AN ORDINANCE ESTABLISHING REGULATIONS GOVERNING THE SITING OF WIRELESS CONTROL
TOWERS, ANTENNAS, RELATED APPARATUS AND STRUCTURES, FOR WIRELESS
COMMUNICATIONS SYST�MS, AND OTHER MATTERS PROPERLY RELATING THERGTO.
Recitals:
WHEREAS, the Federal Government, by and through the Federal Communications Commission (FCC),
has issued wireless communication licenses for personal communication services and other wireless technologies in
order for those license holders to provide wireless services ihroughout the United States of America; and
WHE1tEAS, the current zoning code of Grant County was adopted before new technology communication
facilities were anticipated, and therefore, appropriate siting and development standards do not exist; and
WHEREAS, the uncontrolled siting of communication towers, including without limitation, wireless,
radio, television, and all similar applications, in residential neighborhoods could have significant adverse effects and
cause irreparable harm; and
WHEREAS, the demand by the citizens, businesses, emergency services and government operations, for
new wireless communications services, has produced an increased need for installations of wireless antennas and
Wireless Comnnunications Facilities (WCFs), and other xelated apparatus and structures, to serve the public,
including without limitation, the citizens, businesses, emergency services and governmental operations in Grant
County; and
WH�REAS, WCFs and all other communication facilities, including without limitation, wareless
telephones, radio, television, and similar applications for communication, are supportive of the public health, safety
and welfare in that they provide useful portable communication services for personal convenience, business and
emergency purposes; and

WHEREAS, the FCC has required license holders to provide coverage to areas where wireless
communications licenses have been acquired and that this can require that such facilities be constructed in specific
locations and manners deteimined by engineering standards to achieve such coverage, and thus there may be limited
ability to choose alternative locations; and
WHEREAS, the Federal Telecommunications Act of 1996 (FTA) preserves local zoning autharity to
reasonably regulate Wireless Communications Facilities (WCFs); PROVIDED, however, that the FTA mandates
that localities may not unreasonably discrnninate among FCC license holders and that localities cannot prohibit or
have the effect of prohibiting the provision of wireless services, and the FTA gives the FCC sole jurisdiction over
Radio Frequency emissions of WCFs so long as WCFs meet FCC standards therefore; and
WHEREAS, additional WCFs are required to provide quality communication services to meet the growing
need of the public and businesses for wireless communication and should be accornmodated just as infrastructure for
utilities has been accommodated in the past; and
WHEItEAS, there is a need for new provisions in the County zoning code to address the siting of WCFs;
WHEI2EAS, the Planning Commission made a recommendation for approval of this ordinance at an open
record public hearing meeting held on October 7, 1998.
NOW THEREFORE, THE BOARD OF COUNTY COMMISSIONERS DO HEREBY ORDAIN
AND ESTABLISH AS FOLLOWS:
The following regulations shall govern the siting of WCFs in Grant County.

00.00.010 DEFINITIONS- For purposes of this chapter, the following words and phrases used herein shall
have the designated meaning unless a different meaning is expressly provided:
1. "Administrative Official" means Board of County Commissioners of the duly appointed Director of the
jurisdictional department of the County including the Grant County Department of Community Development
Director or the Directors designee, the Grant County Fire Marshal/ Building Official or designee, the Grant
County Public Works Director of the Directors designee.
2. "Anteima" means an implement or device designed and constructed primarily to receive and t�ansmit signals
described as "personal wireless cornmunications services", including global positioning satellite (GPS) data,
"personal communications services" (PCS) technology, and "pagers".

