WHEREAS, the uninterrupted continuity of powers and duties of the Board of County
Commissioners, and County offices and departments, need to be preserved in time of emergency or
disaster as defined in Chapter 38.52 RCW, and/or enemy attack as defined in Chapter 42,14 RCW;
and
WHEREAS, Chapter 42.14 RCW, the Continuity of Government Act, provides authority
for identification of a succession of powers the Board of County Commissioners, and elected and
appointed offices; and
WHEREAS, pursuant to Chapter 42.14, "unavailable" means either that a vacancy in the
office exists or that the lawful incumbent of the office is absent or unable to exercise the powers and
discharge the duties of the office following an attack and a declaration of existirig emergency by the
governor or his/her successor; and
WHEREAS, pursuant to Chapter 42.14,

NOW THEREFORE, BE IT RESOLVED AND ORDAINED THAT THE BOARD OF
COUNTY COMMISSIONERS adopt this resolution regarding rules %r succession of powers and

SECTION 1. If emergency or disaster as defined in Chapter 38.52 RCW, and/or enemy
attack as defined in Chapter 42.14 RCW reduces the number of available County Commissioners,
then those members that are available for duty shall have full authority to act as a Board of County
Commissioners.
SECTION 2. In the event that no County Commissioner is available, then those elected
county officials as are available for duty shall jointly act as a Board of County Commissioners and
sha11 possess by majority vote the full authority of the Board of County Commissioners regarding
the emergency and/or disaster and/or attack at hand.

SECTION. 3. Each office and department of the County sha11 designate a line of succession
for the discharge of emergency actions in the event that the incumbent office holder or department
director is unavailable.
SECTION 4. Any county officer succeeding to an office on a temporary interim basis shall
discharge the duties of that office only until such time as the elected or appointed officer is available
for duty or a regular successor is appointed by the ordinary means applicable to the office.
SECTION 5. Whenever such emergency and/or disaster and/or attack prevents the conduct
of County affairs and/or business at the regular or usual site, the Board of County Commissioners,
and—all—C—ounty—offices—and departm�ri ya otherwise meet at any place or si e�ided a
reasonable effort is made to notify the public of the emergency relocation. After such relocation,
the affairs and/or business of the County shall be lawfully conducted at such location for the
duration of the emergency and/or disaster and/or attack.
SECTION 6. If any provision contained within this resolution, or its application to any
person, party or circumstance is held invalid, the remainder of this resolution or the application of
provisions to other persons, parties or circumstance, shall not be affected.
