Cornmissioner Carter was out and excused. 9�3o a.m. —12:0o p.m. 10:3o a.m, —10:5o a.m. 1i:oo a.m. —1�:io a.m. C Carter at Neils v Grant County Mediation (Spolcane) L Stoltman, Conservation District Update Open Record Public Hearing, Coroner's Office and Prosecuting Attorney's Office Budget Extensions Commissioners held an Open Record Public Hearing to consider a budget extension request from the following Grant County Offices: r. 2. 3• Coroner's Office Fund #ooi, Department #i2o in the amount of $2,851.0o for out of state travel expenses to attend the International Association of Coroners and Medical Examiners convention in Las Vegas, NV; Prosecuting Attorney's Office Fund #001, Department #io9 in the amount of $58,6i8.00 to cover the salary and benefits of a new Prosecuting Attorney position primarily responsible for handling contested infraction dockets. Prosecuting Attorney's Office Fund #001, Department #109 in the amount of $1g,165.38 to cover step increases and related benefits granted by the Commissioner's Office effective January i, 2oi2. Commissioner Swartz moved to close the public comment portion of the hearing. Commissioner Stevens seconded and the motion passed with 2 Commissioners in attendance. (Resolution No. i2-og6-CC) i:3o p.m. — 2:2o p.m. 2:0o p.m. — 2:2o p.m. D Pohle, Public Works Update Open Record Public Hearing, Maiers Development Corp Franchise Application for Baseline .5 SE The Commissioners held an Open Record Public Hearing to consider a franchise application from Maiers Development Corporation to construct, operate and maintain Desert Hills Water System to convey potable water and irrigation water under, across and along county road Baseline .5 SE within Desert Hills Major Plat, located within the North half of the Southwest quarter of S 6, T i8 N, R 2� E, W.M. Derek Pohle, Public Worlcs Director discussed the project from Desert Hills Water System, owned by Bob Fancher, for the Desert Hills Plat. The proponent is requesting to use the outer io feet of the Baseline .5 SE right of way. Grant County policy is the outer 5 feet of the outer right of way. Grant County discovered the stated owners installing this system in the County right of way earlier this year during routine inspections by Road District Staff. He stated this operation had begun illegally without any franchise in place or permits or approved plans. On March 14, 20�2 they were issued a cease and desist order. They were given 2 options: i) Remove their illegally installed water system out of the right of way and install them into their own utility easement that were provided within their own Plat; or 2) attempt to apply for a franchise, which is why we are here today. In either case, their installations do not comply to county conditions/policies so even if they were granted this franchise, they would not be able to acquire approved plans or permits from County Engineers Office without moving their existing installation to within the utility accommodation corridor on the other side of the county road. COMMISSIONERS' JUNE 4, 2oi2 MINITTES Page g of 6 Public Worlcs recommendation is to deny the franchise request and require them to remove illegally installed system from the Right of Way and use their own utility easement provided in their Plat to install their water systems. The second option is to grant the franchise and require them to meet the county standards which would require them to remove their illegally installed water systems and put them in compliance with our utility accommodation policies within the corridor. Commissioner Stevens aslced if the engineering firm was Columbia Northwest Engineering, Derek stated yes. And clarified that Pamp Meier's Development Corp and asked if these 2 firms should know the process? Derek stated yes, they are both well-seasoned companies and should have been aware of the requirements to get a franchise. Commissioner Stevens stated they must have made an honest mistake and are now asking for a franchise to talce care of their mistake. Discussion ensued. Commissioner Swartz moved to close the public comment portion of the hearing. Commissioner Stevens seconded and the motion passed with z Commissioners in attendance. Commissioner Swartz moved to approve the recommendation of the Public Works Department and deny the franchise application. Commissioner Stevens seconded and the motion passed with 2 Commissioners in attendance. The hearing adjourned. The only bid received was from Gray and Osborne, Tnc.(A motion was made by Commissioner Swartz, seconded by Commissioner Stevens, to hire Gray and Osborne, Inc. as the Grant County Fairgrounds Sewage Engineering Firm.