3. "Antenna Array" means one or more rods, panels, discs or similar devices used for the transmission or reception
of radio frequency signals, which may include omni-directional antenna (rod), directional antenna (panel) and
parabolic antenna (disc). The Antenna Array does not include the Support Shucture defined below.
4. "Attached Wireless Communication Facility (Attached WCF)" means an Antenna Array that is attached to an
existing building or structure (Attachment Structure), which structures shall not be limited to utility poles, signs,
water towers, with any accompanying pole or device (Attachment Device) which attaches the Antenna Array to
the existing building or structure and associated connection cables, and an Equipment Facility which may be
located either inside or outside of the Attachment St�ucture.
5. "Collocation/Site Sharing (Also Co-Location, Collocation, Colocation)" means the use of a common WCF or
common site by two or more wireless license holdars or by one wireless license holder for more than one type
of communications technology and/or placement of a WCF on a structure owned or operated by a utility or
other public entity.
6. "Development Standards" means those standards set forth in Section 00.00.040 and Table 1 herein.
7. "Directional Antenna" means an antenna designed to receive and/or transmit signals in a directional pattern
which is less than 360°, typically an arc of approximately 120°.
8. "Equipment Facility" means any structure used to contain ancillary equipment for a WCF which includes
cabinets, sheltezs, a buildout of an existing st�ucture, pedestals, and other similar structures,
9. "Height" means when referring to a WCr, the distance measured from the ground level to the highest point on
the WCF, including the Antenna Array.
10. "Lattice Tower" means a vertical support structure consisting of a network of crossed metal braces, forming a
tower which may be tluee, four, or more sided.
11. "Local Project Review Ordinance" means the Grant County Local Project Permit Review Ordinance,
"Ordinance 97-192-CC".
12. "Microcell" (as defined for SEPA exemption in HB 2828) means a wireless communication facility consisting
of an antenna that is either: (1) Four feet in height and with an area not more than five hundred eighty square
inches; of (2) if a tubular antenna, no more than four inches in diameter and no more than six feet in length.
13. "Monopole Tower" means a vertical support structure consisting of a single vertical metal, concrete, wooden or
composite material pole, typically round or square, and driven into the ground or attached to a foundation.
14. "Oxnni- Directional Antenna" means an antenna designed to receive and/or transmit signals in a 360° pattern, up
to 20 feet in height or length, and up to approximately 5 inches in diameter.
15. "Review Process" means those processes set forth Section 00.00.060 and Table 2 herein.
16. "Setbacic" means the required distance from the property line of the parcel on which the WCF is located to the
Support Structure.
17. "Support Structure" means a structure designed and const�ucted specifically to support an Antenna Array, and
may include a monopole, self supporting (lattice) tower, guy-wire support tower and other similar structures.
Any device (Attachment Device) which is used to attach an Attached WCF to an existing building or structure
(Attachment Structure) shall be excluded from the definition of and regulations applicable to Support
Structuxes.
18. "Temporary Wireless Communication Facility" means to be in place for ninety (90) or fewer days.
19. "Wireless Communications" means any personal wireless services as defined in the Federal
Telecommunications Act of 1996 which includes FCC licensed commercial wireless telecommunications

