HomeMy WebLinkAboutResolution 16-026-CC i , BOARD OF COUNTY COMMISSIONERS � Grant County,Washington G� I RESOLUTION WITH C�RTIFICATIONS OI+ RESOLUTION No. 16-��-CC COMPLIANCE FOR CDBG PUBLIC SERVICES G12ANT AND GENERAL PURPOSE GRANT WHEREAS, Grant County is authorized to apply to the State Department of Commerce for ' funding assistance on a CDBG Public Services Grant and as well as a CDBG General Purpose Grant; and , WHEItEAS, Grant County h1s identified one or more community development and housing priority needs for which to seelc CDBG funding; and WIIEREAS, it is necessary that certain conditions be met as part of the application requirements , to receive CDBG funds; and ' WHEREAS, Cindy Carter, Chair of the Grant County Board of County Commissioners (`BOCC)"is authorized to submit this/these applications to the State of Washington on behalf of Grant County. NOW, THEREFORE,be it resolved that Grant County authorizes submission o£ (1) a CDBG Public Services Grant to request One Hundred Twenty-Five Thousand Eighty and No/100 Dollars ($125,080.00)to fund public services activities in coordination with the Opportunities Industrialization Center of Washington(OIC); and(2) a CDBG General Purpose Grant in an amount up to One Million and No/100 Dollars ($1,000,000.00) for public infrastructure, community facilities, affordable housing, or economic development; and(3) any amended amounts for one or both grants, and certifias that,if funded it: • Will comply with applicable provisions of Title I of the Housing and Coinmunity Development Act of 1974, as amended, and other applicable state and federal laws; and • Has provided and will provide opportunities for citizen participation that satisfy the CDBG requirements of 24 CFR 570.486; and • Will not use assessments against properties owned and occupied by low- and moderate-income persons or charge user fees to recover the capital costs of CDBG-funded public improvements from low-and moderate-income owner-occupants; and • Has established or will establish a plan to minimize clisplacement as a result of activities assistecl with CDBG funds; and assist persons actually displaced as a result of such activities, as provided in the Uniform Relocation Assistance and Real Property Acqttisition Policies Act of 1970, as amended; and • Has provided technical assist�tnce to citizens and groups representative of low-and moderate- ', income persons that reqwest assistance in developing proposals; and • Will provide opportunities for citizens to review and comment on proposed changes in the funded proj ect and program performance; and ASC Files Page 1 of 2 ; • Will conduct 1nd administer its program in conform�nce with Title VI of the Civil Rights Act of 1964 and the Fair Housing Act, will af�rmatively further fair housing(Title VIII of the Civil ' Rights Act of 1968); and • Has adopted(or will�dopt) and enforce a policy prohibiting the use of excessive force by law , enforcement agencies within its jurisdiction against any individuals engaged in nonviolent civil rights demonstrations; and has adopted(or will adopt)and implement a policy to enforce existing applicable state 1nd local laws against physically barring entrance to or exit from a facility or location which is the subject of such nonviolent civil rights demonstration within its jurisdiction, in accordance with Section 104(1) of the Title I of the Housing and Community Development Act or 1974, as amended; and • Certifies to meeting the National Envirorunental Policy Act(NEPA)through a determination the CDBG-funded public services will not have a physical impact or result in any physical changes and are exempt under 24 CFR 58.34(a), and are not applicable to the other requirements under 24 CFR 58.6; and are categorically exempt under the State Environmental Policy Act(SEPA)per ' WAC 197-11-305 (2); and • Certifies that, should a CDBG General Purpose Grant be funded, all National Environmental '. Policy Act (NEPA) and Stata Environmental Policy Act(SEPA)requirements, as set forth in the CDBG Construction Handbook applicable to the project and all applicable environmental state and fecleral laws, will be adhered to; and • Con�rms the Opportunities Industrialization Center of Washington is not on the federallist of declined or suspended contractors. Grant County designates Corrunissioner Cindy Carter as the authorized Chief Administrative Official and authorized representative to act in all official matters in connection with this/these application(s) and Grant County's participation in the Washington State CDBG program.
