HomeMy WebLinkAboutOrdinance 11-069-CC BOARD OF COUNTY COMMISSIONERS GRANT COUNTY, WASHINGTON ORDINANCE: 11-��I-CC An Ordinance relating to the amendments of the Unified Development Code to allow electric vehicle infrastructure: Chapter 23.04—Tables 3,4,and 5 Chapter 25.02-I)efinitions Recitals: WI3EREAS,the Board of County Comrriissioners of Grant County intends to comply fully with the laws and regulations of the State of Washington, and; WI3EREAS,the Board of County Commissioners of Grant County adopted a Growth Management Act compliant Comprehensive Land Use Plan in September of 1999, subsequently amended in 2006, and; WHEREAS,the Board of County Commissioners of Grant County adopted a Unified Development Code implementing the Comprehensive Plan on October 1, 2000, amended periodically thereafter to comply with changes in the law, and; WHEREAS,the Unified Development Code Chapter 25.12"Legislative Action"provides a process for amending the Code, and; WHERAS,the Washington State Legislature adopted new legislation that mandated all Counties in the State of Washington to make provisions for Electric Vehicle Infrastructure within certain zoning districts in the County, and; WHER�AS, the Grant County Planning Department initiated an amendment,under Chapter 25.12 to the Unified Development Code by amending several sections as outlined in Attachment 1, and; WHEREAS,the Board of County Coxnmisszoners of Grant County have been advised by the Grant County Planning Comrnission that an open record public hearing was conducted on August 3, 2011, on the matter of amending the Grant County Unified Davelopment Code, and; WHEREAS, on August 3, 2011 the Grant County Planning Commission voted unanimously to recommend to the Board of County Commissioners, approval of the LTDC Amendment requests with one recommended change and; WHEREAS,the Board of County Cominissioners of Grant County held an open record public hearing on August 29, 2011, and; WHEItEAS,the Board of County Commissioners have been advised by the Grant County Planning Department that the proposed UDC Amendments were processed in accordance with the requirements of UDC Chapter 25.12"Legislative Action"; and, �'���;�>`�f�;�n��°�z�,�-`;���.a�,�ti.��. � ���' � 2011 txFtF,i�d7"{;e.)�.JiV'`d"Y t:C)1V'N91,f�s'.`.�`9(SP9��E�� L,.a,._,....,,.f..,,...._...6.>.�_,�.��- .�.en..e._at._iL+ulr._..A._.u..�_aaa._�•._,..a�.-_5:?. i An ordinance relating to amendments of the i �Unified Development Code§23.04,and 25.02 ' WIIEi2EAS,the Board of County Commissioners have been advised by the Grant County Planiung Department that the proposed UDC Amendments were processed in accordance with the requirements of ITDC Chapter 24,04"State Environmental Policy Act"; and, WI��REAS,the Board of County Commissioners have found that the proposal is consistent with the Grant County Comprehensive Plan; and, WIIEREAS,the Board of County Commissioners has found that,the LTDC Amendments will serve the public use and interest. NOW,THEREFORE,the Board of County Commissionars of Grant County does hereby ordain amending the Grant County Unified Developznent Code specifically Chapters 23.04 and 25.02 as outlined in Attachment#1.