services including cellular, personal communications services (PCS), specialized mobile radio (SMR), enhanced
specialized mobile radio (ESMR), paging, radio, television and similar services that currently exist or that may
in the future may be developed.
20, "Wireless Communication Facility" or "WCF" means any unstaffed facility for the transmission and/or
reception of wireless communications services, usually consisting of an Antenna Array, t�ansmission cables,
and Equipment Facility, and a Support Structure to achieve the necessary elevation.
00.00.020 PURPOSE AND GOALS
The purpose of this ordinance is to establish general guidelines for the siting of WCFs.
The goals of this ordinance are to:
1, provide a range of locations for WCFs in a variety of zones;
2, within each zone, provide clear performance standards addressing the siting of WCFs;
3. encourage the location of WCFs on existing structures, including utility poles, signs, water towers, buildings
and other WCFs where feasible;
4, promote collocation of WCFs before building new WCFs;
5. facilitate the use of public property and structures for WCFs;
6. streamline and expedite existing permitting procedures in accordance with the intent of Engrossed Substitute
House Bi112828, Chapter 323 Washington Laws 1996; and,
7. enhance the ability of providers of telecommunication services to provide such service to the community
quickly, effectively and efficiently.
00.00.030 APPLICIBILITY
Pre-Existing WCFs. WCPs for which a permit has been issued prior to the effective date of this ordinance shall not
be required to meet the requirements of this ordinance as further specified in Section 00.00.090 BELOW.
Exclusion for amateur Radio Facilities. This Ordinance shall not govern the installation of any amateur radio
facility that is owned and operated by a federally licensed amateur radio station operator or is used exclusively for
receive only antennas. (As regulated by the FCC's adoption of a"limited preemption rule" in 1985 which limits
"local government regulation of placement, screening, or height of antennas based on health, safety, or aesthetic
considerations must be crafted to accommodate reasonably amateur communications, and to represent the minimum
practicable regulation to accomplish the local authority's legitimate purpose reasons".)
Relationship to Other Ordinances. This ordinance shall supersede all conflicting requirements of other codes and
ordinances regarding the height and setbacics, as well as locating and permitting of WCFs.

Attached WCFs in any zone are limited in height to 20' from the top of the attachment structure
2 The Antenna Array for an attached WCF is exempt from the setbacic requirements of this section and from the
setbacics for the zone in which they are located, provided, no such Antenna Array shall extend more than 5'
horizontally from the attachment structure.
3 The Antenna Array for an attached WCF is exempt from the screening requirements of this section.
A. Height Standards
1. Attached WCFs
Attached WCFs sha11 not add more than twenty (20) feet in height to the existing building or shucture to which it is
attaclied (Attachment Structure).
2. WCFs With Support Structures
(a) Industrial zone. In anq Industrial zone the maximum haight for a WCF shall be 200 feet.
(b) Open Space/ Recreation zone. In any Open Space/ Recreation zone the maximum height for a WCF
shall be 200 feet.
(c) General, Recreation, and Freeway Commercial zone. In any General, Recreational, or Freeway
Commercial zone, the maximum height for a WCF shall be 100 feet.
(d) Agriculture and Suburban Agriculture zone. In any Agriculture or Suburban Agriculture zone, the
maximum height for a WCF shall be 300 feet.
(e) Residential, Suburban, and Suburban Ag zones, WCFs not permitted in R-1, R-2, and S-1, 2, 3& S-A.
B. Setback Standards
1. Attached WCF
Antenna Array for Attached WCFs are exempt from the setbacic standards of this section and form the setbacics for
the zone in which they are located. An Attached WCF Antenna Array may extend up to five feet horizontally
beyond the edge of the Attachment Structura so long as the Antenna Array does not encroach upon the adjoining
parcel.
2. Equipment Facilities
All Equipment Facilities shall meet the setbacic requirements for building for the undexlying zone in which they are
located.

