GRANT COUNTY, WASHINGTON
ORDINANCE: 09-�-CC
An ordinance relating to the adoption of official zoning designations
for the following Lamited Areas of More Intensive Rural I)evelopment
(LAMIRDs): Schawana, Beverly, Wheeler, Royal Camp, Parker
Springs, Trinidad, Wanapum Village, Marine View Heights, White
Trail, Desert Aire, Mae Valley, Blue Lake Shore, Crescent Bar, The
Gorge, North Soap Lake, Marine View Area, Winchester, Ruff,
McDonald Siding, Ballards Cafe, Stratford North and South,
McDonald Frontage Area, Ballard Area, Coulee City Area, Ephrata
Area, George Area, Jet Farms Area, Marine View Area, Mattawa,
Moses Lake Area, O'Sullivan Shores Area, Quincy Area, Rocky Ford
Area, Royal Slope Area, Silica Road Area, Soap Lal�e Area, Stratford
Road and Park Orchards Area, and Warden Area.
RECITALS:
WHEREAS, the Board of County Cornmissioners (the "BOCC") intends to
comply fully with the orders and directives of the �astern Washington Growth
Management Hearings Board (the "Board") issued in case Nos. 99-1-0016 and 99-1-
0019; and
WHEREAS, the Eastern Washington Growth Management Hearings Board has
dismissed the final remaining appeals in case Nos. 99-1-0016 and 99-1-0019 filed against
the County's Comprehensive Plan; and
WHEREAS, the Eastern Washington Growth Management Hearings Boasd has
found the Limited Areas of More Intensive Rural Development (LAMIRDs) and
associated Land Use Designations in Resolution 04-007-CC to be GMA Compliant; and
WHEREAS, the County fully intends to continue and complete tha work plan to
bring the LAMIRDs into full compliance with the Final Decision and Orders of the Board
and the Act through the amendment and adoption o� an updated Zoning map in order to
implement Resolution 04-007-CC; and
WHEREAS, the Grant County Planning Commission conducted an open record
public hearing on June 3, 2009 to review the proposed rezone for the affected LAMIRD
areas; and
WHEREAS, the Grant County Planning Commission recommended approval of
the final official zoning designations for the affected LAMIRDs; and
WHEREAS, the official zoning designations are the same as the interim zoning
designations that have been in place since 2004 and are consistent with the adopted
Comprehensive Plan land use designations; and
WHEREAS, the Grant County Planning Commission recommended that the
Board of County Commissioners direct staff to review the Wheeler 4 LAMIRD and the
Stratford Road/Parlc Orchard LAMIRD to verify the Logical Outer Boundary and the
appropriate location for the zoning designation boundaries during the 2010
Comprehensive Plan Amendment Cycle, and
WHEREAS, the Board of County Commissioners finds that the proposed rezone
will not be contrary to the intent or purpose and regulations of the Grant County Code or
the Comprehensive Plan; and
WHEREAS, the Board of County Commissioners finds that the properties
subject to this rezone are suitable for the allowed uses under the proposed zones; and
WHEREAS, the Board of County Commissioners finds that the proposed zoning
and allowable uses under those zones are compatible with neighboring land uses; and
WHEREAS, the Board of County Commissioners finds that the properties
subject to the razone can be served by adequate facilities including access, �re protection,
water, stormwater control, and sewage disposal facilities; and
WHEREAS, the Board of County Commissioners finds that substantial changes
exist that do warrant an amendment to the current zoning district; and
WHEREAS, the Board of County Commissioners finds that there is a public
need for this rezone; and
WHEREAS, the Board of County Commissioners finds that the proposed rezone
will not result in significant adverse impacts on the human or natural environments that
cannot be mitigated by conditions of approval; and
WHEREAS, the Board of County Commissioners finds that the cumulative
impacts of additional requests for like actions will not produce signi�cant adverse effects
to the environment that cannot be mitigated by conditions of approval; and
WHEREAS, the Board o� County Commissioners finds the proposed zoning
districts do not include any allowable use or activity that would result in the siting of
incompatible uses adjacent to an airport or airfield.
WHEREAS, the Board of County Commissioners finds that the proposed zoning
is to be consistent with the findings and conclusions of Ordinance 04-007-CC.

NOW, THEREFORE BE IT ORDAINED, the Grant County Board of County
Commissioners adop�s official zoning designations for the affected LAMIRDs that are
consistent with adopted Land Use Designations adopted in Resolution 04-007-CC.
NOW THEREFORE BE IT FURTHER ORDAINED, that Ordinance 09-016-
CC which established the interim zoning for the affected LAMIRDs is repealed as of the
date that this ordinance is signed.
FURTHER BE IT ORDAINED, that the Grant County Planning Department
review the Wheeler 4 and Strat%rd Road/Park Orchard LAMIRDs during the 2010
Comprehensive Plan Amendment cycle for the purposes of reviewing the Logical Outer
Boundary and appropriate zoning designation boundaries.
PASSED by the Board of Grant County Commissioners in regular session at Ephrata,
Washington, by the following vote, then signed by its membership and attested by its
Clerlc in authorization of such passage.
