RESOLUTION:
1N THE MATTER OF APPROVING A
PRELIMINARY SUBDIVISION OF AN 18.7-
-ACRE PARCEL INTO TEN (10) LOTS
LOCATED 1N A PORTION OF THE EAST
HALF OF THE SOUTHEAST QUARTER OF
SECTION 27, TOWNSHIl' 25 NORTH, RANGE
28 EAST, W.M., COUNTY, WA

A SUBDIVISION OF AN
18.7-ACRE PARCEL

WHEREAS, the Grant County Board of County Commissioners have bean
advised that an open record public hearing was conducted, before the Grant County Planning
Commission on September 5, 2007 in the matter of a preliminary plat of a 18.7-acre parcel
located in a portion of the east half of the southeast quarter of Section 27, Township 25 North,
Range 28 �ast, Willamette Meridian, Grant County, W�shington; and,
WHEREAS, the Grant County Planning Cominission on September 5, 2007
recommended to the Board of County Commissioners to approve this proposed prelirninary plat
with the eleven (11) conditions of approval and twelve (12) �ndings of fact in the affirmative;
and,
WHEREAS, the Grant County Board of Commissioners held a closed record
public hearing on October 30, 2007; and,
WHEREAS, the Board of County Commissioners, have reviewed the application
material, staff report and a summary of the Planning Commission hearing; and,
WHEREAS, the Board oi County Commissioners have found that the proposal
will not adversely affect the health, safety, and general welfare of the public in the vicinity of the
proposal; and,
WHEREAS, the Board of County Commissioners have found that the proposal is
consistent with the Grant County Comprehensive Plan, the Unified Development Code, Chapter
23.04 "Zoning", other land use regulations, and SEPA; and,
WHEREAS, the Board of County Commissioners have found that the public use
and interest will apparently be served by the plat; and,
WHEREAS, the proposed plat, subj ect to the conditions of approval, meets the
applicable requirements of Unified Development Code, Chapter 22.04 "Land Division"; and,

WHEREAS, the proposed preliminary plat alteration does comply witih the
Health District's requirements for sewage disposal and potable water supply; and,
WHEREAS, the proposed prelilninary plat alteration does contain an accurate
legal description of the lots being created, and the roads and easements therein; and,
WHEREAS, the proposed preliminary plat alteration does comply with Grant
County regulations pertaining to roads, utilities, drainage, access for emergency vehicles, and
other infrastructure iinprovements; and,
WHEREAS, the Board of County Commissioners has inade a decision to
approve the preliininary plat of the Isaak Major Plat.
NOW, THEREFORE, BE IT RESOLVED, that the Board of County
Commissioners for Grant County, Washington approve by this Resolution, with elaven (11)
conditions of approval listed below, a preliminary plat of an 18.7-acre parcel located in a portion
of the east half o� the southeast quarter of the Section 27, Township 25 North, Range 28 East,
Willamette Meridian, Grant County, Washington. Parcel #17-1575-000.
CONDITIONS OF APPROVAL:
1) Development shall be in compliance with tha Washington State Envirorunental Policy Act,
the Grant County Comprehensive Plan, the Grant County Unified Development Code, and all
applicable local, state, and federal regulations, rulings or requirements.
2) Proposal shall coinply with all requireinents deemed necessary by the Grant County Health
District, by the Washington State Department of Health, and the Washington State
Department of Ecology regarding doinestic water supply, sewage systeins and storm water
control and treatment including, but not limited to; RCW 90.48.080 Discharge of Polluting
Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201A, Ground Water
Quality Standards; and, WAC 246-272, On-Site Sewage Systems.
3) If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts)
are found a11 construction activity shall stop and the owner/developer shall iminediately
notify the Grant County Planning Department, the Colville Confederated Tribes and the
Washington State Of�ce of Archaeology and Historic Preservation.
4) Approval of the plat shall be contingent upon conformance with all applicable land use rules
and regulations in effect as of July 20, 2007.
5) During road grading and/or construction activities, county roads shall be inaintained clear of
soil and rocks at the point of ingress / egress.
6) This proposal shall comply with the requirements of GCC 23.12.080 Clearing, Grading and
Drainage Standards, including but not limited to:
a) Clearing and grading activities shall be conducted so as to minimize potential adverse
effects on offsite property.

