An oa�dinance relating to an amendment of the Grant County Zoning Map, chan�in� the '
zoning of 55 parcels located in the Lakeview Park Plat from Urban Commercial 1 to Urban
Residential - 4. The parcels are located in Section 25, Township 22 North, Range 26 East,
W.M., Grant County, WA. (Parcel #'s 08-1244-004, 08-1244-006, 0�-1245-000, 08-1245-
001, 08-1247-000, 08-1246-000, 08-1248-000, 08-1249-000, 0�-1251-000, 08-1250-000, 08-

Recitals:
WHEREAS, in compliance with the Growth Management Act of 1990, Grant
County adopted a Comprehensive Plan in September of 1999 and a mandatory update in 2006,
and
WHEREAS, Grant County adopted the Unified Development Code (UDC) in
October of 2000, establishing official zoning districts in conformance with the Comprehensive
Plan, and
�
WHEREAS,the Unified Development Code Chapter 25.12 "Legislative Actions" �
§ 030 establishes a process for making Amendments to the Comprehensive Plan, and �
�
WHEREA�,the Unified Development Code Chapter 23.04 "Zoning Districts" § (
150 establishes a process for Minor Zoning Amendments (Minor Rezones)which are consistent ;
with the goals and policies of the Comprehensive Plan, and �
WHEREAS, on the 1 St of March, 2004, Resolution No. 04-036-CC was adopted
by the Grant County Board of Commissioners, which, in part, established the Comprehensive
Plan designation for the subject properties as "Residential-High Density" and
WHEREAS, an application(#09�5333) for a Minor Zone Change has been

processed in accordance with the UDC Ghapter 23.04 "Zoning Districts'", Chaptex�24.04
"SEP11", and Chapter 25.04 "Permit Application Review Procedures," and
WHEREAS,the Grant County Platzning Cammission held an(�pen Record
Public Hearirlg regardizag this proposed Minar Zone Change, dt�rit�g their regular meeting on
�ugust 3, 2011, after which they voted unaninlously to recommend approval of t1�is Minar Zon�
Change for aIl but 4 parcels. The faur parcels being 08-1].15-005, 08-1115-006, 08-1115-007
and 08-1115-008, and
WHER�AS,the Grant Caunty Board of Cammissioners 11e1d a Clased Record
Public Hearing regaxding this proposed zone change an Scptember 12, 2011, and
WHEIt�AS, after consideration of the Planning Cammission's recommendation
and staff comments, th� Boatd of County Cammissianers voted to approve this Minar Zone
Changa for all parcels, and
WHEREAS,the Grant County Baard of Can�mzssioners have establ'zshed the
Follawing ten"Fifldings o�Fact" supporting their appraval of tl�is Minar Zane Chaxage:
1} The proposed re�one will not be contrary to the intent ar purpases and regulations of the
Grant County Code or the Camprehensive Plan;
2} The property in question is suitable for uses allowed under the proposed zonis�g district;
3) Uses allowed under the proposed zone change are compatible with neighboring land uses;
4) The proposed rezone can be served by adequate facilities including access, fire protectiot�,
water, storm-water contral, ancl sewage dispasal facilities;
5) Substantial chan�es do exist to warrant an amendment ta the current zaniz�g district;
6} A public need does exist for the proposed rezone. Public need shall inean that a valid public
purpose, for which the camprehetlsive plan and this cllap�er have been adoptcd, is served by
th�proposed rezone;
7) The proposed rezone will not rest�lt in significant adverse impacts on the human or natural
environinents that cannot be mitigated by canditions af approval;
$) The cumulative impact of additional requests for like actions (the total of the rezones ov�r
tirne or space)will not produce significant adversa effects to the environment that cannot be
mitigated by conditions of approval;
9) The pedestrian and vehicular traffic associated with the rezone will not be hazardous to I,
existing and anticipated traf�c m the neighborhood; and
10)Tlae proposed zaning district d�es nat include any allowable use or activity that would result
in th�locatian of an incompatible use adjacent ta an airport or air�eld(RCVV 36.70}. `

NOW, THEREFORE, BE IT ORDAINED,that the Grant County Board of �
County Commissioners hereby rescind the current zoning designation of Urban Commercial- 1 ;
