GRANT COUNTY, WASHINGTON
ORDINANCE: 06 a�%S-CC
An Ordinance relating to the amendment of the Unified Development
Code §23.04.800(m) regarding duration of approval for Planned Unit
Developments.
Recitals:
WHEREAS, the Board of County Commissioners of Grant County intends to comply
fully with the laws and regulations of the State of Washington, and;
WHEREAS, the Board of County Commissioners of Grant County adopted a Growth
Management Act compliant Comprehensive Land Use Plan in September of 1999, and;
WHEREAS, the Board of County Comrnissioners of Grant County adopted a Uni�ed
Development Code implementing the Comprehensive Plan on October 1, 2000, and;
WHEREAS, the Unified Development Code Chapter 25.12 "Legislative Action"
provides a process for amending the Code, and;
WHEREAS, the Grant Count Planning Department initiated an amendment, under
Chapter 25.12 to the Unified Development Code by amending Chapter 23.04.800 (m) Duration of
Approval, and;
WHEREAS, the Board of County Commissioners of Grant County have been advised by
the Grant County Planning Commission that an open record public hearing was conducted on
Apri15, 2006 and May 3, 2006, on the matter of amending the Grant County Unified
Development Code, and;
WHEREAS, on May 3, 2006 the Grant County Planning Commission voted
unanimously to recommend to the Board of County Commissioners, approval of the UDC
Amendment request, and;
WHEREAS, the Board of County Commissioners of Grant County held an open record
public hearing on June 13, 2006 and October 23, 2006, and;
WHEREAS, the Board of County Commissioners have been advised by the Grant
County Planning Department that the proposed UDC Amendment was processed in accordance
with the requirements of UDC Chapter 25.12 "Legislative Action"; and,
WHEREAS, the Board of County Commissioners have been advised by the Grant
County Planning Department that the proposed UDC Amendment was processed in accordanee
with the requirements of UDC Chapter 24.04 "State Environmental Policy Act"; and,

WHEREAS, the Baard of County Commissioners have found that the proposal is
consistent with the Grant County Comprehensive Plan; and,
WHEREAS, the Board of County Commissioners has found that, this UDC Amendment
will serve the public use and interest.
NOW, THEREFORE, the Board of County Cornmissioners of Grant County does
hereby ordain amending as outlined in Attachment 1 tlie Grant County Uni�ed Development
Code § 23,04,800 (m}.
BE IT FURTHER 4RDAINED, the effective date of this ardinance sha11 be 5 p.m. of
the date of signature.

(m) Duration of Approval: Consistent with GCC 22.04�.260 �a PUD shall be effective lor
f"ive (5) years li•om tl�e date of approval by the Decision Malcer. A PUD shall expire
and become void after the �"ive (5) year period if: a) A fiYial PUD has not been
recorded for a projecti that includes land division; or b) A buildin� permit has not
been issued or i€�if substantial construction activity or substantial operation has not

or authorized repr•esentative submits a written request a rninimum of thirty (30�ys

conditions of approval and prepare and record the PUD. In addition to the
administrative extension above and GCC 22.04.260, PUDs may in additioil be
�ranted a maxirnum of two (2) additional two (2) vear extensions by the Board of
County Cornmissioners in an open record �ublic hearin��rovided the followin�
findin�s are made: 1) The landowner or authorized representative has established
aod reasons for the extension; and, 2) Projects includin� subdi

construction or operational activities• and 3) The proposal is found to be
substantially in compliance with all re�ulations and requirements of the Unified
Development Code and Comprehensive Plan policies and �oals at the time of
extension• and 4) The extension is found to be in the public's best interest and will

approval may be modified from the above parameters pursuant to GCC 25.28,
Development A�reements. Knowledge of expiration date and initiation of a petition
for extension shall be the responsibility of the applicant. The County will not provide
notification prior to expiration.
