APPROVING A PRELIMINARY PLAT
OF
PHEASANT ORCHARD VI�W
ESTATES
WI-I.EREAS, the Board of County Commissioners of Grant County have been advised that open
record public hearings were conducted before the Grant County Planning Commission on September 7,
2011, and. on October .5, 201 l, in the matter of a Preliminary Plat of approximately 251.02 acres to create
five (5) lots from two existing parcels, which are located in a portion of Section 29, Township 21 North,
Range 26 East, Willamette Meridian, Grant County, Washington, and
WHEREAS, the Grant County Planning Commission on October 5, 2011 did approve a motion
to recommend to the Board of County Commissioners to approve this proposed Preliminary Plat with
nine (9) suggested Conditions of Approval and seven (7) Findings of Fact affirming the recommendation,
and
�VIIEREAS, the Board of County Commissioners held a closed record public hearing regarding
this matter on November 21, 2011, and
WHE1tEAS, the Board of County Cornmissioners have reviewed the application material, staff
report, and a summary of the Pl�nning Commission hearings, and
WHEREA.S, the Board of County Commissioners have found th�t this proposal will not
adversely effect the health, safety, and general welfare of the public in the vicinity of the proposal, and
WHEREAS, the proposed Preliminary Plat, subject to the Conditions of Approval, meets the
applicable requirements of the Unified Development Code Chapter 22.04 "Land Division," and
WHEI2EAS, the Board of County Commissioners have found that the public use and interest will
apparently be served by the proposed Preliminary Plat, and
WHEREAS, the Board of County Commissioners have found this proposal to be consistent with
the Grant County Comprehensive Plan, the Shoreline Master Program, the Unified Development Code
Chapter 23.04 "Zoning" and other land use regulations, and SEPA, and
WHEREAS, the proposed Preliminary Plat does comply with the Health District's requirements
for sewage disposal and potable water supply, and
WHEREAS, the proposed Preliminary Plat does contain an accurate legal description of the lots
being created, and the roads and easements therein, and.

WHEREAS, the proposed Preliminary Plat does comply with Grant County regulations and9
where applicable, all WA State Department of Transportltion xegulations pertaining to roads, utilities,
drainage, access for emergency vehicles, and other infrlstructure improvements, and
V�'H�REAS, the proposed Preliminary Plat does comply with all requirements of the Un�ted
States Dep�rtment ot'the Interior, the United. States Bureau of Reclamation, and the Quincy-Columbia
Basin Irrigation District, and
WFIEREAS, the Board o£ County Commissioners have made a decision to approve the Phelsant
Orchard View Estates long plat,
I�TOW, THEREFORE, BE IT RESOLVED THAT the Board of County Commissioners of
Grant County, Washington hereby approve b� this Resolution, subject to the nine (9) Conditions of
Approval listed below, a Preliminary Plat of approximately 251.02 acres to creata five (5) lots, located.
in a portion of Section 29, Township 21 North, Range 26 East, Willamette Meridian, Grant County,
Washinglon (Parcels #20-0667-000 8� #20e0668-000).
CONDITIONS OF A.PPROVAL
1) The applicant shall comply with all requirements as deemed necessary by the Grant County I�ealth
District, including, but not limited to:
a) The applicant shall contact the Grant County Healtla District regarding the suitability for septic
system installation.
2) The applicant shall comply with all requirements as deemed necessary by the Grant County Public
Works Department, including, but not limited to:
a) Provide a plat check fee of $200.00 for Major Plats.
b) Scale shall be a minimum of 1" = 100 ft.
c) Provide a Pl�t Certificate from the title company for all land being dedicated to Grant County.
d) Show adjacent subdivisions on the face of the plat.
e) An Approach Permit shall be obtained prior to a Building Perniit.
� On Sheet 2, the road is labeled B.5-NW. It should be 13.5-NW, Also, 12-NW sh.ould be
labeled as Martin Rd. on the vicinity map.
3) The applicant shall comply with all requirements as deexned necessary by the Grant County Auditor,
including, but not limited to:
a) The name "Pheasant Orchard View Estates" zs approved.
4) The applicant shall comply with all requir•ements as deemed necessary by the U.Se Bureau of
Reclamation, including, but not limited too
a) All survey data on Bureau of Reclamation Farm Unit Maps pertaining to Reclamation
facilities, associated rights-of-w�y, and farm unit boundaries within the are� being subdivided
must be included on the plat.
b) Landowners should be aware of existing Reclamation and District rights to construct,
reconstruct, operate, �ind maintain Proj ect facilities as necessary. Any work that will involve
these facilities or the existing rights-of-way must be reviewed and approved by R.eclamation.