b) All development shall ensure that soil erosion and sedimentation of drainage-ways will
be controlled to prevent damage to adjoining properties.
c) Surface drainage shall not be directed to or discharged onto County Roads or ditches
within County right-of-ways unless approved by the County Engineer.
7) This proposal shall comply with the requirements of GCC 23.12.100 Road Standards,
including but not limited to:
a) Address will need to be posted as each lot is developed.
8) Development shall coinply with the requirements of the Health District including, but not
limited to:
a) A site registration will be required for each lot before the plat can receive final approval.
Contact the Health District for information.
9) Development shall comply with all requirements of the Grant County Public Works,
including but not limited to:
a) Provide a plat review fee of $200.00.
b) Provide a plat cei-tificate from the title company for all land being dedicated to Grant
County.
c) An approach permit must be obtained for each lot prior to the issuance of a building
permit.
d) A hatclled/shaded area shall be added to the southeast corner of Lot 5 and shall extend for
100' in both directions from the intersection. This area shall be labeled "No Access".
e) The 15' common driveway easements do not seem to be distinguished as true easements.
The 15' appears to simply be the area of the lots left over after the habitat protection zone
is taken out of each lot. If the driveway areas are in fact intended to be true easements,
the applicant should put some sort of box with hatching around those areas to clearly
depict the intention of the easement so that future use of those areas by both future lot
owners is clearly defined. If an actual easement is not what is intended then the area
should be relabeled as "Common Driveway Area" and lots 1 and 2 shall share one
common access location centered on the common lot line intersection with the county
road right-of-way. The saine shall apply to lots 3 and 4, and lots 5 and 6.
10) Development sha11 coinply with all requirements of the Second Wildlife Habitat Survey,
including but not limited to:
a) Houses should be placed as far east and south as possible allowing for topography. This
will ensure a contiguous patch of shrub steppe habitat on the western boundary adjacent
to state land.
b) Driveways can be shared between lots 1& 2, 3& 4, and 5& 6 to reduce disturbance and
loss of habitat.
c) Septic and well systems should be placed to the east of the building site for lots 1-6.
d) In coordination with Jarnes G. Hallett, Ph.D. and Eric Pentico/WDFW/ and before iinal
plat approval is given the proponent shall establish tha covenant to mitigate the loss of
steppe habitat. The covenant shall be recorded with the GC Auditor, referenced in full on
the final plat and shall address the following:
i) Control invasive weeds.

ii) Replant native vegetation.
iii) Gophar control.
iv) Pets. Particularly, pets sha11 not be allowed to roam freely in the designated sagebrush
habitat area.
11) Development shall comply with all requirements of the Grant County Planning Department,
including but not limited to:
a) Comply with all requireinents listed in UDC Chapter 22.04 Article V Final Subdivisions
and Short Subdivisions.
b) Comply with all requirements listed in the SEPA Mitigated Datermination of Non-
Significance issued by Grant County on July 20, 2007.
c) The proposal is subject to the GCC 22.04.260 Tiine Limitations.

FINDINGS OF FACT
The Board of County Commissioners may want to consider the following iindings of fact in
making its decision to approve, approve with modifications, remand or deny the proposed
plat alteration application.
(1) The proposed subdivision does / does not ineet the applicable requirements of UDC
Chapter 22.04 "Subdivisions and Plats";
(2) The proposed subdivision does / does not serve the public use and interest;
(3) The proposed subdivision does / does not comply with the Comprehensive Plan, the
Shoreline Master Program, the zoning code and other land use regulations, and
SEPA;
(4) The proposed subdivision does / does not comply with health requireinents for
sewage disposal and potable water supply;
(5) The proposed subdivision does / does not contain an accurate legal description of the
lots being created, and the roads and easements therein;
(6) The proposed subdivision does / does not comply with Grant County regulations
pertaining to roads, utilities, drainage, access for emergency vehicles, and other
infrastructure improvements;
(7) The best available science has / has not been considered in the final decision
regarding the preliminary plat.
(8) The proposed subdivision does / does not coinply with requirements of the U.S.
Department of Interior.
(9) The phasing plan does / does not include all land within the preliminary subdivision.
(10) Each phase is / is not an independent planning unit with safe and convenient
circulation and with facilities and utilities coordinated with the requirements
established for the entire subdivision; and,
(11) All road improvement requirements are / are not ensured pursuant to GCC §
22.04.450.
(12) The proposed subdivision does / does not appropriately identify and protect critical
areas pursuant to GCC § 24.08.
