HomeMy WebLinkAboutResolution 00-125-CC BOARD OF COUNTY COMMISSIONERS ., GRANT COUNTY,WASHINGTON IN RE THE MATTER OF: RESOLUTION: 2000-125-CC APPLICATION FOR ZON�CHANGE NOTICE OF DECISION: FROM HEAVY INDUSTRIAL TO FINDINGS OF FACT, CONCLUSIONS,AND GENERAL COMMERCIAL FINAL DECISION OF THE GRANT COUNTY BOARD OF COUNTY COM.MISSIONERS APPLICANT: Randal and Cindy Niessner Recitals: WHEREAS,the applicants have petitioned Grant County to change the zoning of a 2.2 acre portion of a 10.9 acre parcel from Heavy Industrial to General Commercial. WHEREAS,at their regularly scheduled open record public hearing,the Grant County Planning Commission heard a request by Randal Niessner to rezone approximately 2.2 acres of a 10.9 acre parcel from Heavy Industrial to General Commercial, and; WHEREAS,the Grant County Planning Commission made a recommendation to the Grant County Board of County Commissioners to deny the proposed zone change request, and; WHEREAS,the Grant County Board of County Commissioners conducted a closed record public meeting on August 29,2000 to discuss the proposed zone change. WHEREAS,the Grant County Board of County Commissioners set this zone change request for a closed record public hearing to take place on October 2,2000 WHEREAS,the Grant County Board of County Commissioners have inade a decision to deny the rezone request from Heavy Industrial to General Commercial, and; NOW,THEREFORE,BE IT RESOLVED,that the Grant County Board of County Conunissioners do, by this resolution, deny the zone change request from Heavy Industrial to General Commercial affecting 2.2 acres of parcel number 16-0101-001, located in a portion of Section 8, Township 16 North,Range 26 East, Willamette Meridian, Grant County, Washington. I. FINDINGS OF FACT The Grant County Board of County Commissioners adopted the following Findings of Fact for the Randal Niessner Zone Change. 1. The proposal is not within a Critical Area as de�ned by the Grant County Resource Lands and Critical Areas Development Ordinance. 2. The proposal is not consistent with the 1977 Grant County Comprehensive Plan and surrounding land uses. Resohttion# 2000-125-CC Page 2 of 2 3. The proponent has not presented sufficient evidence that changed circumstances in the area of the subject property warrant a rezone of the property. 4. The proponent has not presented sufficient evidence that the rezone would substantially beneFit the safety,health, and welfare of the affected coimnunity. 5. A Determination of Non Significance was issued for this proposal on Apri121, 1999 and the requirements of SEPA have been met. 6. The SEPA appeal period expired on May 20, 1999 and no SEPA appeals were received. The Grant County Board of County Commissioners having made forgoing Findings of Fact, NOW, TI�+REFOItE, makes the following: II. CONCLUSIONS 1. The proposal is not consistent with the 1977 Grant County Comprehensive Plan and surrounding land uses. 2. The proponent has not presented sufficient evidence that ehanged circumstances in the area of the subject property warrant a rezone of the property. 3. The proponent has not presented sufficient evidence that the rezone would substantially benefit the safety, health, and welfare of the affected commmiity. The Grant County Board of County Commissioners by making the forgoing Findings of Fact and Conclusions, after considering the closed record, applicable County and State laws,the Determination of Non-Significance, and supporting environmental documents, NOW, THEREFORE,malce the following: , III. DECISION The application by Randal and Cindy Niessner for a rezone from Heavy Industrial to General Commercial is denied by a vote of the majority. DATED this�_day of October, 2000.