c) Stnictures are prohibited frorn encroaching upon existing right-of-way corridors vvithout
Reclamation's and the District's prior approval. This includes, but is not liinited to, temporary
improvements such as paving, fencing, and landscaping.

d) Recl�mation's concurrence to this proposal is conditioned. upon the assumption that there are
no encroachments upon. Pxoject facilities or rights-of way.
e) Lots 2, 3, 4, and 5 of the proposed plat consist of less than 10 acres per lot. 'The Bureau of
Recl�mation recommends that the agricultural water supply be released from those portions of
land. As a result, the landowner would be relieved of future obligations for payment of annual
�ssessments to the District for those acres. Th.e proponent can initiate this process by
contacting the District headquarterso
� This proposal is located within the Quincy Ground Water Subarea (QGWSA). The proponents
will be required to obtain both a Ground Water Permit from the Washington State Department
of Ecology and a QGWSA license from Reclamation if they plan to use an amount of vvatez°
that exceeds the qu�ntity allowed in an exempt ground water withdraw made pursuant to RCW
90.44.050.
5) The applicant shall comply with all requirements as deemed necessary by the Quincy-Columbia Basin
Irrigation District, including, but not limited to:
a) The applicant is required to pay a Quincy-Coluix�.bia Basin Irrigation District Short Plat Fee of
$50 for the first split (first two lots), plus $10 for each additi.onal lot.
b) A useable irrigation right�of-way from the legal point of water delivery to each segregation
within the Farm Unit is to be drawn on the face of the plat. If access to the turnout cannot be
obtained, the water must be released before the pl�t is signed.
6) The applic�int shall comply with all requi�ements as deemed necessary by the WA State Department
of Ecology (Spokane—SEPA Coordinator), including, but not limited to:
a) Any ground water development proposal that will withdraw water in excess of 5,000 gallons
per day for single or group domestic supply, or for industrial purpose, or for the irrigation of
more than %2 acre of lawn or non commexci�l garden will require a permit from the
Department of Ecology.
7) The applicant shall comply with all requirements as deemed necessary by the Grant County Planning
Department, including, but not limited to:
a) Development shall comply with the requirements of GCC § 22.04 Article V"Final
Subdivisions and Short Subdivisions" and a11 other pertinent portions of Grant County Code.
b) Please make the following corrections/additions to the rnapping:
i. In the Vicinity Map on Sheet 1 of 2, Martin Rd. NW appears to be mislabeled. Please
correct as necessary.
ii. On Sheet 2 of 4, Rd, 13.5 NW appears to be mislabeled (2 occurrences). Please correct
�s necessary.
iii. In the Legal Description on Sheet 3 of 4, please correct the minor misspelling of
"Washin tg�on" in line 2 of paragraph 4.
iv. In the Legal Description on Sheet 3 of 4, please correct the minor misspelling of
"wastewav" in line 14 of paragraph 5.
v. In the Exceptions on Sheet 4 of 4, please correct the minor misspelling of "Columbia99 in
line 3 of Exception 1.
vi. In the Exceptions on Sheet 4 of 4, please correct the minor misspelling of
"appurtenances" in line 2 of Exception 3.
vii. In the Exceptions on Sheet 4 of 4, please correct the minor misspelling of "respectively"
in line 4 of Exception 3.
viii. In the Exceptions on Sheet 4 of 4, please correct the minor misspelling of
"res ectivelX" in. line 3 of Exception 7.

8) In accordance with RCW 90.44.050, domestic water use for the five lots proposed by this proj ect sh111.
be restricted as follows:
a) The tot�l maximum amount of water withdrawal (allowed for the project as a whole) is 5,000
gallons per day. A Note shall be added to the face of the plat to reflect this restriction.
b) Each of the five proposed lots is limited to a maxixnum of 1,000 gallons of domestic water per
day. A Note shall be added to the face o� the pl�t to reflect this restriction.
c) Because 1,000 gallons per day is less than WA. St�te Department of Health requirements, the
applicant shall contract with the U.S. Bureau of Reclamation for an adc�itiona1250 gallons of
irrigation water per day for each lot.
9) Additional irrigation water shall be made available for the lots proposed by this proj ect, Provision of
water by a 10-ft. irrigation easement along the north boundary of the proposed lots shall be depicted on
the face of the plat. A copy of the contract entered into with the U.S. Bureau of Recl�xnation shall be
submitted to the Planning Department prior to final recording of the plat.
