RESOLUTION N0.2oo0-123-CC RESOLUTION APPROVING A PLAT ALTERATION Ronald Garrison WHEREAS, the Board of County Commissioners of Grant County have been advised by the Grant County Planning Commission that an open record public hearing was conducted on September 6, 2000, on the matter of creating two lots from one five (5) acre lot in a portion of Farm Unit 153, Blocic 71, located in Section 2, Township 19 North, Range 25 East, Willamette Meridian, Grant County, Washington. The applicant has requested that the two lots be created to remedy the two homes that exist on one lot. This plat alteration would create one home per parcel; WHEREAS, the Grant County Planning Commission on September 6, 2000 made a recommendation to the Board of County Commissioners to approve this proposed plat alteration, with the 11 conditions of approval; WHEREAS, a SEPA Determination of Non-Significance was issued on July 31, 2000; WHEREAS, the Grant County Board of Commissioners held a closed record public meeting on September 26, 2000; WH�REAS, the Board of County Commissioners have made a decision to uphold the recommendation to approve the proposed plat alteration request; WHEREAS, the Board of County Commissioners have found that the proposal is consistent with the Grant County Comprehensive Plan; WHEREAS, the Board of County Commissioners have found that the public use and interest will apparently be served by the plat alteration; WHEREAS, the Board of County Commissioners have found that the proposal will not adversely effect the health, safety, and general welfare of the public in the vicinity of the proposal; Page 2 of 4 IN TH� MATTER OF CREATING TWO Ronald Garrison LOTS FROM A FIVE (5) ACRE PORTION OF FARM L1NIT 153, BLOCK 71 NOW, THERFORE, BE IT RESOLVED, that the Board of County Commissioners for Grant County, Washington approve by this Resolution, a plat alteration to create two lots from one five (5) acre parcel located in Farm Unit 153, Blocic 71, which is located in a portion of Section 2, Township 19 North, Range 25 East, Willamette Meridian, Grant County, Washington. CONDITIONS: 1) Development shall be in compliance with the Growth Management Act, The County-Wide Planning Policies, The Washington State Environmental Policy Act, the Grant County Comprehensive Plan, the Grant County Zoning Ordinance, and all applicable local, state, and federal regulations, rulings or requirements. 2) Development shall comply with all applicable requirements of the Grant County Fire Flow guidelines and the Uniform Building Code and Uniform Fire Code. 3) Development shall comply with all improvements required by the Grant County Public Works Department including, but not limited to: a. Provide Re-Plat check fee of $100.00 b. Con�orm to Basic Plat Requirements. c. Show all easements for existing roads. d. Show location of existing road approaches. Approach locations must meet County sight distance requirements. 4) Developer shall comply with all requirements deemed necessary by the Grant County Health District, the Washington State Department of Health, and the Washington State Department of Ecology regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to: RCW 90.48.080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201A, Ground Water Quality Standards and WAC 246-272, On-Site Sewage Systems. Also including, but not limited to: a. If tha lots share the same well, the owners will need an agreement regarding use and maintenance of it. b. A protective easement will be needed if there are areas outside the 100ft. radius around the well which are outside the property line. � Page 3 of A� IN THE MATTER OF CREATING TWO LOTS Ronald Garrison FROM A FIVE (5) ACR� PARCEL IN FARM LTNIT 153, BLOCK 71 5) If any Native American Grave site(s) or archeological/cultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall immediately notify the Colville Confederate Tribes and the Washington State Office of Archeology and Historic Preservation. 6) Proposal shall comply with all requirements of the United States Department of Interior, Bureau of Reclamation and the Quincy Columbia Basin Irrigation District including, but not limited to: a. The complete farm unit must be shown on the plat. b. All lots within the farm unit are to be given a useable irrigation right- of-way to the legal point of water delivery and all irrigable acres proposed for roads must be included in the adjoining lots in an aquitable manner. If access to the turnout cannot be obtained, the water must be released before the plat is signed. c. Useable legal access to all lots must be included in the plat. Federal irrigation right-of-ways are not legal access and do not fulfill this requirement. d. All federal right-of-ways need to be shown on the plat. 7) Use shall not have adverse impact on existing agriculture operations. 8) Approval of the plat alteration shall be contingent upon conformances with all applicable land use rules and regulations in effect as of June 30, 2000. 9) The Re-Plat shall be surveyed by; or under the supervision of a registered land surveyor of the state. 10) The preparation of the final Re-Plat shall be certified on the Re-Plat by said registered land surveyor that it is a true and correct presentation of the lands actually surveyed. 11) Proposal shall comply with all requirements of the Grant County Emergency Services including, but not limited to: a.