(a) Industrial zone. In any Industrial zone, a WCF shall be setback a minimum of 40 feet from tha front
and 5 feet from the side and rear lot lines.
(b) Open Space/ Recreation zone. In any Open Space/ Recreation zone a WCF shall be setback a
minimum of 20 feet from all lot lines.
(c) General, Neighborhood, Recreational, Freeway Commercial zone. In any General, Recreational,
Freeway Commercial zone a WCF shall be setbacic a minimum of 40 feet from the front and 10 feet
from the side and rear lot lines,
(d) Agricultural zone. In this zone, the setback shall be 10 feet from the front lot line and 5 feet from the
side and rear lot line.
(e) Residential 1,2 and Suburban 1,2,3 & Suburban Ag zones. In these zones WCFs are not permitted
(f� Where WCFs abut Residential 1&2, Suburban 1,2,3, or Suburban Ag zones, the WCF shall be setback
a multiple of five (5) times the height of the tower,
C. Site Obscuring Fence (Screening)
1. WCFs shall be buffered with a slat type, site obscuring fence that effectively screens the view of the WCF
compound. The planning director or reviewing administrator may waive the site obscuring fence requirements if the
goals of this ordinance would be better served
D. Aesthetics/ Placement, Materials and Colors
1. Attached WCFs
(a) Attached WCFs which are significantly visible to the adjacent residences shall be designed so as to
blend in with the structure to the extent feasible, including placement in a location which is consistent
with proper functioning of the WCF, and the use of compatible or neutral colors.
(b) Attached WCFs which are significantly visible to adjacent residences, which have aesthetic impacts
that are not able to be reasonably mitigated by placement and color solutions, can be required to be
screened in a reasonable and achievable manner.
2. WCFs with Support Structures shall be designed so as to blend in with the existing surroundings to the extent
feasible, including the use of neutral compatible colors.
3. Equipment Facilities shall, to the extent practicable, use materials, neut�al colors and textures that will blend with
the natural setting and built environment.
E. Lighting
WCFs shall not be artificially lighted, except for:
1, security and safety lighting of equipment buildings if such lighting is appropriately downshielded to keep light
within the boundaries of the site; and
2. such lighting of the WCF as may be required by the Federal Aviation Administration (FAA) or other applicable
authority installed in a manner to minimize impacts on adjacent residences,
F. Noise
No equipment shall be operated at a WCF so as to produce noise in excess of the applicable noise standards under
WAC 173-60, except for in emergency situations requiring the use of a backup generator, where the noise standards
inay be exceeded on a temporary basis.
G. Security Fencing
WCFs with Support Structures shall be enclosed by a security fence not less than six feet in height and the Support
S�ructure shall be equipped with an appropriate anti-climbing device; provided, however, that the governing

authority may waive such requirements, as it deems appropriate; however, nothing herein shall prevent security
fencing which is necessary to meet other requirements of state or federal agencies.
H. Radio Frequency Emissions
1. The Federal Telecommunications Act of 1996 (FTA) gives the Federal Coinmunications Commission (FCC) sole
jurisdiction of the field of regulation of Radio Frequency (RF) emissions and WCFs which meet the FCC standards
shall iiot be conditioned or denied on the basis of RF impacts.
I. Structural Integrity
WCFs with Support Structures must be constructed to the most recent Elect�onic Industries Association/
Telecommunications Industries Association (EIA/TIA) 222 Revision r Standard entitled "Structural Standards for
Steel Antenna Towers and Antenna Supporting St�uctures" as it may be updated or amended.

A. General
The applicable Development Standards referred to herein are those set forth in Section 00.00.040 and Table 1
above.
Ii. Attached WCFs are permitted as follows
1. Attached WCFs in zones A, I-H, I-L, O-SR, P-F, C-G, C-N, C-R, and C-FS that meet the Development Standards
are permitted outright. Attached WCFs in zones A, I-H, I-L, OS-R, P-F, C-G, C-N, C-R, and C-FS that exceed the
Development Standards shall be pernutted through a Board of Adjustment Review.
2. Attached WCFs in the Residential 1,2 and Suburban 1,2,3 and Suburban Agriculture zones are not peimitted.
C. WCFs with Support Structares are permitted as follows
1. WCFs with Support Structures in zones A, P-F, I-H, I-L, C-G, C-N, C-R, and C-FS are permitted outright.
WCFs with Support Structures in zones A, P-F, I-H, I-L, C-G, C-N, C-R, and C-FS that exceed the Development
Standards shall be permitted through an Administ�ative Review.
2.WCFs with Support Structures in zones R-1, R-2, S-1, S-2, S-3, and S-A are not permitted,
3. WCFs with Support St�uctures in the O-SR zone are permitted only with a CUP.

