Item 2 did not arrive for signature. The motion passed with 2 Commissioners in attendance. 1. Possible vouchers for Znterfund Communications, insurance, and/or grant administration. (Approved) 2. Anticipating: Professional Services Agreement for Legal Representation of Indigent Individuals in Grant County Superior Court (Adult Felony Only), Hourly/Part Time Contractor, between Grant County and Stephen R. Hormel. Terrn is through case assignment completion on specified Class A felony matters. (Did not arrive for signature) 3. BOCC Chair signature on Terrorism Losses (Rejection) insurance form and Storage TankApplication insurance form (renewal). (Approved) 4. Working Agreement between Grant County and Grant County Public Employees' Association, Public Works, January i, 2oi2 to December gi, 2014. (Approved) 5. Legal Services Agreement between Grant County and Ries Law Firm as special counsel in the matter of Andres Negrete Appeal of Notice to Correct Grant County Code Violations on Parcel Nos. 15004400o and 150054002. (Approved) 6. Contract between Grant County and Gregory Drilling for the drilling of three (3) groundwater monitoring wells at the Grant County Fairgrounds for the purpose of carrying out the Groundwater and Effluent Monitoring and Reporting Plan for the Grant County Fairgrounds. Period of performance is June 18, 2oi2 through August 6, 2012. (Approved) 7. Grant County's funding application for the Washington State Department of Commerce's Emergency Solutions Grant in the amount of $89,862; of this amount, $6,269 will be for Grant County's administration of the grant. (Approved) C Carter with B Fode, Exit Interview Citizen Public Comment Period Rich Walpole and Phil Bloom came to discuss the recent public hearing held June 5, 2oi2 when Maiers Development applied for a water franchise for Desert Hills. The franchise was denied by the Commissioners because it was done without permits or approved plans. They are aslcing today for the Commissioners to reconsider their denial. The Commissioners will discuss the process with Derelc Pohle, Public Worlcs Director. Claims Payment Request (Batch o1-�.1) from the Multi Agency Communication Center in the amount of $264,568.�2. (Approved) TREASURER'S OFFICE �. Pursuant to RCW 54.28.ogo, request to distribute the PUD Privilege Tax funds received in the amount of $2,goi,641.84 as provided on a listing by the Treasurer. Execution of WA State Department of Transportation Local Agency Agreement for the Dodson Overlay project. (Approved) 2:0o p.m. — 2:2o p.m. Open Record Public Hearing, Yellowstone Pipe Line Company Franchise Hearing The Commissioners held an Open Record Public Hearing to consider renewing the franchise for Yellowstone Pipe Line Company for a period of fifty (50) years to construct, operate and maintain a 6" refined petroleum products over, under, along, and across certain County roads in Grant County, Washington lying within the following described portion of the County, to-wit: Along the following roads: i1-NE, W-NE, V-NE, 10-NE, T-NE, S-NE, R-NE, 9-N�, Q-NE, P-NE, 8-NE, N-NE, M-NE, 7-NE, L-NE, K-NE, J-NE, 2oth Ave. NE, i9th Ave. NE, and 6.� NE. Derek Pohle, Public Works Director recommends approving the franchise but with some amendments. One change is not renewing the term for 5o years but possibly 10 years. Another change will be the annual fee incurred between $5,000 -$7,500. Indemnification language will also need to be amended. Lee Pence, Civil Deputy Attorney, stated he has no verbal comment for the record but will disseminate his written opinion. Mike Kunz, Yellowstone Pipeline, Montana, stated he had not seen anything yet on fees. He gave a brief history on the pipeline. Larry Oswald, Yellowstone Pipeline, Montana, stated they have never been charged a fee. They only have g000 ft. of pipeline in County road right of way and in county road crossings. Commissioner Stevens seconded and the motion passed with 2 Commissioners in attendance. Commissioner Swartz moved to approve the franchise with reservation on the duration of the franchise and fee to be determined. Commissioner Stevens seconded and the motion passed with 2 Commissioners in attendance. In attendance were Commissioners Stevens, Carter, Swartz, and Lee Pence, Civil Deputy Attorney. The Commissioners approved and signed the Grant County Payroll Authorization form for the June 8, 2oi2 payroll. The Commissioners approved and signed the Grant Public Works County Payroll Salary Fund for June i5, 2oi2. As of this date, the Board, by a majority vote, does approve for payment those vouchers certified by the auditing officer as required by RCW 42.24.080, and those expense reimbursement claims certified by the auditing officer as required by RCW 42.24.090, in the amounts of $154�936.81 and $5g�,165.ig, as recorded on a listing and made available to the Board.
