OF CERTAIN COUNTY ROAD(S) AND ) RESOLUTION NO. 97-176-CC
RIGHT(S)-OF-WAY )
) ORDER GRANTING VACATION
) AND ABANDONMENT OF A
) PORTION OF CERTAIN COUNTY
) ROAD(S) AND RIGHT(S)-OF-WAY
WHEREAS, the Board of County Commissioners of Grant County, Washington, were
petitioned to vacate and abandon certain portions of County roads and right(s)-of-way
described as follows:
That portion of Walnut Avenue lying between the southerly right-of-way line
of Fifth Avenue and the southerly right-of-way of Crescent Drive; and that
portion of Broadway Avenue lying between the southerly right-of-way of
Fourth Street and the southerly right-of-way line of Fifth Street, Plat of
Resurvey of and Addition to Trinidad, as recorded in Book 1 of Plats, Page
61; and
WHEREAS, per chapter 36.86 RCW, a notice of hearing on the report for vacation
and abandonment was published in the County official newspaper at least once a week for two

consecutive weeks preceding the date fixed for the hearing, and a copy of said notice was
posted for at least twenty days preceding the date fixed for hearing at each termini of the
County road or portion thereof to be vacated and abandoned; and
WHEREAS, the Board of County Commissioners did hold a public hearing on the
report of the County Road Engineer; and
WHEREAS, numerous parties voiced their objection to the vacation and abandonment
of the subject rights-of-way because public access to view the Columbia River and Crescent
Bar would be lost; and
WHEREAS, applicants agreed to provide public access to the subject view of the
Columbia River and Crescent Bar; and
WHEREAS, applicants agreed to grant a public easement for pedestrian traffic on the
easterly six feet of Walnut Avenue lying between the southerly right-of-way line and Fifth
Avenue, and the southerly right-of-way line of Crescent Drive; and
WHEREAS, the Board of County Commissioners did consider the report given by the
County Road Engineer, together with any evidence for or objection against said vacation and
abandonrnent; and
WHEREAS, the above described county road rights-of-way are not useful as part of
the County road system and the public will be benefitted by the vacation and abandonment,
excepting a six foot public easement for pedestrian traffic.

NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners
that the following described portion of Walnut Avenue lying between the southerly right-of-
way line of Fifth Avenue and the southerly right-of-way of Crescent Drive, except for the
reservation of an easement for the easterly six foot; and that portion of Broadway Avenue
lying between the southerly right-of-way of Fourth Street and the southerly right-of-way line
of Fifth Street, Plat of Resurvey of and Addition to Trinidad, as recorded in Book 1 of Plats,
Page 61, as said rights-of-way are found not useful as a part of the County Road system and
the public will be benefitted by the vacation and abandonment; and
BE IT FURTHER RESOLVED by the Board of County Commissioners, that the
portion of the above described property is hereby vacated and abandoned, subject to the
reservation of easement as set forth below:
Grant County hereby e�pressly reserves to itself, its successors
and assigns, and the general public, a perpetual, mutual and
exclusive easement in, under and across the above-described
property, such easement being described as follows:
A public easement reserved by Grant County for a
six foot pathway for pedestrian purposes, consisting
of the six feet on the most easterly six feet of
Walnut Avenue lying between the southerly right-of-
way line and Fifth Avenue, and the southerly right-
of-way line of Crescent Drive, with the rxght to
construct and maintain a pedestrian foot path over,
along and across the property herein described.