D. WCFs that are proposed as part of a residential or commercial subdivision, Planned Unit Development (PUD),
binding site plan, contract rezone, or other coordinated development approval are to be reviewed and approved
through those processes.
E. WCFs on property owned, leased or otherwise controlled by the governing authority of the jurisdiction,
provided that the WCF has been approved by the governing authority, are permitted outright.
F. Temporary WCFs for a terrn not to exceed 90 days, with a possible 90 day extension with approval of the
building official, are permitted outright in zones that allow for WCFs,
00.00.060 APPROVAL PROCEDUI2�S
A. Permitted Oatright
Where a facility is permitted oui�ight a technically complete and approved building permit is required. This
includes but is not limited to a site plan, Local Project Review, Grant County Resource and Critical Areas Review,
SEPA review, engineer stamped drawings, construction calculations, and FAA letters.
B. Administrative Review
1. Review of WCFs under this Section will be conducted by the Administ�ative Official upon application for a
building permit for the WCF.
2. Application Contents. Each applicant requesting a permit sha11 submit a scaled plan and a scaled elevation view
and other supporting drawings, calculations and other documentation showing the location and dimensions of the
WCF and all improvements associated therewith, including information concerning Support Structures
specifications, antenna locations, Equipment Facilities, landscaping and fencing, and if relevant to its consideration
of whether the application meets all Development Standards.
3, Review Criteria. The Administrative Official shall apply the Development Standards, provided that the applicable
Development Standards requirements may be reduced or waived by the Board of Adjustment so long as the approval
of the WCF meets the purpose and goals of this ordinance in Section 00.00.020.
4. Appeals. The applicant may appeal a denial in accordance with the provisions of the G1ant County Local Project
Review Ordinance.
C. Conditional Use Permits (CUP)
1. Approval Body. The body that shall review and approve conditional use permits shall be the Board of Adjustment
and shall hereinafter be referred to as the "Approval Body".
2. Application Contents. Each applicant requesting a conditional use permit under this ordinance shall submit a
scaled plan and a scaled elevation view and other supporting drawings, calculations and other documentation
showing the location and dimension of the WCF and all associated improvements therewithin, including information
concerning tower specifications, antenna locations, equipment shelters, landscaping and fencing and if relevant,
topography, adjacent uses and existing vegetation.
3. Notice. Notice of the application and the public hearing by the Approval Body shall be given in accordance with
the procedures under local project review of applications and hearings before the Approval Body.
4. Hearing, The Approval Body shall review and approve the application for a Conditional Use Permit at the
conclusion of an open record public hearing in accordance with procedures specified by Grant County.
5, Conditional Use Criteria
(a) Development Standards. Every application for a Conditional use permit shall be reviewed for compliance with
the Development Standards set forth in Section 00.00.040 above; provided that the applicable Development

