ORDINANCE REPEALING AND ORDINANCE No. 16- ���� -CC
� REPLACING CHAPTER 6.04 OF THE
GRANT COUNTY CODE RE:
REGULATION OF FIREWORKS
W�IEREAS,the Board of County Commissioners has provided, in Chapter 6.04 of the Grant
County Code for the regulation of the sale and discharge of Fireworlcs; and
WHEREAS,RCW 70.77 and WAC 212-17 constitute the state Fireworks laws and authorize
counties to adopt regulations to promote public health, safety, and the general welfare; and
WHEREAS,there is no provision for the sale or discharge of Fireworks due to extreme�re
conditions; and
WHEREAS,the Board of County Commissioners desires to update the provisions of Chapter
6.04 and provide for the emergency prohibition of the sale and/or discharge of Fireworks.
NOW,THEREFORE,BE IT ORDAINED: That Chapter 6.04 of the Grant County Code be
repealed in its entirety and be replaced with the following:
Chapter 6.04—FIREWORKS
6.04.010—Definitions.
6.04.020—Fireworks permitting authority.
6.04.030—Emergency ban of Fireworks
6.OA.040—Violation-Penalty
Sections:
6.04.10—Definitions.
For the purposes of this section`Bxtreme Fire Danger"shall be dafined as periods of hot, dry weather
accompanied by low fuel moistures and or diminished firefighting resources as determined by the Fire
Marshal.
6.04.020—Fireworks permitting authority.
Pursuant to RCW 70.77.260
1. The Board of County Commissioners, (BOCC), of Grant County does hereby appoint the rire
Marshal of Grant County or their designee as the designated of�cer for the unincorporated areas
of the County and in those jurisdictions who are contracted with the County to receive
applications for Firework permits to insure compliance with state and local code for the approval
and issuance of a perinit.

; 2, The Grant County Fire Marshal shall develop policies and procedures' for the sale and discharge
of Fireworks with-in the County.
6.04.030 -Emergency Ban of Fireworks,
, 1. The Grant County Fire Marshal may recommend to the BOCC a prohibitioii on the sale and or
discharge of Fireworks due to`Bxtreme Fire Danger".
' 2. The BOCC will determine and issue the ban to prohibit the sale and or discharge of Fireworlcs.
6.04.040—Violation—Penalty
Discharge of Fireworlcs during periods of declared`Bxtreme Fire Danger"is a misdemeanor and any
person violating this ordinance shall,upon conviction,be fined up to one thousand dollars or be
' imprisoned for up to ninety days, or be subject to both such fine and imprisoninent.
A PUBLIC HEARING WAS HELD ON THE ABOVE ORDINANCE AT 4:00 P.M. ON THE 29T�I
