HomeMy WebLinkAboutResolution 96-130-CCBOARD OF COUNTY COMMISSIONERS GRANT COUNTY, WASHINGTON IN THE MATTER OF DESIGNATING RESOLUTION NO. 96-130-CC THE INTERIM URBAN GROWTH ORDINANCE NO. 96-130-CC AREA FOR THE CITY OF SOAP LAKE CITY OF SOAP LAKE GRANT COUNTY WHER�AS, the Growth Management Act, Chapter 36.70A RCW (hereinafter GMA) requires Grant County to designate interim urban growth areas; and WHEREAS, the cities and towns and Grant Caunty have participated in the development of County wide Planning Policies; and, WHEREAS, The GMA requires that all cities within the county be included within an urban growth area; that urban growth be located first in areas already characterized by urban growth that have sufiicient existing public services and facilities to serve the development, and second, in areas already characterized by urban growth that will be served by a combination of existing and proposed services and facilities; and, WHEREAS, the City of Soap Lake has proposed an interim urban growth area for the City of Soap Lake on the basis of the following criteria which include: 1) The Final Adopted Policies of the Grant County Planned Growth Committee 5-6-93. 2) Draft City of Soap Lake Comprehensive Plan including goals with respect to land use, housing, economic development, open-space and recreation, transportation, utilities, and capital facilities. 3) Data and inforrnation developed by the City of Soap Lake and the analysis of such data and information by the City of Soap Lake Citizens Advisory Committee for the development of the City of Soap Lake Comprehensive Plan including populat'ron and land capacity analysis and financing strategies. 4) The City of Soap Lake has received input from the Comprehensive Plan Citizens Advisory Committee, the Planning Commission, and held public hearings. 5) The City Council of the City of Soap Lake has adopted the proposed IUGA. WHEREAS, the Washington State Department of Community, Trade and Economic Development was provided 60 day notice and opportunity to comment and no comments have been received; and WHEREAS, the Grant County Planning Director is the SEPA Responsible Ofiicial for the State Environmental Policy ACT (SEPA) purposes, and has reviewed a SEPA Bnvironmental Checklists and issued a Mitigated Declaration of Non-signiiicance (MDNS) for the establishment of the proposed IUGA; and WHEREAS, the Board of County Commissioners held a public hearing on August 14, 1995, upon notice, at which time the Board of County Commissioners heard comments in regard to the proposed IUGA at Soap Lake and continued the public hearing until September 11, 1995, upon notice, in the Board Room of the County Commissioners at the Grant County Court House, Ephrata, WA; and, WHEREAS, the Board of Caunty Commissoiners designated the Interim Urban growth area in its proceedings on September 11, 1995. WHEREAS, The Grant County Board of County Cammissioners makes the following findings and conclusions: 1. The Washington State Legislature has adopted the Growth Management Act. Grant County has been mandated to plan under the Growth Management Act. The Growth Management Act requires that Interim Urban Growth Areas be designated for cities, towns and rural urban nodes within Grant County. The City of Soap Lake has made a proposal for an interim urban growth area to the Grant County Board of Commissioners. A�nal urban growth area will be developed and proposed by the City of Soap Lake in the completed City of Soap Lake Comprehensive Plan. 2. The Washington State Legislature has determined the following, Growth and development is inevitable. Growth, development and population increase will affect the human and natural environment. The development of comprehensive plans and implementing development regulations as required by the Growth Management Act will constitute mitigation tools to mitigate potential adverse impacts to the human and natural environment resulting from growth, development and papulation increase in a planned, coordinated and funded manner concurrent with growth, development and population increase. 3. The City of Soap Lake has determined that its IUGA proposal represents a reasonable area to which the City of Soap Lake may provide urban services, facilities and utilities over a 20 year planning horizon. The City of Soap Lake has proposed an Interim Urban Growth Area providing sufficient �rea for development. The City of Soap Lake Comprehensive Plan, implementing development regulations, capital facilities � 5. plans and capital funding plans will address: land use; transportation; utilities; capital facilities; housing; economic development; open space and recreation; and, design in the City of Soap Lake and the proposed Interim Urban Growth Area. The City of Soap Lake and Grant County may develop Interlocal Agreements for joint planning to implement the Growth Management Act. The IUGA proposal by the City of Soap Lake and supporting documentation addresses criteria including but not limited to the following: A. B. C. D. E. Existing commercial and residential developments bordering the corporate limits of the City. Estimated population growth of the City. The capacity of the city for expanding urban governmental services as defined in RCW 36.70A. 030 (16). Availabrlity of land suitable for development in the city or the area adjacent to the City. Anticipated growth and development over a 20 year period of time. NOW, THEREFORE , BE IT RESOLVED; that the IUGA proposal by the City of Soap Lake is established by the Board of County Commissioners as identified in Exhibit A with the following stipulations: Stipulations: 1. The iinal urban growth area shall be proposed by the City of Soap Lake and designated in compliance with the Growth Management Act, The County Wide Planning Policies, The Washington State Environmental Policy Act, and all applicable federal, state, and local regulations, rulings or requirements. 2e The �nal urban growth area shall be proposed by the City of Soap Lake and designated in conformance, as required by the Growth Management Act, with revised population projections for Grant County as prepared by the Washington State Ofiice of Financial Management. Final Urban Growth Areas shall include areas and densities sufficient to permit urban growth that is projected to occur in Grant County within the next 20 years based upon official population projections for Grant County. 3. The final urban growt� area proposal by the City of Soap Lake and designation shall take into consideration SEPA Prethreshold Decision Scoping Review Comments and additional comments submitted by persons, agencies with jurisdiction, the Washington State Department of Ecology, affected Indian Tribes, and each local agency or political subdivision whose public services would be changed as a result of implementation of the IUGA proposal. 4. The Interim Urban Growth Area shall be considered as a long term urban growth area boundary providing capacity in lceeping with the City of Soap Lake's plans and projections for population growth and development in the agricultural, residential, commercial, industrial, and public sectors of the community and for the preservation an enhancement of the rural environment and life style enjoyed by the citizens of the City oi Soap Lake consistent with the requirements of the Growth Management Act. 5. Modification of interim urban growth areas may be made by the County based on revised data or changed circumstances. The interim urban growth area designated by this ordinance shall remain in effect only until such time as a iinal urban �rowth area is designated pursuant to the requirements of the Growth Management Act. 6. The City of Soap Lake has proposed future land use designations within the IUGA under the jurisdiction of Grant County to be used as a guide for the �evelopment of the iinal Urban Growth Area and the development of land use and development regulations. The City of Soap Lake and Grant County may work jointly to develop defined future land use designations within the IUGA and to create land use and development regulations for the IUGA consistent with the requirements of the Growth Management Act.