Standards may be reduced or waived so long as the approval of the WCF meets the goals and purpose of Section
00,00.020 herein. Additional Development Standards may be required as provided in subsection S.b below.
(b) CUP Conditions. The Approval Body may impose conditions in addition to the Development Standards if all of
the following criteria have been met:
(1) The WCF would result in probable significant adverse visual impacts on nearby residences as
determined by the approval body.
(2) The conditions are based upon the purpose and goals of this ordinance as set forth in Section 00.00.020
and other adopted policies or regulations of the jurisdiction.
(3) The conditions are reasonable and capable of being accomplished.
6. Findings. All decisions rendered by the Approval Body under a Conditional Use Permit shall be supported by
findings of fact and conclusions of law based upon substantial evidence in the record.
7. Timing of Decision. The Approval Body shall render its decision within 120 days of a technically complete
application, unless the Approval Body can demonstrate that more time is required or the time extension is agreed to
by the applicant.
8. Appeals. The decision of the Approval Body may be appealed to the governing body of Grant County as outlined
in the Project Review Ordinance.
00.00.070 SHAI2ED FACILITIES AND COLLOCATION POLICY; FACILITATING LOCATION
PUBLIC PROPERTY
A. FCC Licensed Wireless Communications providers are encouraged to construct and site their WCFs with a view
towards sharing facilities with other utilities, to collocation with other existing WCFs and to accommodating the
future collocation of other future WCFs, where technically, practically, and economically feasible.
B. Grant County will work with telecommunications providers to facilitate the siting of WCFs on publicity owned
property, by identifying existing facilities, the appropriate contact persons, and the appropriate procedures.
C. Wireless Communications providers must prove by use of geographic search area maps that collocation is not
possible to achieve the same coverage area being proposed befora a new tower may be const��ucted, This is to
further enhance the promotion of collocation among the various Wireless Communication providers.
D. FCC Licensed Wireless Communication providers proposing a new WCF with Support Structure shall
demonstrate that it made a reasonable attempt to find a collocation site acceptable to engineering standards and that
none was practically or economically feasible. Grant County shall defer to the proponent's judgement regarding
whether collocation is feasible or not.
00.00.080 REMOVAL OF ABANDONED WCFs
Any WCF that is not operated for a continuous period of twelve (12) months sha11 be considered abandoned, and the
owner of such a WCF shall remove same within ninety (90) days of notice to the governing authority that the WCF
is abandoned. If such WCF is not removed within said ninety (90) days, the governing authority may remove such
WCF at the owners sole expense. The permit shall be reviewed one year after the date of issuance to make sure the
permitted use is sti11 the actual use of the land (i.e. to make sure the WCF is still an active tower). If there are two or
more users of a single WCF, thea this provision shall not become effective until all users cease using the WCF.
00.00.090 NONCONFORMING WCFs
WCFs in existence on the date of the adoption of the ordinance, which do not comply with the requirements of this
ordinance (non-conforming WCFs) are subject to the following provisions.
A,Nonconforming WCFs may continue in use for the purpose now used, but may not be expanded without
complying with this ordinance, except as further provided in this Section 00.00.090.

B. Nonconforming WCFs may add additional antetuias (belonging to the same carrier or other carriers) subject to
administrative review pursuant to Section 00.00.060(B) of this ordinance,
C. Nonconforming WCFs which are hereafter damaged or destroyed due to any reason or cause may be repaited and
restored to their former use, location and physical dimensions subject to obtaining a building permit therefore, but
without otherwise complying with this ordinance.
D. The owner of any Nonconforming WCF inay replace, repair, rebuild and/or expand such WCF in order to
improve the structural integrity of the facility, to allow the facility to accommodate collocated antennas or facilities,
or to upgrade the facilities to current engineering, technological or communication standards, without having to
confonn to the provisions of this ordinance, so long as such facilities are not increased in height by more than 10%
and/or setbacks are not decreased by more than 10%.
00.00.100 MODIFICAIONS TO EXISTING FACILITIES OR PRE-EXISTING FACILITIES
WHICH MEET THE REQUIREMENTS OF THIS ORDINANCE
A. Minor Modifications. Minor modifications to WCFs permitted under this ordinance sha11 be approved under an
Administrative Review. Minoz modifications are as follows: the addition of no more than two Antenna Arrays to
any existing WCF, so long as the addition of the Antenna Arrays add no more than 20 feet in height to the WCF; an
increase ira height of the Support Structure which is no greater than 10%, and a decrease in setbacics by no more than
10%. Collocation of up to one Antenna Array shall be considered a minor modification.
B. Major modifications. Major modifications to WCFs permitted under this ordinance shall be approved under a
Hearing Body Review. Major modifications are any modifications that exceed the definition of minor
modifications.
00.00.110 SEVEI2ABILITY
If any provision of this ordinance, or its application to any person or circumstances is held invalid, the remainder of
the ordinance or the application of the provisions to other persons or circumstances, shall not be affected.

An ordinance establishing regulations governing t�ie siting of wireless
control towers, antennas, related apparatus and structures, for wireless
communications systems, and other matters properly relating thereto has
been adopted by the Grant County Commissioners. The fiill text of the
ordinance will be mailed, without charge to any person upon request.
