders the most 42 restrictive zone and shall be in compliance with all applicable local, state and federal 43 requirements and regulations. 44 45 23.08.390 Tank rarm(Bulk Fuel Storage)Facilities 46 4"1 (a) The following standards apply to all tanlc fann (bulk fueling storage) facilities: 48 (1) Water supplies and sewage disposal facilities adequate to serve the proposed use shall be 49 provided in accordance with the requirements of GCC § 23.12. Occupancy shall not be 50 permitted before water supplies and sewage disposal facilities are approved and installed; ; Chapter 23.OS 33 January 2013 amendments 1 25.08.010 Purpose 2 3 (a) Conditional Use: provide flexibility in the implementation of GCC Titles 22,23 and 24. By providing 4 for the control of undesirable impacts through the attachment of specific conditions to the approval of 5 a proposed land use,the variety of uses permitted under each land use designation can be expanded. 6 7 (b) Variance: To ensure that all persons and their property are guaranteed equal rights and opportunities 8 under siinilar circumstances. A variance shall never be used to endow certain persons or property 9 with special privileges denied to all others under similar circumstances. Variances may only be 10 granted for dimensional, bullc, and area requirements specified by GCC Titles 22, 23 or 24. For 11 changes fi•om use or density standards, only the procedures for a site-specific re-designation as 12 delineated in GCC § 25.12 shall be used. 13 14 25.08.OB0 Applicability 15 16 (a) Conditional Use: as delineated in GCC Title 23. 17 18 (b) Variance: From the developinent standards delineated in GCC § 23.12 and/or the protection standards 19 of GCC § 24.08. 20 21 25.08.030 Process 22 I 23 (a) General: Conditional use permit and variance requests shall be classified and processed as Type III 24 procedures as delineated in GCC § 25.0�. The burden of proof shall be on the person requesting the 25 conditional use permit or variance to bring forth evidence in support thereof 26 27 (b) Notice and Public Hearing: A notice of application and public hearing is required for all conditional 28 use permit and variance requests as delineated in GCC § 25.0�. 29 30 25.08.040 Decision Making Authority 31 32 (a) The Decision Malcer shall be as specified in GCC §25.04.080. 33 34 25.0�.050 Application Procedures 35 36 (a) Requests for conditional use permits or variances shall be submitted on forms provided by the 37 Depai�tment. A narrative statement shall be included with the application for�ns demonstrating how 38 the request confoi�rns to the criteria for approval specified in GCC § 25.08.060, and shall include an 39 explanation as to why,if a Variance is denied,the Applicant would be denied all reasonable use of his 40 or her property. 41 42 25.08.060 Criteria for Approval 43 44 (a) Conditional Use Pennits: The Decision Maker, as defined in GCC § 25.04.080 shall grant a 45 conditional use only if the applicant demonstrates that the requested conditional use conforms to all of 46 the criteria set forth below: 47 (1) The proposed use will not be contrary to the intent or purposes and regulations of the Grant 48 County Code or the Comprehensive Plan; 49 (2) The proposal is appropriate in design, character and appearance with the goals and policies for 50 the land use designation in which the proposed use is located; Chapter 25.08 1 October 1,2000
