HomeMy WebLinkAboutResolution 99-067-CC f BOARD OF COUNTY COMMISSIONERS � GRANT COUNTY, WASHINGTON IN THE MATTER OF APPROVING THE ) RESOLUTION NO. 99-67-CC SAND CASTLE ESTATES II PRELIMINARY ) PLAT, A 11-LOT SUBDIVISION ON 3.2 ) ACRES IN A RESIDENTIAL-ONE ZONE ) RESOLUTION APPROVING LOCATED IN A PORTION OF THE WEST ) A PRELIMINARY PLAT FOR HALF OF SECTION 3, TOWNSHIP 18 N., ) SAND CASTLE ESTATES III RANGE 28 EAST, W.M., GRANT COUNTY ) WASHINGTON ) MICHAEL BERNSEN WHEREAS, the Board of County Commissioners of Grant County have been advised by the Grant County Planning Commission that an open record public hearing was conducted on March 3, 1999 on the matter of approving the Sand Castle Estates III Preliminary Plat, an eleven (11) lot , subdivision on approximately 3.20 acres located in a portion of the West Half of Section 3, Township 18 North, Range 28 East, W.M., Grant County, Washington and; WHEREAS, the Grant County Planning Commission made a unanimous recommendation to approve the preliminary plat with conditions at the open record public hearing on March 3, 1999 and forwarded their recommendation to the Grant County Board of County Commissioners for final action and; , WHEREAs, the Grant County Board of Commissioners held a closed record public meeting on April 5, 1999 and April 13, 1999 and; WHE�zEA5, the Board of County Commissioners have made a decision to uphold the recommendation from the Grant County Planning Commission to approve the proposed preliminary plat with the conditions as stipulated by the Planning Commission and; WHEREAS, the Board of County Commissioners have found that the proposal does conform to the general purpose of the Grant County Comprehensive Plan and; W�Eu�As, the Board of County Cornmissioners have found that the public use and interest will apparently be served by the plat and; WHEREAS, the Board of County Commissioners have found that the requirements of the State Environmental Policy Act have been complied with and a Mitigated Determination of Non-Significance (MDNS) was issued on this proposal on February 5, 1999 and; WxEx�As, the Board of County Commissioners have concluded that appropriate provisions for drainage, roads, alleys, public ways, water supplies, sanitary wastes, parks, playgrounds, fire protection facilities, school sites and grounds and other public and private facilities and improvements have been made and; Page 2 of 3 IN THE MATTER OF APPROVING THE SANI7 CASTLE ESTATES II PRELIMINARY PLAT, A 11-LOT 5UBDIVI5ION ON 3.2 ACRES IN A RESIDENTIAL-ONE ZONE LUCATED IN A PORTION OF THE WEST HALF OF SECTION 3, TOWNSHIP 18 N,, RANGE 28 EAST, t7V,N1,, GRANT COUNT�' WASHINGTON W�x�As, the Board of County Connmissioners have found that the Preliminary Plat shall be ' gaverned by the following six (6) conditions of approval. NOW THEREFC?RE, BE IT RESOLVED, that the Board of County Commissioners for Grant County, Washington approve by this Resolution, a Sand Castle Estates III Preliminary Plat located in a portion of the West Half of Section 3, Township 18 North, Range 2$ East, W.M., Grant County, Washington. The preliminary plat is appraved subject to tki� following conditions. 1. The Propasal shall be in compliance with khe Grant County Comprehensive Plan, the Grawth . Management Act, The Washington State Environmental Policy Act, the Grant County Zoning Qrdinance, the Grant County Resaurce Lands and Critical Areas Development Ordinance and all applicable federal, staCe, and Iacal regulatians, rulings or requirements. 2. Proposat shall comply with ail requirements deemed necessary by the Grant County Health District, the Washingtan State Department af Health, and the Washington State Department af Ecalogy regarding domestic water supply, sewage systems and storm water cantrc�I and treatment including, but not Iirnited ta; RCW 90.48.080 Discharge of Folluting Water Frohibited; WAC 1'73-201, . Surface Water Sta�dards; WAC 173-201A, Graund Water Qualiry Standards; and, WAC 24b-272, � 4n-Site Sewag� Systems. . 3. Praposal shall comply with all requirements of the Grant Caunty Fire Marshal and shall comply with the Grant County Fire Flaw Guzdelines, the Uniform Building Code, Uniform Fire Cade and all other applicable requirements for fire protection. 4. Proposal shall camply with all requirements of the Grant County Public Woxks Department including, but not limited to: a. The preliminary plat approval by the Board af County Comrnissioners required the developer to construct a new raad to Scenic Drive or widen Viewmont Drive to Goodrich Road as a condition of approval of development, Neither option has been completed at this time. Prior �' to appraval of any additional lots in this area a mechanism needs to be provided to assure the '� cornpletion of one of these requirements. The approval action by the Baard also required the improvernent af the Goodrich Road and Pelican Lane/Place intersection to accommadate a "4 way stop". HALF OF SECTION 3, TOWNSHIP 18 N., RANGE 28 EAST, W.M., GRANT COUNTY ' WASHINGTON b. Access road must be built to current urban county access road standard with paving on both sides. c. Access permit required prior to the issuance of building permits. d. Conform to the plat requirements. 5. If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are ; found a11 construction activity shall stop and the owner/developer shall immediately notify the Colville Confederated Tribes and the Washington State Office of Archaeology and Historic Preservation. 6. Preliminary Plat approval shall be contingent upon conformance with all applicable land use rules and regulations in effect as of December 14, 1998 Done this�day of April, 1999.
