1N THE MATTER OF ADOPTING A
POLICY FOR CERTAIN COUNTY ROAD
IMPROVEMENTS WHEN ACCEPTING
CONTRIBUTIONS FROM THE PUBLIC
AND REPEALING RESOLUTION 77-39-CC

WHEREAS, the County Road Engineer has requested a new policy be established to provide
direction concerning the matter of paving existing gravel county roads as may be requested by the
public, and
WHEREAS, Chapter 36.75.050 RCW provides that the powers and duties vested in or
imposed upon the Board of County Commissioners with respect to establishing, examining,
surveying, constn,tcting, �ltering, repairing, improving, and maintaining county roads, shall be
exercised under the supervision and direction of the County Road Engineer, and
WHEREAS, the Board of County Commissioners shall by resolution, and not otherwise,
order the survey, establishment, construction, alteration, or improvement of county roads; the County
l�oad Engineer shall prepare all necessarymaps, plans, and specifications therefor, showing the right
of way widths, the alignments, gradients, and standards of construction, and
WHEREAS, the Board of County Commissioners finds that it is necessary to establish a new
policy regarding the improvement of county roads when accepting contributions of money from the
public desiring to improve said roadways from a gravel surface to a bituminous surface.
NOW, THEREFORE, BE IT RESOLVED, the Board of County Commissioners directs the
County Road Engineer to take all actions appropriate to examine, report, and establish County Road
Projects using the following criteria:
1. Petitions from the public asking for an existing county gravel roadway be improved with a
bituminous surface mt�st be submitted in writing and the petition must show the name of the
ro�d and the termini of the requested improvement. The County Road Engineer will assist
the public interested in submitting such petitions.
2. The County Road Engineer shall examine the petition and respond to the petitioner with an
estimate of cost to be borne by the petitioner. Approval of the petition may be withheld if
one of the following conditions exists:
a. The existing right-of-way is less than sixty feet or otherwise insufficient.
b. The petitioners project termini results in work that is less than one-half mile in
length, EXCEPT when the entire gravel roadway length is less than one-half mile.
c. The petitioner's gravel roadway does not begin or end at an existing paved county
roadway or paved city street.

d. The owners of irrigation delivery systems along the proposed improvement are
unwilling to modify their operations to prevent water from entering county rights-of-
way.
e, The cost oFpreparing the existing gravel road to meet current geometric standards
will consume the entire year's budget allocated for the cost share program.
£ The roadway is part of a proposed l�nd developinent or mitigation requirement.
g. The petitioner is �, city, town, port district, ii-�igation district, state or federal agency,
or other junior taxing district.
h. The county road district cannot schedule the worlc due to other commitments, time
constraints, or equipment failure.
i. The petitioner does not contribute the entire amount estimated to complete the work.
j. The petitioner's contribution is listed in order of receipt on a first-come first-served
basis and that project will exceed the budget for the year.
k. The Board of County Commissioners does not approve the resolution establishing
a county road proj ect.
3. The costs to be included in the engineer's response shall include the price of the liquid
asphalt, including sales taxes and freight, and the cost oF the coverstone, not including
transport, for both the prime coat and the tack coat.
4. The worlc shall be cornpleted after May 15 and before September 1 of each year.
5. Petitioner's projects are not carried over from year to year due to the volatility of the price
of asphalt or weather related problems.
6. A petitioner's project that may have been approved may also be cancelled by the County
Fc�ad Erigiri�er x`��r any re�son and all monies collected from the petitioner shall be returned
promptly.
7. If a petitioner decides to withdraw an approved project before it is constructed the County
Road Engineer shall return all monies collected from the petitioner in a timely fashion.
8. The county road budget normally sets a limit of $200,000 per year for this pxogram, and the
budget may be adjusted from time to time as necessaiy.
